Elon Musk Writes A Blistering Take Down Of Chris Christie And New Jersey"s Decision To Ban Tesla"s Sales Model (TSLA)

Elon Musk jokes about his job


Elon Musk wrote a blog post about Tesla’s troubles in New Jersey. 


Tesla’s direct-to-consumer sales model was banned in the state this week. The ban starts April 1. 


Musk’s post basically echos what he said last year about fighting the dealers. 


He doesn’t want Tesla to sell cars through auto dealerships because the dealers will have no incentive to sell electric cars. He says that all other cars that tried the dealership model have gone bust.


In this post he has pointed language for Chris Christie:


On Tuesday, under pressure from the New Jersey auto dealer lobby to protect its monopoly, the New Jersey Motor Vehicle Commission, composed of political appointees of the Governor, ended your right to purchase vehicles at a manufacturer store within the state. Governor Christie had promised that this would be put to a vote of the elected state legislature, which is the appropriate way to change the law. When it became apparent to the auto dealer lobby that this approach would not succeed, they cut a backroom deal with the Governor to circumvent the legislative process and pass a regulation that is fundamentally contrary to the intent of the law.


And later, he adds:


The rationale given for the regulation change that requires auto companies to sell through dealers is that it ensures “consumer protection”. If you believe this, Gov. Christie has a bridge closure he wants to sell you! Unless they are referring to the mafia version of “protection”, this is obviously untrue. As anyone who has been through the conventional auto dealer purchase process knows, consumer protection is pretty much the furthest thing from the typical car dealer’s mind.


Here’s the whole thing:

It is worth examining the history of these laws to understand why they exist, as the auto dealer franchise laws were originally put in place for a just cause and are now being twisted to an unjust purpose. Many decades ago, the incumbent auto manufacturers sold franchises to generate capital and gain a salesforce. The franchisees then further invested a lot of their money and time in building up the dealerships. That’s a fair deal and it should not be broken. However, some of the big auto companies later engaged in pressure tactics to get the franchisees to sell their dealerships back at a low price. The franchisees rightly sought protection from their state legislatures, which resulted in the laws on the books today throughout the United States (these laws are not present anywhere else in the world).


The intent was simply to prevent a fair and longstanding deal between an existing auto company and its dealers from being broken, not to prevent a new company that has no franchisees from selling directly to consumers. In most states, the laws are reasonable and clear. In a handful of states, the laws were written in an overzealous or ambiguous manner. When all auto companies sold through franchises, this didn’t really matter. However, when Tesla came along as a new company with no existing franchisees, the auto dealers, who possess vastly more resources and influence than Tesla, nonetheless sought to force us to sell through them.


The reason that we did not choose to do this is that the auto dealers have a fundamental conflict of interest between promoting gasoline cars, which constitute virtually all of their revenue, and electric cars, which constitute virtually none. Moreover, it is much harder to sell a new technology car from a new company when people are so used to the old. Inevitably, they revert to selling what’s easy and it is game over for the new company.


The evidence is clear: when has an American startup auto company ever succeeded by selling through auto dealers? The last successful American car company was Chrysler, which was founded almost a century ago, and even they went bankrupt a few years ago, along with General Motors. Since the founding of Chrysler, there have been dozens of failures, Tucker and DeLorean being simply the most well-known. In recent years, electric car startups, such as Fisker, Coda, and many others, attempted to use auto dealers and all failed.


An even bigger conflict of interest with auto dealers is that they make most of their profit from service, but electric cars require much less service than gasoline cars. There are no oil, spark plug or fuel filter changes, no tune-ups and no smog checks needed for an electric car. Also, all Tesla Model S vehicles are capable of over-the-air updates to upgrade the software, just like your phone or computer, so no visit to the service center is required for that either.


Going a step further, I have made it a principle within Tesla that we should never attempt to make servicing a profit center. It does not seem right to me that companies try to make a profit off customers when their product breaks. Overcharging people for unneeded servicing (often not even fixing the original problem) is rampant within the industry and happened to me personally on several occasions when I drove gasoline cars. I resolved that we would endeavor never to do such a thing at Tesla, as described in the Tesla service blog post I wrote last year.


Why Did They Claim That This Change Was Necessary?

