The 2013 profit totals are in for the big five oil companies—BP, Chevron, ConocoPhillips, Exxon Mobil, and Shell. Their financial reports indicate that they earned a combined total of $ 93 billion last year, or $ 177,000 per minute. (see Table 1) After years of oil production declines, the big five oil companies actually increased their total production* in 2013, predominately due to BP and ConocoPhillips almost doubling their total production. The companies’ higher oil production yet lower profits indicate that it is becoming more expensive to produce oil as the number of newer, easier, and cheaper fields shrink. This is why, despite their outsized earnings, the oil companies are not only fighting to keep their tax breaks but also lobbying to lift the crude oil export ban. But doing so could hurt working families, our economy, and our energy security. Instead, we need to invest in cleaner transportation alternatives.


As mindboggling as it sounds, Big Oil’s $ 93 billion in profits in 2013—impressive by any standard—were nonetheless a 27 percent reduction in profits compared to 2012, primarily because gasoline averaged 16 cents per gallon—or 4 percent—less. Despite the decreases, Exxon Mobil, Shell, and Chevron still had the first, seventh, and eighth, respectively, highest profits of any global public company on the 2013 Fortune 500 list. BP finished 30th, while ConocoPhillips ranked 50th, mostly because it spun off its refining business partway through 2012.

It would not be surprising if the big five oil companies use their 2013 decline in profits as another excuse to pressure Congress to retain their $ 2.4 billion-per-year tax breaks. The largest of these special provisions allows these companies to qualify for the “limitation on section 199 deduction attributable to oil, natural gas, or primary products,” which will cost taxpayers $ 14.4 billion over 10 years, according to the Congressional Joint Committee on Taxation. This tax break was enacted in 2004 and was designed to encourage manufacturing to remain in the United States rather than move overseas. It ought not apply to oil and natural gas production since the oil and gas fields cannot be moved to another nation.


The Joint Committee on Taxation found that the second-largest deduction was for “modifications of foreign tax credit rules applicable to major integrated oil companies which are dual capacity taxpayers.” This provision is worth $ 7.5 billion over 10 years. Seth Hanlon, former Director of Fiscal Reform at the Center for American Progress, best describes why this tax break is unwarranted:


Our tax system allows companies that do business abroad to reduce from their tax bill any income taxes paid to other governments. The rules are supposed to prevent oil companies from claiming credit for royalty payments to foreign governments. Royalties are not taxes; they are fees for the privilege of extracting natural resources.


… oil companies have been permitted to claim credits for certain payments to foreign governments, even in countries that generally impose low or no business tax (suggesting that these payments, or levies, are in fact a form of royalty). Dual capacity taxpayer rules, therefore, are a subsidy for foreign production by U.S. oil companies.



The decline in profits is also why the American Petroleum Institute, Exxon Mobil, and other oil companies are lobbying to lift the crude oil export ban, which would enable them to sell their domestic oil at the world, or Brent, price that fetched nearly $ 10 per barrel more than the domestic, or West Texas Intermediate, price on February 7. Lifting the ban would force the United States to import more expensive foreign oil to replace the exported domestic oil, which could raise gasoline prices. Banking giant Barclays Plc predicts that lifting the current ban could add $ 10 billion annually to gasoline prices paid at the pump.


If there is any good news here for American families and businesses, it is that gasoline prices, which hit a record high in 2012, were lower in 2013. This cut at the pump reduced the average household’s annual gasoline expenditures.


The fact that profits decreased in 2013 despite production increasing calls into question the big five companies’ reliance on finding and developing more difficult, dangerous oil fields—such as those in the Arctic Ocean. It is fairly clear that such a business model is not economically sustainable. Instead, they—and we—could benefit from greater investment in cleaner, alternative transportation technologies.


Of course, when it comes to spending their money, the priorities of oil companies are fairly obvious. All of the companies, except for ConocoPhillips, spent a combined total of $ 32 billion, or nearly 40 percent of their total profits, to repurchase their own stock. (see Table 1) This increases the value of the remaining shares, providing a bounty to senior executives, boards of directors, and other large shareholders. The CEOs of these five companies had a combined compensation of $ 96 million in 2012, the last year for which data are available, or nearly $ 20 million per CEO. This is nearly 400 times greater than the $ 51,107 median income for a family of four during that same year. These five major oil corporations also spent $ 45 million on lobbying in 2013; every $ 1 spent on lobbying helped the companies protect $ 53 of their tax breaks—an outstanding rate of return.


