Americans for Responsible Leadership Wholly Funded by Koch-Linked Group

Americans for Responsible Leadership — one of the political nonprofits involved in a scheme last year that California authorities called political “money laundering” — spent more than $ 25.2 million last year, roughly a 13-fold increase over the $ 1.8 million it spent in the non-election year 2011.

And ARL received almost all its revenues — 97.6 percent — from a single organization linked to billionaire conservatives Charles and David Koch, the Center to Protect Patient Rights, making it practically a wholly-owned subsidiary of the latter group. In that sense it’s similar to another 501(c)4 nonprofit, American Future Fund, which obtained 92 percent of its 2012 funds from CPPR and one other Koch-linked group. 

ARL spent nearly $ 9.8 million in the 2012 elections, including $ 3.2 million against President Obama’s re-election bid, according to reports it filed with the Federal Election Commission. The rest was spent supporting Obama’s rival, GOP nominee Mitt Romney, and 20 other Republican candidates, most of whom were running for Senate seats.

That’s close to what the group told the IRS it spent on political activity in its annual tax filing covering 2012, which was obtained by OpenSecrets Blog: almost $ 9.9 million. ARL also gave $ 11 million to a group working on a California ballot measure and nearly $ 1.4 million to organizations fighting two Arizona ballot initiatives.

Groups organized under section 501(c)(4) of the tax code are supposed to be devoted to social welfare, and political activity (local, state or federal) can’t make up a majority of their spending. But, as ARL spokesman Barrett Marson noted, “IRS rules treat ballot initiative activity as lobbying and not political activity.”

Under federal law, these nonprofits also don’t have to disclose their donors, which is why they’re often referred to as “dark money” groups. But ARL last year was at the center of a case brought by the state of California, which demanded to know, under state law, who donated the $ 11 million that ARL sent to the Small Business Action Committee, a group that was fighting a tax-hike initiative and supporting a measure to cut the influence of labor unions. Under order from a state judge ARL eventually revealed that it received the funds from CPPR; CPPR in turn got the money from Americans for Job Security, another dark money group.

California wound up fining ARL and CPPR a total of $ 1 million and requiring the Small Business Action Committee to disgorge the $ 11 million to the state.

Somewhat ironically, ARL describes its mission as being to “further the common good and general welfare of the citizens of the United States by educating the public about concepts that advance government accountability, transparency, ethics and related public policy issues.”

Who’s getting paid?

The group’s top contractors included Direct Response LLC, which received $ 6.7 million for “consulting phone programs;” Direct Response was also a contractor for American Future Fund. Grassroots Outreach LLC — a company run by Nathan Sproul, who was at the center of allegations of Republican voter fraud last year — was paid nearly $ 1.4 million by ARL.

Despite the fact that efforts of ARL and other conservative dark money groups were largely for naught in that 2012 wasn’t a good year for Republican election victories, one individual in the Koch network seemed to make out very well: Sean Noble, the founder and president of the Center to Protect Patient Rights. ARL paid Angler LLC, one of several consulting firms he owns, $ 536,964, while American Future Fund paid Angler $ 5.3 million. And Angler plus two other consulting companies owned by Noble made $ 8.1 million from the Center to Protect Patient Rights.

In addition, the campaign against one of the Arizona ballot initiatives that ARL opposed was run by one of Noble’s firms. And ARL’s president, Kirk Adams — a former speaker of the Arizona House of Representatives — hired Noble to make ads for his ultimately unsuccessful bid last year for a seat in Congress, paying his firm DC London about $ 55,000.

But when it comes to the next big battle at the Defense Department — over sexual assault in the ranks — don’t expect Obama to lead the charge.

He hasn’t formally met with female Democrats who’ve made the issue a priority in Congress, despite repeated requests from one of them. He hasn’t endorsed any of their proposals. And his top aides have made no commitment to lawmakers and victims groups beyond pressuring military brass behind the scenes.

Obama could argue he’s still done more to stamp out sexual assault in the military than any other president, even raising the issue in front of military audiences.

“No military unit can succeed without discipline, without trust and without cohesion,” Obama told Marines at Camp Pendleton on Wednesday. “And that’s why we’re going to work together, all of us, to stop these crimes of sexual assault and uphold the honor and the integrity that defines the finest military on Earth. And that message is coming all the way from the top.”

But there’s little reason to think Obama will go beyond generic calls for change to take a clear stand on what he believes a serious overhaul should look like, even as the Senate debates competing proposals to tackle the very issue.

Members of his party aren’t expecting him to dive in since it would almost certainly cost Obama with military brass who have resisted significant changes for 25 years.