As anyone who has been through the conventional auto dealer purchase process knows, consumer protection is pretty much the furthest thing from the typical car dealer’s mind.


There are other ways to assess the premise that auto dealers take better care of customers than Tesla does. Consumer Reports conducts an annual survey of 1.1 million subscribers, which factors in quality, reliability and consumer satisfaction. The Tesla Model S was the top overall pick of any vehicle in the world, scoring 99 out of 100. This is the highest score any car has ever received. By comparison, in theindustry report card, Ford, which sells their cars through franchise dealers, received a score of 50. BMW, which makes competing premium sedans, received a score of 66.


Consumers across the country have also voiced their opinion on the sales model they prefer. In North Carolina, a Triangle Business Journal poll found that 97 percent of people polled said Tesla should be allowed to sell cars directly. A poll by the Austin Business Journal showed that 86 percent of respondents were in favor of direct sales, and in a Los Angeles Times poll 99 percent of respondents came to the same conclusion. These aren’t polls that we commissioned and there are many more like them. We have not seen a single poll that didn’t result in an overwhelming majority saying they preferred the direct model to the traditional dealer model. Democracy is supposed to reflect the will of the people. When a politician acts in a manner so radically opposed to the will of the people who elected him, the only explanation is that there are other factors at play.


Going Forward


Some reassurances are also in order. Until at least April 1, everything is business as usual for Tesla in New Jersey. It should also be noted that this regulation deals only with sales, so our service centers will not be affected. Our stores will transition to being galleries, where you can see the car and ask questions of our staff, but we will not be able to discuss price or complete a sale in the store. However, that can still be done at our Manhattan store just over the river in Chelsea or our King of Prussia store near Philadelphia.


Most importantly, even after April 1, you will still be able to order vehicles from New Jersey for delivery in New Jersey on our TeslaMotors.com website.


We are evaluating judicial remedies to correct the situation. Also, if you believe that your right to buy direct at a Tesla store should be restored, please contact your state senator & assemblyman:www.njleg.state.nj.us/districts/districtnumbers.asp.


Finally, we would like to thank the many people who showed up in Trenton on Tuesday to support Tesla and speak out against the MVC’s back-door tactics in passing this regulation change without public consultation or due process. It was an amazing response at very short notice and much appreciated.

China will fight back “forcefully” if any country tries to challenge its “bottom line” and drag China into war, a political adviser and former Defense Ministry official said on Tuesday.


Qian Lihua, a member of the National Committee of the Chinese People’s Political Consultative Conference, made the remarks as China faces serious challenges over territorial and maritime disputes.


Some of China’s neighbors, including Japan and the Philippines, have acted against China, illegally taking over Chinese islands and stepping up their military presence in a way that targets the country.


“We don’t expect any kind of war to break out and we hope to control crises and prevent warfare. We want to resolve conflicts and remain peaceful. But China cannot realize those goals alone,” said Qian, a major general who used to head the foreign affairs office under the Ministry of National Defense.


“It requires all countries in the region to cooperate closely and to make a joint contribution to regional peace and stability,” he added.


In an earlier interview with Xinhua News Agency, Qian said that one cannot completely rule out the possibility of clashes in East Asia, and singled out Japan as a potential problem.


“Japan has lost its direction, and has been taken advantage of by right-wing forces to challenge the international order created after World War II,” Qian said.


But he said it is impossible and impractical for Japan’s right-wing or militaristic forces to cause major trouble, chaos, conflicts and even war against China, as China is not in the same situation as it was in 1894 or the 1930s, when Japan waged war against China.


“Preserving peace and promoting economic development has become the common goal of every country,” Qian said.


The Asia-Pacific region has seen an increase in conflicts in recent years. Due to disputes over territory and maritime issues, many Asian countries have increased their military and national defense spending.


Among the top 15 military spenders in the world, China, Japan, India, South Korea and Australia all are in the Asia-Pacific region. Among them, the military spending from China, Japan and South Korea amounted to 64 percent of the region in 2013, Qian said.


While there has been speculation that Asian countries are now in an arms race, Qian refuted the notion.


“The arms race existed only during the Cold War, between NATO and the Warsaw Pact in the past, when regional organizations sought world hegemony with a bigger influence,” he said.