In addition to receiving unjustified tax breaks, the big five oil companies also benefit from the lack of federal limits on carbon pollution generated by oil and gas production, transportation, and refining. The Environmental Protection Agency reported that “petroleum and natural gas systems” and refiners were the second- and third-largest sources of carbon and other climate pollution among the major industrial sectors that must report their emissions. Since there are no federal limits on this pollution, American families and businesses must bear the costs of more climate pollution, such as damages from extreme weather events, heightened smog, and tropical diseases. These—and other—oil companies can dump their carbon and other climate pollution in the sky for free. And at our expense.


Despite the decline in profits in 2013, BP, Chevron, ConocoPhillips, Exxon Mobil, and Shell are some of the richest, most profitable companies in the world. They produce a valuable commodity that is essential to our economy. However, their proposal to eliminate the crude oil export ban, their battle to keep some unnecessary federal tax breaks, and their uncontrolled climate pollution all could or do impose real costs on American families. It’s up to President Barack Obama and Congress to retain and adopt policies that benefit all Americans, not just Big Oil’s bottom line.

Bloomberg, Watts Team Up to Demand Tougher Gun Control Measures

Outgoing New York Mayor Michael Bloomberg has joined forces with gun control crusader Shannon Watts to urge Congress to enact tougher measures to prevent the spread of illegal firearms.


Bloomberg’s organization Mayors Against Illegal Guns and Watts’ group Moms Demand Action for Gun Sense have combined to create “a nationwide movement” of Americans to put pressure on lawmakers for expanded background checks on all gun purchases.  


In a joint editorial in Politico Magazine, the pair wrote Monday that gun buyers with “something to hide” are turning to unlicensed “private sellers” over the Internet and to gun show dealers who aren’t required to conduct background checks.


“It’s like offering two lines at the airport, one with security and one with none,” the two said about the nation’s background check laws. “Criminals are naturally choosing the latter. And Americans are dying as a result.”


They pointed out that due to the vast power of the gun lobby in Washington it’s “an uphill battle” in closing dangerous loopholes in the background check system and in strengthening gun control enforcement.


“For decades, the gun lobby has had the field to itself, fear-mongering to raise money and sell firearms, and claiming any measure to keep guns out of the hands of criminals is a step on the way to gun confiscation, which is of course nonsense,” Bloomberg and Watts wrote. “Those falsehoods have undermined public safety for generations, allowing millions of innocent Americans to be murdered.”


Mayors Against Illegal Guns was formed in 2006 with a group of 15 mayors creating a bipartisan coalition for more gun control. The organization now has more than 1,000 mayors in its membership and claims 1.5 million supporters.


Moms Demand Action was started by Watts as a grassroots campaign on Facebook on Dec. 15, 2012, a day after the Sandy Hook school massacre in Newtown, Conn. A year later, the group has 130,000 active members and chapters in all 50 states.


“The passion of moms who think every day about the safety of their children, families and neighborhoods helped make the group a prominent voice in the gun debate,” said Bloomberg and Watts. “To get Congress to listen, we must unite supporters from every walk of life. And that is why our two organizations are merging.”


The editorial noted that on average 33 Americans are murdered every day with guns, mostly with illegal firearms. But the two also pointed out that New York has become the nation’s safest big city, with murder rates down to record lows, partially because of a crackdown on illegal guns.


“But 90 percent of guns recovered at New York crime scenes come from out of state, mostly from states that don’t require background checks on all gun purchases,” the two wrote. “Clearly, this is a national problem that requires national action.”


They added, “Combining the legal and policy expertise of mayors with the passion and determination of moms will create a force for change that political leaders will not be able to ignore.”


Bloomberg leaves office on December 31st; Democrat Bill de Blasio will be taking over as the city’s chief executive.

Afghanistan rebuffs U.S. demand to sign security pact

  • Afghanistan on Friday rebuffed a US demand to sign a highly anticipated security pact as soon as possible, insisting the document must wait until after next year’s presidential election.


