Rights group intervenes in ludicrous ‘zero tolerance policy’ trend

A 10-year-old has been suspended from school and threatened with expulsion for firing a make-believe arrow at a classmate, prompting a rights group to step in and demand the incident be stricken from the record.

The Rutherford Institute, a civil liberties watchdog group, has intervened in the case of Johnny Jones, a fifth grader at South Eastern Middle School in Fawn Grove, Pa., who found himself in trouble after violating the school’s zero tolerance policy on weapons by miming the action of shooting an arrow from a bow with only his hands.

According to the report, Jones was in class when a classmate held up his folder like an imaginary gun and “shot” at him while he was retrieving a pencil from the teacher. When Jones drew back the strings of an imaginary bow and “shot” back, a girl in the class altered the teacher.

The teacher then passed the matter on to the principal, saying that “firearms” had been involved in the play fighting. Sure enough, instead of using common sense, the principal suspended Jones for a day, contacted the boy’s parents, and threatened expulsion for “making a threat” to another student using a “replica or representation of a firearm”.

Demanding a response by December 13, The Rutherford Institute’s letter (PDF) states “We request that you rescind the suspension and immediately remove all reference to it from Johnny’s permanent school record.”

“There is no reason that Johnny should be stigmatized and branded a miscreant due to the school’s unreasonable application of its zero tolerance policy against him,” notes the letter, signed by Rutherford Senior Staff Attorney Douglas R. McKusick.

The group routinely intervenes in such cases. President John W. Whitehead, describes the school’s response to the incident and others like it as an ongoing effort to “criminalize childish behavior and punish all offenses severely, no matter how minor or non-threatening the so-called infraction may have been.”

“We all want to keep the schools safe, but I’d far prefer to see something credible done about actual threats, rather than this ongoing, senseless targeting of imaginary horseplay,” he added.

While the school district’s zero-tolerance policy encompasses a prohibition of almost any kind of weapon, Rutherford attorneys state that it is ludicrous to consider an imagined weapon a violation of the policy.

“No reasonable argument can be made that the imaginings from the mind of a 10-year-old boy, completely lacking any actual, tangible device, represented a ‘replica’ or a ‘look-alike’ of an actual gun,” they write.

“This atrocious misapplication of rules originally intended to protect students while on school grounds is foolish and actually damages the futures of the children meant to be protected. Moreover, Johnny’s rights were trampled without the due consideration.” the letter concludes.

Once again, these daily incidents all across the country highlight how, in many cases, positions of authority in society have been filled by spineless jellyfish who would rather see kids grow up as mindless automatons than experience the joy of youthful imagination.

No. 2 US nuke commander suspended amid probe

WASHINGTON (AP) — The No. 2 officer at the military command in charge of all U.S. nuclear war-fighting forces has been suspended and is under investigation by the Naval Criminal Investigation Command for issues related to gambling, officials said Saturday.

The highly unusual action against a high-ranking officer at U.S. Strategic Command was made more than three weeks ago but not publicly announced.  

Air Force Gen. Robert Kehler, who heads Strategic Command, suspended the deputy commander, Navy Vice Adm. Tim Giardina, from his duties on Sept. 3, according to the command’s top spokeswoman, Navy Capt. Pamela Kunze. Giardina is still assigned to the command but is prohibited from performing duties related to nuclear weapons and other issues requiring a security clearance, she said.

Kehler has recommended to Defense Secretary Chuck Hagel that Giardina be reassigned, Kunze said. Giardina has been the deputy commander of Strategic Command since December 2011. He is a career submarine officer and prior to starting his assignment there was the deputy commander and chief of staff at U.S. Pacific Fleet.

Two senior U.S. officials familiar with the investigation said it is related to gambling issues. The officials spoke on condition of anonymity because the probe in incomplete.

Strategic Command oversees the military’s nuclear fighter units, including the Navy’s nuclear-armed submarines and the Air Force’s nuclear bombers and nuclear land-based missiles. It is located near Omaha, Neb.

Kunze said Strategic Command did not announce the Sept. 3 suspension because Giardina remains under investigation and action on Kehler’s recommendation that Giardina be reassigned is pending. The suspension was first reported by the Omaha World-Herald.

The spokeswoman said a law enforcement agency, which she would not identify, began an investigation of Giardina on June 16. Kehler became aware of this on July 16, and the following day he asked the Naval Criminal Investigation Service to begin a probe.

Police finance chief suspended

Assistant Chief Officer Ann Hall, who is responsible for finance and commissioning for Cleveland Police, is being investigated over unauthorised payments to an executive coaching company, the police watchdog said.

Her suspension follows the sacking last year of the force’s Chief Constable Sean Price, allegations against his deputy Derek Bonnard, and a long-running criminal investigation into alleged corruption at the police authority.

Cindy Butts, of the Independent Police Complaints Commission, admitted that, given the force’s recent history, “news of this investigation may cause some concern among the public”.

Mrs Hall, a member of the Association of Chief Police Officers, was born in North Lanarkshire and became the force’s executive director of finance nine years ago.

A force spokesman said: “It should be emphasised that suspension is a neutral act and it should not be inferred from the decision to suspend that any potential misconduct matters have been proven.”

Barry Coppinger, Cleveland’s police and crime commissioner, said he wanted to see the watchdog’s investigation completed “as swiftly and thoroughly as is possible”.

Ministers told the Commons in February that a new “code of ethics” will require every officer to demonstrate “honesty and truthfulness” in the wake of growing concerns over police corruption.

Mr Price became the first chief constable to be sacked in 35 years when a disciplinary panel found he had lied about his role in the recruitment of the former police authority chairman’s daughter. It also found he directed a member of staff to lie about it.

Mr Bonnard faces a four week disciplinary hearing into alleged misconduct and is suspended from his role of Deputy Chief Constable.