But now Asian countries have their own reasons to increase military spending and they are capable of doing so, but it does not mean the region has an arms race, Qian added.


As an official in charge of the foreign affairs of China’s military for years, Qian also responded to Western countries’ criticism that China’s military affairs are not transparent enough, saying that China has made great efforts to promote military transparency.


Qian said transparency should be a two-way street and called on the West not to use the issue of military transparency to pressure China.


“Before sufficient military trust is established, it’s impossible to realize military transparency,” he said.


Qian added that there is no international standard to measure a country’s military transparency.


“There is no complete transparency, not even among allies like NATO members,” he added.


“So the transparency should be a two-way mechanism. If you are open to me, I will be open to you. Otherwise, we could not open our military facilities to other countries,” Qian said, adding that transparency should be more than communication and mutual visits. About 2,200 members of the CPPCC National Committee are gathered in Beijing for the annual session of China’s top political advisory body.

NYC Eyes Plans to Prod Taxis to Take it Slower


Taxis have long been a go-to choice for New Yorkers in a hurry. But the city wants to break the step-on-it habit.


Under recent proposals from Mayor Bill de Blasio, cabs could be outfitted with black-box-style data recorders and devices that would sound warnings — or even pause the fare meter — for going too fast. And meanwhile, speed limits on most city streets could drop from 30 to 25 mph.


Traffic-safety advocates applaud the ideas. De Blasio says New York’s signature yellow cabs “set the tone on our streets.” 


But cabbies fear friction with passengers and feel they’re being scapegoated. Riders say they’re torn between the drive for safety and the need for speed.


The city Taxi and Limousine Commission says it’s exploring the ideas.

Turkish Citizens Say No to Internet Censorship, Take the Streets in Protest

People of Turkey taking the streets against new Internet Censorship law.  Protests against an increase in internet censorship in Turkey took to the streets again tonight in Istanbul, Ankara and Izmir.


This new Censorship Law will allow Turkey’s telecommunications authority to block websites and censor any internet content without a prior court decision.  


The legislation also would force Internet service providers to keep records on Web users’ activities for two years and make them available to authorities when requested, without notifying the users.

Internet access in Turkey is already restricted and thousands of websites blocked. The independent press agency Bianet estimated that 110,000 websites were blocked in 2011 alone, while Google reported Turkish requests to remove content from the web rose nearly 1000% last year.


Proposed amendments to Law No. 5651 would provide for additional penalties on authors, content providers, and users of content it deems inappropriate with no effective means of redress. Turkish Prime Minister Recep Tayyip Erdogan has been openly critical of the internet, calling Twitter a “scourge” and condemning social media as “the worst menace to society”. Ankara   Thousands marched to Kızılay, protesting the new internet censorship bill recently approved by president Abdullah Gül.


Freedom of speech is already restricted in Turkey in many ways through bans, arrests of journalists and alleged pressure by politicians.  A report by a committee to protect journalists defines Turkey as the “world’s leading jailer of journalists” in 2013. In the same year, Turkey ranked 154 out of 179 countries in the Press Freedom Index by Reporters without Borders.


The levels of self censorship that will occur amongst everyday Turkish citizens and activists when the knowledge that they could be legally targeted for their online activity once the new measures are implemented are impossible to estimate. As well as what content will be banned or groups of people will become targets and possible face arrest for what they say and do on-line. One thing is clear to many, the passage of this new bill is not going to create a safer environment for the Gezi protesters.

As the No. 2 man in power in his nation, he lived a life of luxury, rubbing shoulders with world leaders such as Nikita Khrushchev, Fidel Castro and President Jimmy Carter.


On a visit to the White House, he heard Carter say his boss, communist dictator Nicolae Ceausescu, was a great leader and one with whom he could do business.


And yet, standing nearby his boss, a stunned Gen. Ion Mihai Pacepa knew first-hand that Ceausescu was, in reality, a “butcher, committing genocide against his people.”


Pacepa thought, “I can’t believe we fooled the leader of the United States this badly.”


So began a fascinating look deep inside the world of communist disinformation presented by the co-author of Pacepa’s blockbuster book, Prof. Ronald Rychlak, at the International Spy Museum Jan. 16.


