Authorities: Chris Brown arrested on warrant

LOS ANGELES (AP) — Chris Brown was arrested Friday and will be held without bail on a warrant issued by probation officials in the latest legal entanglement for the R&B singer who has struggled to put his 2009 attack on Rihanna behind him.


The warrant was issued by the judge overseeing Brown’s case after he was informed Friday morning that the singer had been discharged from rehab “for failure to comply with rules and regulations of the program.” No further details were released, but more information will be presented to Superior Court Judge James R. Brandlin when Brown appears in his courtroom on Monday afternoon.


Sheriff’s officials said Brown was cooperative when he was arrested at a Malibu treatment facility where he had been staying and transported to a jail facility in downtown Los Angeles.


Brown had been ordered to remain in rehab for anger management treatment. A January letter from the facility stated that the singer was also being treated for bipolar disorder, post-traumatic stress disorder and past substance abuse.


An email sent to Brown’s attorney Mark Geragos was not immediately returned. A probation spokeswoman declined to comment on what prompted Brown’s arrest.


Brown’s probation for the Rihanna assault had been scheduled to end this year, but a judge revoked it last year after Brown was arrested on a misdemeanor assault charge in Washington, D.C. That case is pending.


Brandlin rejected a Los Angeles prosecutor’s request to send Brown to jail because of the Washington case, citing his progress in rehab. He has ordered Brown to stop smoking marijuana and take only prescribed medications; the singer has not failed any drug screenings since the order was made.


In addition to getting treatment, the singer remained under strict orders to complete 1,000 hours of community labor this year. A probation report dated Feb. 26 stated that Brown had completed 250 hours and that he was being cooperative with probation officials.


Brown’s attempts at treatment have not been without difficulties.


A rehab center where Brown was voluntarily staying reported to Brandlin that the singer threw a rock through his mother’s window during a joint counseling session in November. The judge then ordered Brown to remain in treatment for another three months and renewed that order at a hearing on Feb. 28.


A probation officer interviewed Brown for the February report, saying the singer was grateful to be in rehab and “looks forward to staying out of trouble.”


“He remains thankful to the court for the opportunity to find out and learn more about himself, his anger issues and the type of person he wants to become, which is a man who is able to better himself and be a positive role model,” the report states.

The idea, forwarded by City Councilman Sam Liccardo, calls for citizens to volunteer their own CCTV systems, registering them with local law enforcement, so police can monitor whatever the cameras are trained on.


While the proposal suggests that police would have access to the cameras after a crime, remote accessibility means that cops could potentially monitor camera feeds in real time, which would amount to a violation of the Fourth Amendment.


The proposal is a desperate response to surging crime rates in the city. The idea came about after local business owners volunteered CCTV footage following a series of arson crimes in a downtown district.


“It became apparent that there’s a lot of evidence out there that residents want to provide,” Liccardo said, adding that costs would be limited because the security systems are privately operated.


Liccardo also suggested that a camera database would be compiled and maintained by existing city officials. The new database “is something that costs very little but could have a big impact in making San Jose safer.” the councilor said.


San Jose’s independent police auditor, retired judge LaDoris Cordell, lauded the idea, calling it a logical step and stating “You tend to behave when the cameras are on you.” Dismissing the notion that the proposed system would represent an “intrusion on privacy,” Cordell instead described it as allowing residents to “know what’s going on in their neighborhood.”


Electronic Frontier Foundation attorney Hanni Fakhoury, noted that the proposed system is wide open to abuse. “Once you give the police unfettered access 24/7, you’re relying on them to exercise their restraint.” Fakhoury said.


“To me the really interesting and troublesome part of it is the way we are starting to privatize government surveillance — to enlist private citizens in a way that is kind of unprecedented and could be potentially really dangerous.” the attorney added.


The proposal is not limited to San Jose, cities such as Philadelphia and Chicago, as well as towns such as nearby Los Gatos and Monte Sereno have already launched similar systems of surveillance.


Officer Catherine Mann of the Los Gatos/Monte Sereno Police Department said “We haven’t had any negative responses, once we get it out to them that this is not a ‘Big Brother’ ” situation. “We’re not sitting around watching live videos from their home.” she added.


Police in San Jose say they are exploring the “merits of the idea”, which is set to be discussed by a City Council committee this week.

Law enforcement officials are investigating a threat against Sen. Ted Cruz (R-Texas), who was vaulted into national prominence with his push to defund ObamaCare.


A person identifying himself as Troy Gilmore Jr., posted on Twitter Friday morning: “Take down Ted Cruz, at his home” and listed Cruz’s home address in Houston.


“What goes around comes around CRUZ!!” the person wrote.


The author of the threat uses the Twitter handle @ArmyVet54 and identifies himself as having served in the U.S. Army and Navy.