And Obama could even end up angering some Democrats since members of the party are divided on whether to remove prosecution of sexual assault cases from the chain of command or rely on the military hierarchy to enforce new policies.

“I’ve never counted on the administration. I just think it’s something we’re working here,” said Sen. Barbara Boxer (D-Calif.), who is partnering with Sen. Kirsten Gillibrand (D-N.Y.) on legislation to remove prosecution of sexual assault cases from the military’s chain of command.

Rep. Mike Turner (R-Ohio) said Obama “has been somewhat late to the game” on the issue, which Turner has been trying to help solve for years. He nudged the White House to support what the House adopted in its version of the defense bill, including provisions that expand legal counsel for victims, establish mandatory minimum sentences for convicted sex offenders and eliminate a commander’s ability to overturn a jury verdict.

“But I think people have not seen leadership out of the administration,” Turner said. “He wasn’t commenting on the issue until legislation had practically passed through the House.”

So far, the White House hasn’t said whether Obama would support the chain of command measure or any of the other proposals senators are still debating.

“We don’t comment on legislation at this point in the process, but as we’ve said, we are open to consideration of any ideas to improve prosecution, prevention and victim support,” said White House spokeswoman Caitlin Hayden.

Sen. Chuck Grassley (R-Iowa), who supports the command chain legislation, said he had his doubts Obama would step in during the critical moments of rounding up votes. “If he does, he’ll do it at the last minute,” Grassley said, adding that “legislating is too messy for him.”

Senate Armed Services Committee ranking member Jim Inhofe (R-Okla.), an opponent of the Gillibrand-led approach, teased that if Obama did support the proposal, it could scare off some Republican supporters.

And Obama might not do much to flip Democrats either, according to Sen. Claire McCaskill, the Missouri Democrat who’s spearheading opposition to the Gillibrand bill. McCaskill supports an alternative package of reforms.

“There’s very few Democrats that are undecided at this point. I don’t know if it would or not, if he weighed in, it would make a difference,” McCaskill said. She added that she’d “have a hard time imagining” Obama would take a different stance than Defense Secretary Chuck Hagel, who initially expressed doubt about Gillibrand’s bill.

But still, some Democrats are hoping to get Obama on board. Gillibrand is trying to sway undecided senators on her chain of command proposal and has been working the West Wing’s back channels with phone calls to Valerie Jarrett and lunch with Elizabeth Sherwood-Randall, the White House’s defense policy coordinator. She is also asking for face time with the president to make her pitch to remove the command chain, the same way she’s been approaching fence-sitting senators on the floor and in their personal offices.

“I’m doing everything in my power to make that happen. I’m going to marshal the evidence. I’m going to marshal the advocacy,” the New York Democrat told POLITICO.

Rep. Jackie Speier (D-Calif.), who like Gillibrand is advocating major changes in the military command’s oversight of prosecutions, said she’s been making personal pleas to Obama “every time I’m around him.” That included a brief moment with the president during picture time at the White House holiday party and when she handed him some papers about her legislation at the House Democratic retreat. She said she was also ready to bring the issue up during last week’s meeting in the Capitol with Obama.

“I was too far up the line to be able to get my question in,” she said.

Pressure is likewise building on Vice President Joe Biden to further challenge the Pentagon, with longtime allies noting the former Delaware senator’s own legislative résumé includes the original Violence Against Women Act in 1994 as well as its reauthorization earlier this year. “I know he hates this kind of violence,” said Eleanor Smeal, president of the Feminist Majority Foundation.

Senior White House aides including Tina Tchen, the chief of staff to Michelle Obama, and Lynn Rosenthal, the top adviser on violence against women and former executive director of the National Network to End Domestic Violence, have been heading up talks with lawmakers and victims groups. One recent session covered the transition for victims from military to civilian life and their struggles in getting health care.

Turner said he wasn’t impressed by a White House meeting in May that brought together 16 lawmakers who have been working on sexual assault matters — some for several years. “It was almost as if our office was putting out a 101 briefing of what the issues were and what the various pieces of legislation would accomplish,” he said.

Hagel, who has also been leading weekly meetings on sexual assault with senior Pentagon brass, is expected in the coming days to release six new policies on the issue, including an expansion of an advocacy program for victims to all military branches and recurring inspector general audits of all closed investigations, according to an internal memo of the draft plans obtained by POLITICO.

A senior White House aide also praised Hagel for his move earlier this year requesting legislation that would put a stop to commanders overturning jury verdicts. “We thought that was a really great step and commitment to improving the system,” said the White House official.