In the 40-minute talk, Rychlak, who teamed up with Pacepa to write “Disinformation: Former Spy Chief Reveals Secret Strategies for Undermining Freedom, Attacking Religion, and Promoting Terrorism,” brought alive through fascinating accounts – many drawn from Pacepa’s insider experience – the widely misunderstood and still remarkably influential Russian-born “science” of disinformation.

The International Spy Museum in Washington, D.C., features the largest collection of international espionage artifacts ever placed on public display.


Rychlak, a historian and law professor at the University of Mississippi School of Law, teaches courses in constitutional law, criminal procedure, and terrorism and the law. Before co-authoring “Disinformation” with Pacepa, he authored several other books, including “Hitler, the War, and the Pope.”

The museum notes that Pacepa was the highest-ranking Soviet bloc intelligence official ever to defect to the West. Pacepa exposed the massive crimes and corruption of his former boss, Romanian President Nicolae Ceauescu, giving the dictator a nervous breakdown and prompting him to post two different million-dollar bounties on Pacepa’s head and send assassination squads to the U.S. to find his former spy chief and kill him. Fortunately, all such attempts failed, and Pacepa, at 85, today lives in the U.S. as a “proud American citizen.”


In his presentation, Rychlak discussed important disinformation campaigns, including the transformation of Pope Pius XII from a wartime hero into a Nazi sympathizer, the spread of anti-Semitism in the Middle East, the campaign to turn Americans and their Congress against the Vietnam War, and the Kremlin’s secret cultivation of modern Islamic terrorism.


Rychlak also screened highlights from the accompanying documentary by WND Films, “Disinformation: The Secret Strategy to Destroy the West.”


Pacepa was unable to appear because he still lives under a protective identity due to ongoing threats to his life.

Pacepa was once involved with mass deception at the very highest levels of the vast Soviet bloc intelligence machine. Due to a crisis of conscience, he “left the dark side,” defected to America in 1978 and became a major asset to America’s intelligence community. The CIA has praised his cooperation for providing “an important and unique contribution to the United States.” President Ronald Reagan referred to his internationally bestselling book, “Red Horizons,” as “my bible for dealing with dictators.”


Rychlak recently talked about the book on “The Sean Hannity Show.”


The International Spy Museum, which opened in 2002, is the only public museum in the U.S. solely dedicated to espionage. It’s also the only museum in the world to provide a global perspective on spying.


The museum’s Advisory Board of Directors and Advisory Council include former FBI and CIA director Judge William Webster, and former CIA director James Woolsey. Coincidentally, Woolsey wrote the “Introduction” to “Disinformation.”


The museum says its mission is to “educate the public about espionage in an engaging way and to provide a context that fosters understanding of its important role in and impact on current and historic events.”

Tom Coburn confirmed Thursday night that he will not serve out his full Senate term and intends to step down after 2014 because of deepening health problems. In a statement, Coburn acknowledged that he is battling a serious recurrence of cancer and said he would continue to fight for his priorities during the remainder of his time in office. ‘Carolyn and I have been touched by the encouragement we’ve received from people across the state regarding my latest battle against cancer. But this decision isn’t about my health, my prognosis or even my hopes and desires,’ Coburn said. ‘As a citizen, I am now convinced that I can best serve my own children and grandchildren by shifting my focus elsewhere.’ …

Obama: Take NSA out of phone data storage

President Barack Obama ordered changes to intelligence-gathering practices that would prevent the government from storing broad collections of phone and electronic communication data.  



President Obama admits to being skeptical of surveillance as a Senator from Illinois, but maintains the government program is necessary post Sept. 11.



The president advocated that those records be stored by a third party but did not offer specifics about where they would be kept.  He also proposed a new level of judicial approval for government access to those records. 


If adopted, the proposals represent a step back from the government’s claims to wide latitude in maintaining national security. 


“America’s capabilities are unique,” Obama said in the highly-anticipated speech at the Department of Justice. “That places a special obligation on us to ask tough questions about what we should do.” 


Yet Congress and the president’s Justice Department will play key roles in determining whether any of Obama’s proposals are enacted.  One revision the president proposed is under his control is halting any surveillance of  foreign leaders unless there are national security concerns involved.


The reforms represent a response of some of the most explosive revelations by fugitive contractor Edward Snowden, who made details of the NSA’s meta-data practices public last year.