Texas Rep. Sheila Jackson Lee reintroduced a bill on the House floor Wednesday that will prohibit states from having “Stand Your Ground” laws, and require neighborhood watch programs to register with local law enforcement and the Department of Justice. States that fail to follow these guidelines will be penalized by a 20 percent cut in federal funding.


According to Jackson Lee, “We will … decrease the incidence of gun violence resulting from vigilantes by reducing by 20 percent the funds that would otherwise be allocated … to any state that does not require local neighborhood watch programs to be registered with a local [law] enforcement agency.”  


The Justice Exists for All of Us Act would require that states change Stand Your Ground Laws to Duty to Retreat. In other words, if a person is found in a situation in where they feel threatened, they will not be allowed to use force unless they have first “retreated” or tried to avoid an escalating situation by removing themselves from the location.


In other words, the person must avoid conflict with their aggressor by “retreating” in order to be justified in using force, even if the person has every right to be in that place to begin with. The aggressor then must follow and continue to initiate threatening behavior for the person to use force. Even then, the person still has the burden of proving that they were justified in that use of force.


Currently, Stand Your Ground laws allow for the use of force when one’s life is threatened provided that person has a lawful right to be in the location.


However, laws vary tremendously from state to state and while some laws are more specific, some leave gray areas that are ultimately interpreted by either a judge or jury.


The proposed act would also require that the establishment, organization or operation of a neighborhood watch program be registered with local law enforcement and the DOJ. Additionally, anyone who participates in such watch programs must also be registered within the same system.


While some neighborhood watch programs already work closely with local law enforcement, others do not. There are no strict and rigid rules and regulations for establishment or participation in neighborhood watch programs, as they were originally introduced as a way of neighbors simply looking out for neighbors. Additionally, in many areas, especially those riddled with high crime or rural locations, law enforcement is already stretched thin. Many of these areas simply do not have the extra resources to work with neighborhood watch programs to ensure that they are up to Jackson Lee’s standards.


The bill was originally introduced by Jackson Lee in June of last year in a previous session of Congress, but it has yet to be enacted. The proposed legislation was drafted as a result of the shooting of Trayvon Martin by neighborhood watch coordinator George Zimmerman.


Although Zimmerman was recently found not guilty on both murder and manslaughter charges, the case has thrown Stand Your Ground laws into the media and political spotlight, regardless of the fact that such laws had no effect on the case, as it was essentially a matter of self-defense, not Stand Your Ground.


While this fact was pointed out to Jackson Lee, her press secretary Mike McQuerry stated, “She just thinks it’s the right time to pursue it now.”


“Let’s speak to the pain of the American people,” Jackson Lee reiterated. “Let’s look at ways of fixing the law.”


But is the Stand Your Ground law broken and something that’s in need of fixing? That depends on who you ask.


Attorney General Eric Holder, who believes Martin was unlawfully murdered by Zimmerman as a result of racial profiling, agrees with Jackson Lee’s thinking, and feels that Stand Your Ground laws need to be repealed.


“We must confront the underlying attitudes, the mistaken beliefs and the unfortunate stereotypes that serve too often as the basis for police action and private judgments. Separate and apart from the case that has drawn the nation’s attention, it’s time to question laws that senselessly expand the concept of self-defense and sow dangerous conflict in our neighborhood,” Holder said earlier this month.


But what Jackson Lee and Holder have yet to publicly address is that the black community has actually benefited from the Stand Your Ground laws at a disproportionate rate, at least in the state of Florida anyway.

NORTH BAY VILLAGE, Fla. (AP) — Authorities were investigating Friday what caused the outdoor deck at a Miami-area sports bar to collapse, causing dozens of fans watching the NBA finals to plunge into a bay in a chaotic scene that sent 24 people to hospitals.


Many of those hurt had cuts and bruises, though one person suffered a fracture and two were in serious condition, officials said. About 100 people were watching the Miami Heat play the San Antonio Spurs when the deck at Shuckers Bar & Grill in North Bay Village, north of Miami Beach, gave way on Thursday night.


The deck was about 8 to 10 feet above the water’s surface, about the same height as a sea wall that runs along the bay.


Griselle Marino, a spokeswoman for Miami-Dade Fire Rescue, said Shuckers had passed a fire safety inspection in January. She said the restaurant’s main structure had a capacity of 74 people, but the rules for the deck would be enforced separately by North Bay Village city officials.


Marino said it’s largely up to restaurant and bar operators to ensure they don’t go over capacity.


“We can’t be policing every restaurant,” she said.


Friday morning, a small U.S. Coast Guard vessel was anchored off shore. The dock, which collapsed in a v-shape, was strewn with large potted palms, green plastic chairs and tables, and umbrellas. Some flip-flops and cell phones were scattered among sugar packets, mustard bottles and other condiments from the tables.


Structural engineer Morgan Villanueva said Friday as he arrived to inspect the dock that it appears a main beam on the western edge of the dock buckled, creating the collapse.