For his part, Obama warned in May that “there is no silver bullet to solving this problem” while urging Hagel to work on “effective metrics and feedback loops” that will help in understanding how much more needs to be done. The president said he wanted over the next several months and years to see a surge in victim reporting on sexual assault “that may actually indicate to me that people are becoming more confident about moving forward.”

More than four years after the Great Recession the American people are still waiting for a real recovery. Household income has actually declined the past five years while economic growth has struggled to outpace inflation. As UCLA economist Edward Leamer said recently, “It’s not a recovery. The good news, though, is our country is poised for not just a long-overdue recovery but an economic boom. Our global competitive advantage and our vast reserves of both energy and capital have us primed for another American century. What’s missing is leadership in Washington that has the courage and vision to turn our potential into prosperity.

Three factors are working in our favor, if we would only act.

First, in the context of the global economy, we’re the least wilted rose in the vase. All of the challenges we face in terms of demographics and debt (i.e. too few workers to sustain our safety net) are worse among our key competitors, particularly Europe, China and Japan. For the foreseeable future America will be a safe harbor, in spite of ourselves.

Second, our nation is sitting on vast reservoirs of cash that are either on company balance sheets, committed to failing government programs or being misdirected through an inefficient and immoral tax code.

In terms of public funds, how Congress handles the impending bankruptcy of our safety net programs could trigger a debt bomb or an economic boom. And regardless of what the administration says we don’t have years to act. According the latest trustees’ report, the Social Security disability trust fund runs out of money in two years, while Medicare Part A (the part that funds hospital visits and procedures) could run out of money in six years. The sooner we act the sooner we put our nation on a path toward growth rather than stagnation or decline.

Beyond entitlements, the rest of the budget contains billions that could be redirected to activities that create wealth rather than debt. For instance, the Government Accountability Office has documented at least $ 200 billion that is wasted every year through duplication. Meanwhile, our broken and parochial grant process (the refuge of vanquished earmarxists) spends nearly $ 600 billion every year. We also spend $ 537 billion on contracts, $ 175 billion of which are no-bid contracts. Modest reforms in these areas could produce far more growth than the ill-conceived 2009 stimulus.

Real tax reform would also help propel a real recovery. Reducing rates and eliminating special interest provisions that give a corrupted IRS too much power over our lives could help bring back 1980’s and 1990’s growth rates of 4-5 percent instead of today’s meager sub 2 percent growth. Simplifying the code would also shift a significant portion of the more than $ 150 billion Americans spend each year on tax compliance toward activities that create real wealth.

One obstacle to tax reform is the administration’s effort to redefine tax reform as reform that only leads to more revenue instead of lower rates for working families. This bizarre revisionism is at odds with every serious tax reform effort in the past 30 years from Reagan-O’Neill in the 1980’s to Simpson-Bowles today, which was embraced by progressives like Senator Dick Durbin (D-IL). The moral outrage in today’s code aren’t rates that favor the rich but special interest carve outs that keep rates artificially high for low and middle income Americans who can’t afford to hire a tax earmark lobbyist. Giveaways for pro sports leagues, Hollywood movie producers and green energy companies keep rates high for the very low and middle income families the administration says it wants to protect. Asking working families to subsidize the salaries of wealthy NFL team owners, movie producers, and politically-connected energy executives is hardly the moral high ground in the tax debate.

Third, and finally, our energy potential could turn North America into another Middle East in the next two decades. In April, we learned the Bakken Formation in North Dakota, South Dakota and Montana holds twice as much shale oil and three times as much gas as was previously estimated. By 2020, we could be a net exporter of natural gas and within striking distance of the elusive goal of energy independence, but only if we have an energy policy that places economic growth ahead of green ideology.

In today’s atmosphere of scandal the best thing the president can do to help his administration and the country is to give the House Ways and Means Committee an offer they can’t ignore. It can’t be a rehash of talking points, but a bold and imaginative plan that says the president is serious about a grand bargain and serious about compromise. Or, they can spend the next three years defending an indefensible IRS and fending off other scandal-related questions.

The administration is right to warn against GOP overreach but the administration and congressional Democrats should be focused on their own problem of underreach. Over the past two decades, six separate commissions have come up with ways to save Medicare – the biggest driver of our debt –yet the president, Senate Majority Leader Reid and the Senate Finance Committee, who control two-thirds of our government, have done nothing to save Medicare or Social Security.

If the president chooses to lead, he’ll do much more than change the subject. He’ll bring us closer to the kind of recovery, and American century, we all so desperately want.