    Washington warned Kabul on Thursday to sign the Bilateral Security Agreement (BSA) as soon as possible, with senior officials hinting that delaying beyond the end of this year could mean no post-2014 US troop presence.


    The latest US run-in with President Hamid Karzai was set off by the Afghan leader saying the painstakingly negotiated deal would not be signed until after the election in April.


    US officials bristled, saying the pact, which governs the conditions of any post-war American counter-terrorism and training mission in Afghanistan, must be signed by the end of the year.


    The White House said it needed a swift decision from Karzai to start planning the footprint of any US forces, and warned Obama had not yet decided whether or not to keep US forces in Afghanistan.


    “Failure to get this approved and signed by the end of the year would prevent the United States and our allies from being able to plan for a post-2014 presence,” White House spokesman Josh Earnest said.


    Karzai had said the pact currently under consideration by a loya jirga, a meeting of tribal chieftains, could only be signed “when our elections are conducted, correctly and with dignity”.


    His spokesman Aimal Faizi stood firm on the issue on Friday.


    “Security, peace and good elections are key to the signing of the BSA,” Faizi told AFP.


    “Let’s wait and see what will the loya jirga decide on the document. If approved, as the president said, it will be signed after elections.”


    Senior US officials speaking on condition of anonymity were blunt, warning that if there were no BSA in force, there would be no US troop garrison in Afghanistan after NATO combat troops leave in 2014.


    “We desperately need this pact”


    Some jirga delegates voiced frustration at Karzai’s unexpected announcement — the latest in a long line of antagonistic outbursts.


    “This should be signed by the current government not be left to the next one,” Aminullah Muavez, a member of the provincial peace council of Nuristan — a Taliban stronghold in the country’s northeast — told AFP.


    “If we don’t sign it soon, the US might change their mind and withdraw from Afghanistan.”


    Karzai on Thursday told jirga delegates that the BSA would allow up to 15,000 foreign troops to stay in the war-torn country.


    Afghanistan goes to the polls on April 5 to elect a successor to Karzai, who must step down after his two terms. A credible election is seen as crucial to the country’s future stability.


    The jirga is to give its decision Sunday on the BSA, the text of which was only agreed after months of tortuous negotiations with Washington.


    It is widely expected to approve it, though possibly with recommendations or conditions, after which it must also be approved by the Afghan parliament before Karzai can sign it into effect.


    Tahira Mirzad, a former MP representing Kapisa province at the Jirga, told AFP the country urgently needed the BSA.


    “This is a sensitive phase we are going through at the moment. it’s a chaotic phase, every day we have attacks by the enemies, there is a lack of proper training for security forces, we desperately need this pact to be signed,” she said.


    Obama stepped in this week with a letter to confirm a deal on the vexed question of US forces raiding Afghan homes.


    The letter released by Karzai’s office said US forces would not enter Afghan homes for military operations “except under extraordinary circumstances involving urgent risk to life and limb of US nationals”.


    The issue is a sensitive one in Afghanistan and had for a time appeared to pose a serious threat to the deal.


    Supporters of the deal say it is vital for post-2014, when the bulk of NATO’s 75,000 troops will pull out. The Taliban insurgency this year has reached levels of violence not seen since 2010, according to the United Nations.


    The Taliban condemned the jirga as an American plot and threatened to target its delegates if they approve the deal.


    A draft text released by Kabul Wednesday appeared to show Karzai had bowed to a US demand that American troops would not be tried in local courts if they are accused of crimes.


    A similar security deal between the United States and Iraq collapsed in 2011 over the issue of whether American troops would be answerable to local courts, leading Washington to pull its forces out.

10 Senate Dems demand delay...


Ten Senate Democrats have signed on to a letter crafted by Sen. Jeanne Shaheen (D-N.H.) urging the Obama administration to extend the open enrollment period for the recently launched health-care exchanges.


Shaheen called for the extension this week in light of myriad problems with the HealthCare.gov Web site.


As of now, Americans are required to obtain health insurance by March 31 or will face a penalty under the individual mandate. Some have suggested the penalty could be delayed, given the problems with the Web site might prevent people who otherwise want insurance from obtaining it.


The White House on Wednesday announced it would give Americans six weeks longer than previously thought – until March 31 — to enroll before facing a penalty, but also said the change had nothing to do with the Web site problems.