Senior administration officials argued to reporters ahead of the president’s speech that there had been no abuses to the programs affected by the reforms. Obama ordered the changes, administration officials said, because they “present the risk of potential abuse.”


“The men and women of the intelligence community, including the NSA, consistently follow protocols designed to protect the privacy of ordinary people,” Obama said. “They are not abusing authorities in order to listen to your private phone calls, or read your emails. When mistakes are made – which is inevitable in any large and complicated human enterprise – they correct those mistakes.”


Effective immediately, the NSA will have to seek prior approval from the Foreign Intelligence Surveillance (FISA) Court before initiating new queries of bulk meta-data.


The president ordered the NSA and Attorney General Eric Holder to develop recommendations over the next 60 days as to how the program should be structured, and how meta-data should be stored. This window coincides with the late March deadline by which Congress must vote to re-authorize many intelligence practices anyway.


The proposal would also seek to add an element of transparency to the meta-data program by giving the FISA court more leeway to declassify its rationales for approving or rejecting the government’s data collection requests. Obama will also establish a group of outside advocates for the FISA court in hopes of more effectively protecting individuals’ privacy.


Obama’s speech in many ways intended to strike a balance between government prerogatives and civil liberties, and the difficulties of pinpointing the precise mixture between the two. 



President Obama assures Americans that the men and women working for the National Security Agency follow protocols to ensure the safety of citizens.



“Those who are troubled by our existing programs are not interested in a repeat of 9/11, and those who defend these programs are not dismissive of civil liberties,” he said. “The challenge is getting the details right, and that’s not simple.”


The president will also seek to reassure heads of states from allied nations that the United States will not seek to monitor their personal communications. This comes in response to revelations last year that the U.S. government had monitored the email of German Chancellor Angela Merkel, among other foreign leaders. A senior administration official said that the U.S. will not monitor the communications of heads of states from allied nations “absent a compelling national security purpose.”


Obama also took strides toward more clearly defining the nature of U.S. intelligence practices abroad without necessarily changing many of those practices. Obama explained that the U.S. only engages in data collection and surveillance abroad for the purposes of counterintelligence and counterterrorism, and to shore up cybersecurity and disrupt illicit transactions.


The president also emphasized that the United States’ intelligence practices isn’t used to suppress criticism or dissent or advantage American companies, nor does the U.S. randomly access foreigners’ emails at will.


Much of the manner in which the U.S. conducts surveillance and collects intelligence won’t change, though.


Obama didn’t heed some of the most significant of the 46 recommendations generated by the task force he empaneled last year to study potential changes to the national security and intelligence infrastructure. Though the change to how meta-data is stored was one of the panel’s recommendations, Obama will not separate the position of NSA director and the person in charge of monitoring U.S. Cyber Command.


The broader question is whether the reforms and constraints outlined on Friday by Obama will satisfy civil libertarians and broader criticism of the scope of U.S. surveillance.


Some of the revelations made public by Snowden and other self-proclaimed watchdog organizations have eroded domestic support for broad government surveillance. Fifty-six percent of Americans said in an NBC News/Wall Street Journal poll that they’re concerned about government going too far in violating individuals’ privacy, a gradual shift from the days following 9/11, when the public was more willing to give the government broad latitude in the name of counterterrorism.


Congress could also prove disruptive to the president’s proposals. In how speech, Obama vowed to “consult with the relevant committees in Congress to seek their views, and then seek congressional authorization for the new program as needed.”


Though the administration can initiate some of the reforms immediately, others will require congressional reauthorization. If libertarian-minded lawmakers from both parties aren’t satisfied by Obama’s reforms – particularly those involving meta-data that will be developed in the coming months by Holder and the NSA – it could spark a fight on Capitol Hill about whether further constraints are needed on government surveillance practices.


“President Obama’s announced solution to the NSA spying controversy is the same unconstitutional program with a new configuration,” said Kentucky Sen. Rand Paul, a libertarian-Republican critic of the NSA. On CNN, he suggested that the scope of government surveillance must ultimately be settled by the Supreme Court.


Such a fight would lay bare some of the odd political fault lines when it comes to national security issues, pitting hawkish Democrats and Republicans, joined together, against a handful of progressive Democrats and an ascendant, libertarian-minded wing of the GOP.