Villanueva said Florida building codes typically call for a deck that can support about 100 pounds per square foot.


“If people (watching the NBA finals) were excited and jumping, it’s going to be an additional load,” he said.


Right after the collapse, sports bar customers — and later rescuers — helped people from the water amid yelling, crying and a rush to find people who might be submerged.


One witness, Martin Torres, 42, of Los Angeles, said he was inside the sports bar with family and friends when heard what sounded like a loud explosion. At first, he thought a boat had struck the deck. He said he looked outside and saw people staring up from the water, and then he and others started helping them out of the bay.


“It was shock,” said Torres. “People were yelling. Nobody knew. People came out all wet. They were crying. For a while, nobody knows what was going on.”


Israel Marquez, 37, of Bakersfield, Calif., who like Torres was in Florida because he’s scheduled to board a cruise on Friday, said he “heard a big old snap. Boom. Like a shotgun blast.”


Marquez said he looked out at the deck, and “it all came down in slow motion.”


Many people seemed in shock, with cuts and gashes on their faces. He said he went to the edge and helped five or six people from the water before rescuers arrived.


“A lot of people were just shaken up,” added Eric Williams, 42, of Atlanta. He rushed to the scene with his son, and they jumped in to help people after they heard a loud noise from their room at the adjacent Best Western.


He described the scene as “pandemonium,” with people scrambling to get out.


There was initially some concern that people might have been trapped in the water beneath the crumpled deck. But divers searched the waters as helicopters overhead shined spotlights onto the scene, and Downey said later that everyone was accounted for.


“There were a lot of TVs and everybody was in celebration and it was loud. So when it started happening, some people didn’t even realize what was going on,” said Miami-Dade Fire Rescue spokeswoman Griselle Marino.


Heat player Dwyane Wade said after the game that his thoughts were with the injured fans.


“I’d like to share our concerns as an organization and our gratitude to our fans back in Miami, but share our concerns for all that were injured tonight at Shuckers restaurant,” he said.


North Bay Village is a small island in Biscayne Bay with a strip of restaurants, hotels, houses and condos that is attached by causeways to the mainland and also to Miami Beach. Pouring rain fell early Friday near the Shuckers site, where a reporter later observed pilings sticking out of the water where the deck once stood. Wood, chairs and palm trees were piled together in the water in a scene like after a hurricane.


Although not as trendy as South Beach, North Bay Village is one of the many tourist spots in and around Miami where locals and visitors converge.

(CNN) — The U.S. Marine believed responsible for the stabbing death of his wife in North Carolina along with a deadly shooting spree some 1,300 miles away in Texas had no known ties to the Lone Star State, authorities there said Wednesday.


Lance Cpl. Esteban J. Smith, 23, died Sunday in a shootout with Texas authorities after going on a two-hour rampage that left one person dead and five wounded, according to investigators.


Police in Jacksonville, North Carolina, also believe he stabbed his wife to death.


Authorities don’t know why Smith, an active duty Marine from Bakersfield, California, was 1,300 miles away from his duty station at Camp Lejeune, North Carolina, said Tom Vinger, spokesman for the Texas Department of Public Safety.


Tuesday, survivors of Smith’s Texas shooting spree said they were thankful to be alive.


“I don’t know how we survived it,” Casimiro Solis told CNN affiliate KTAB.


He said he and his wife, Charlotte Feldman, were on their way to work in Brady, Texas, when a man police identified as Smith came up to them with a “dead blank” look on his face and started firing.


Authorities counted 16 bullet holes in their truck.


Solis said hardware that attaches the shoulder belt to the truck caused one bullet that would have gone through Feldman to instead ricochet into the truck’s top.


“I really thought the side of my face was shot off,” Feldman told the station.


Feldman and Solis suffered only minor wounds in the attack.


In addition to Feldman and Solis, police say Smith killed Alicia Torres, 41, in Eola, Texas, shot at two people in Eden, Texas, and wounded Concho County Sheriff Richard Doane just north of Eden in central Texas.


Smith died in a firefight with state troopers and a game warden who arrived shortly after that incident.


Authorities found an assault rifle, a handgun and hundreds of rounds of ammunition in Smith’s pickup.


Smith’s wife, Rubi Estenania Smith, 21, was discovered dead Sunday afternoon at a motel near Camp Lejeune, according to police in Jacksonville, North Carolina.


Police located Rubi Smith’s body after agents with the Naval Criminal Investigative Service working on the Texas incident found some sort of evidence on Smith and contacted them for help.


Police didn’t describe the evidence.


It appeared she had been stabbed, police said.


Esteban Smith was a Marine rifleman who had served two tours in Afghanistan with the 3rd Battalion, 8th Marine Regiment, 2nd Marine Division, according to the Marine Corps.


He first deployed to Afghanistan from August 2010 to May 2011, then again from April 2012 until November.