“Extending this period will give consumers critical time in which to become familiar with the website and choose a plan that is best for them,” the letter states. “Individuals should not be penalized for lack of coverage if they are unable to purchase health insurance due to technical problems.”


The letter doesn’t state how long the senators would like to extend open enrollment, only that it should be beyond March 31. One of the signers,


Sen. Kay Hagan (D-N.C.), called for a two-month delay  in remarks on Thursday. Separately, another Democratic senator, Joe Manchin (W.Va.), has called for a one-year delay in the individual mandate.


The signatories to the letter are Shaheen and Sens. Mark Begich (D-Alaska), Mark Pryor (D-Ark.), Mary Landrieu (D-La.), Hagan (D-N.C.), Dianne Feinstein (D-Calif.), Mark Udall (D-Colo.), Tom Udall (D-N.M.), Michael Bennet (D-Colo.) and Martin Heinrich (D-N.M.).


Begich, Pryor, Landrieu and Hagan are all top GOP targets in red states in 2014, and Bennet is likely to be targeted in 2016. (Shaheen and Mark Udall face reelection in swing states in 2014 but aren’t considered among Republicans’ top targets.)


Feinstein stands out as a long-time liberal senator from California. Tom Udall is considered largely safe for reelection in New Mexico next year and Heinrich was just elected in 2012 in the same state.

Dear Secretary Sebelius:


When fully implemented, the Affordable Care Act represents a bold step forward in reforming our nation’s health care system.  It has the potential to improve the quality of care we all receive and provides the opportunity for millions of Americans to purchase quality, affordable health insurance.


The newly created federal and state health insurance marketplaces are intended to allow consumers the opportunity to compare health insurance options and find a plan that fits their needs and their budgets.  For three years, we have been eagerly waiting for the launch of these marketplaces.  However, now that the marketplaces are open, we have become discouraged and frustrated with the problems and interactions that are occurring with the Affordable Care Act’s federally-administered website, healthcare.gov. 


As long as these substantial technology glitches persist, we are losing valuable time to educate and enroll people in insurance plans.  Our constituents are frustrated, and we fear that the longer the website is not functional, opportunities for people to log on, learn about their insurance choices, and enroll will be lost.


Given the existing problems with healthcare.gov and other state-run marketplace websites that depend on the federally-administered website, we urge you to consider extending open enrollment beyond the current end date of March 31, 2014.  Extending this period will give consumers critical time in which to become familiar with the website and choose a plan that is best for them. Individuals should not be penalized for lack of coverage if they are unable to purchase health insurance due to technical problems.  


The Affordable Care Act has already had a significant impact on the lives of millions of Americans; seniors are now paying less for their prescription drugs, critical preventive care services are available for free and important work is being done to improve the quality of care we receive.  Americans will now have the opportunity to receive tax credits to purchase quality health insurance, and starting in January 2014, insurance companies will no longer be able to deny health coverage because of a pre-existing condition or drop coverage if someone is sick.


We appreciate your efforts to fully implement this law and look forward to working with you to accomplish that goal.  Thank you for considering our requests to extend the open enrollment period if the healthcare.gov substantial technology glitches continue.

Iran rejects demand that it ship out its processed uranium before talks


It’s becoming obvious that there is going to be precious little to talk about with Iran by the time negotiations start over its nuclear program.


That’s because they’ve ruled out even discussing the halt of uranium enrichment – a condition Israel demands be met – and now they see no need to ship out their processed nuclear material prior to talks, despite this being a long standing US condition.


Gee – it’s like they want to fool us into thinking they’re reasonable, or something.

Iran on Sunday rejected the West’s demand to send sensitive nuclear material out of the country but signaled flexibility on other aspects of its atomic activities that worry world powers, ahead of renewed negotiations this week.


Talks about Iran’s nuclear programme, due to start in Geneva on Tuesday, will be the first since the election of Iranian President Hassan Rouhani, who has tried to improve relations with the West to pave a way for lifting economic sanctions.


Rouhani’s election in June to succeed Mahmoud Ahmadinejad has raised hopes of a negotiated solution to a decade-old dispute over Iran’s nuclear programme that could otherwise trigger a new war in the volatile Middle East.


Iranian Deputy Foreign Minister Abbas Araqchi’s comments on Sunday may disappoint Western officials, who want Iran to ship out uranium enriched to a fissile concentration of 20 percent, a short technical step away from weapons-grade material.


However, Araqchi, who will join the talks in Switzerland, was less hardline about other areas of uranium enrichment, which Tehran says is for peaceful nuclear fuel purposes but the West fears may be aimed at developing nuclear weapons capability.


“Of course we will negotiate regarding the form, amount, and various levels of (uranium) enrichment, but the shipping of materials out of the country is our red line,” he was quoted as saying on state television’s website.


In negotiations since early 2012, world powers have demanded that Iran suspend 20-percent enrichment, send some of its existing uranium stockpiles abroad and shutter the Fordow underground site, where most higher-grade enrichment is done.


In return, they offered to lift sanctions on trade in gold, precious metals and petrochemicals but Iran, which wants oil and banking restrictions to be removed, has dismissed that offer. It says it needs 20-percent uranium for a medical research reactor.


However, Araqchi’s statement may be “the usual pre-negotiation posturing”, said Middle East specialist Shashank Joshi at the Royal United Services Institute (RUSI) in London.


“It is easy to imagine a compromise whereby Iran would ship out only some of its uranium, allowing the negotiating team to claim a victory. There are many potential compromises that will be explored,” Joshi told Reuters.



“Compromises?” That’s pretty delusional. Iran is not going to give anything up that would prevent it from building a bomb out of pre-existing parts that could be assembled in a matter of weeks. That includes enriched uranium.


We’ll see what other delusions the administration is suffering from relating to Iran when the talks get underway.

US Republicans demand to be consulted over Syria response

Secretary of State John Kerry has issued a tough statement, saying that the suspected chemical weapons attack was a “moral obscenity” and accused Syria’s government of covering it up.




He added that the Obama administration was consulting with allies and members of Congress and would decide soon how to respond.




But some politicians and congressional staff members, particularly Republicans, have called for more communication with Congress by the Democratic administration, even as many expressed strong support for “decisive” action against Syrian President Bashar al-Assad.




Speaker of the House of Representatives John Boehner had “preliminary communication” with the White House about the situation in Syria on Monday afternoon, said Brendan Buck, a spokesman for the Republican leader.

Christians demand free speech guidance from Scotland Yard chief


The American, a former deputy sheriff in Los Angeles, was eventually released without charge but later said his experience suggested that “thought police” had become a reality in Britain.


Andrea Williams, the director of the CLC, has written to Sir Bernard insisting that human rights laws allow Christians to express their genuinely-held views without fear of arrest, providing they do not incite a breach of the peace.


The Christian Legal Centre (CLC), which is representing Mr Miano, points out in its letter that Sir Bernard’s officers took no action against a woman who told Mr Miano to “**** off” but arrested the preacher for reading from the Bible.


In the letter, seen by The Telegraph, Mrs Williams says: “We formally request that you issue guidance to all officers immediately that the Bible message on the ‘sin of homosexuality’ is lawful.


“Currently, the police appear to enforce the law to silence the viewpoint that homosexual conduct is a sin. This conduct by the police is unlawful and amounts to a systemic pattern of discrimination against Christians.”


Mrs Williams suggested Christians were becoming “fearful” of expressing their lawful views because of the police’s “intimidatory tactics”.


The CLC said there had been at least 16 cases of Christians being arrested for expressing their views on homosexuality over the last 11 years.


Mrs Williams said: “We would like to see clear guidance from the Metropolitan Commissioner that Christians preaching from the Bible that homosexual conduct is sinful is lawful free speech.


“The police officers in this case found that the complainant saying ‘**** off’ was non-offensive and lawful, but that the evangelist’s preaching from the Bible was an arrestable offence.


“Free speech is under threat and we need to protect it. We hope that the Commissioner will take a lead in this.”


Mr Miano has instructed Paul Diamond, the human rights barrister, to act for him in the case.


It is understood the CLC will launch judicial review proceedings against Scotland Yard if Sir Bernard fails to issue the guidance to officers.


The group is also asking the Association of Chief Police Officers to draw up guidelines for police officers in other forces across England and Wales.
