Facing fire, Boehner insists his Obamacare expansion vote was really a repeal vote

Good luck with that.


House Speaker John Boehner’s job has gotten substantially harder with the success of Obamacare enrollments and the reality that the law is here to stay. He’s got one side—business interests—wanting his help in making changes to the law that will help them and the other—Matt Drudge and the tea party—insisting that he do nothing other than repeal. It’s not working out so well.

Last week, in an unusual voice vote without debate, the House passed their “doc fix,” the must-pass legislation to make sure physicians didn’t face a 24 percent cut in reimbursements in treating Medicare patients. Tucked quietly into that bill was a provision business organizations had been pushing for that would expand coverage options for small businesses by a eliminating cap on deductibles for small group policies offered inside the law’s health care exchanges. That would allow the businesses to offer high-deductible, cheaper policies for people who also have health savings accounts. That would count, for many, as an improvement in the law. Including Matt Drudge, who had a screaming headline Monday morning: “Republicans Expand Obamacare?”


Boehner is now falling all over himself trying to insist that this isn’t an expansion, but actually a repeal.

Too early to run Obamacare victory lap




  • The long-term impact of the Affordable Care Act won’t be measured for years

  • There are still many variables that will determine the law’s success or failure

  • One expert says it will all come down to whether lower premiums are delivered

  • Deductibles and customer satisfaction will also play into perception of whether it works



Washington (CNN) — Sure, President Barack Obama claimed victory when he announced from the Rose Garden that more than 7 million people had signed up for Obamacare.


“No, the Affordable Care Act hasn’t completely fixed our long-broken health care system, but this law has made our health care system a lot better — a lot better,” he said Tuesday, the day after enrollment closed for the year. “And that’s something to be proud of.”


The Democratic National Committee emailed reporters enticing them to click on a video to watch “coverage about how the Affordable Care Act is succeeding.”


No doubt, Obamacare will have an impact on the immediate future of health care.


It’s fair to say that more people have health insurance, whether that’s because of premium subsidies or prohibitions against discrimination against preexisting conditions or the fact that those under 26 can stay on their parents’ health insurance or from the expansion of Medicaid.


And the Democratic victory lap is welcome for a party suffocating under the weight of Obamacare politics, including fallout from glitches with the federal health care website and canceled insurance plans.

Now that it’s implemented, public opinion of the law is going to be tied to its success or failure. And the first year enrollment figures are only one small indicator.


In other words, the Obama administration’s celebration might be legitimate, but it could be premature as the long-term viability of the Affordable Care Act unfolds.

‘The real test is still to come’


There’s a lot more to the story that begins with Obama’s aim to reduce the ranks of the uninsured.


“The real test is still to come,” said Drew Altman, president of the Henry J. Kaiser Family Foundation.


And like any business, the cost and customer satisfaction are going to make or break the law and will ultimately determine enrollment.


Elaine Kamarck, a senior fellow with the Brookings Institution, said that if people can’t afford to pay their monthly premiums, even with the help of government subsidies, then the law will collapse.


“Essentially, it’s all going to be about the cost of the premiums,” she said.


Health Secretary Kathleen Sebelius predicted recently that premiums would rise, but at a lower rate than recent history.

The first clue as to whether that’s true will come sometime over the summer, when insurance companies begin submitting their rates for 2015.

“When insurers set their premiums for 2014, many of them built in some padding, assuming they were going to get an older sicker pool of enrollees,” Levitt said. “When they set their premiums for 2015, they’ll be looking at who actually signed up compared to what they expected.”


If premiums go up, it will signal insurance companies feel the customers who’ve enrolled are sicker — and thus more expensive — than expected. But if premiums stay steady or even go down, it will show that the initial pool of customers met their expectations.


Altman says there’s another cost factor — the cost of the deductible. If people can afford the cost of the premium but their deductible is so high that they can’t afford to pay for their doctors’ visits, then people will give up on the law.


And customer satisfaction matters, too. If people are frustrated their doctor is no longer available in their coverage plan and they can’t get the services they think they need, that could persuade them that it’s more worth it to pay the tax penalty for not being insured.


Growing pains


Other government programs that are now institutions saw their share of troubles in infancy.


A New York Times story from 1996 opened with this: “Medicaid, the little understood relative of Medicare that provides benefits for needy persons who cannot get Medicare, is having trouble persuading state governments to join up.”


The story noted that in Kentucky, 12,000 of the eligible 100,000 signed up. Another article in The Times said only 200,000 of an eligible 2 million people nationwide signed up for Medicaid in its first few months.


The Children’s Health Insurance Program created in the 1990s also had growing pains. States used less than 20% of federal funds granted to them for the health insurance program for low-income children.


And a 1999 Times story quoted a health care expert saying it was unclear whether the number of uninsured has been reduced with CHIP.


More than a decade later, more than 7 million children receive health benefits through CHIP and every senior over the age of 65 has access to Medicare and more than 66 million people were enrolled in Medicaid in 2010 — a number that has increased with the expansion of Medicaid in Obamacare.


What’s next for Obamacare?


But Altman says Obamcare can’t really be compared to other programs because the number of people who benefit from other government health programs are more uniform: Medicare benefits seniors, Medicaid the poor, CHIP is for children.


The Affordable Care Act is so varied, depending on what state you live in and what sort of coverage rules and cost framework is applied.


He notes that more than 500 different insurance zones exist around the country, each one impacting consumers differently, so anger in states where costs are high or the governor chose not to expand Medicaid might be at a different level in a state where costs are low.


As with any major piece of legislation, the law could still be changed. But politics will determine how much. If Democrats maintain control of at least one branch of government, then it would likely be tinkered with. If Republicans, however, win back the Senate and the White House in 2016, major changes could come.


While Karmack said Republicans are “going to have a hard time repealing the entire act because pieces of it are extremely popular,” one way to essentially gut the law is to reduce the amount of subsidies that participants receive for their premiums.


If the subsides don’t keep pace with the cost of the premiums, then the law will likely be unpopular and the ranks of the uninsured are likely to again rise.

I Saved $ 335.00 A Month On Healthcare Because Of Obamacare

Because of the ACA, earlier this month I signed up for a new platinum healthcare plan offered in California that is saving me a ton of money — and for that, I’m very grateful. As many of C&L’s readers know, I suffered for many years while running this site with severe nerve damage that ruined my music career and kept me in chronic pain for a very long time. As a result of that combined with my age and another previous condition, my healthcare plan (PPO) has skyrocketed the last few years, making it very difficult for me to sustain the kind of coverage I need. So when President Obama undertook the task of trying to fix our broken system, I was firmly behind it — not because I’m a progressive, but because it was essential to my wellbeing. I’m selfish that way, I know.


Healthcare has become a hot-button political issue in our country because of the GOP’s opposition to expanding coverage to millions of uncovered Americans and the Beltway media’s refusal to call it the way it really is, but for me, this is all about survival.


Paul Begala said as much to CNN:

I did so for one reason and one reason only: it was a good deal for my family. In fact, it was a better deal than we were getting before the ACA.

DAVID AXELROD: This is, of course, Alex, why seven presidents tried to do this, seven presidents failed over 65 years. It is a very, very difficult thing to do because you’re right, anytime something happens in the health care system — if a premium goes up, or if someone gets denied care in any way, people say that’s because of the Affordable Care Act. And, you know, f you’re intimidated by that prospect, then you should never have gone down this road.


I think the reason why people, from the president to members of Congress who voted this deserve such great credit, is this isn’t the easy, political thing to do. It’s going to take time. I think we’re going to look back in five, ten, twenty years and say that was an extraordinarily good decision. But the transitional period is fraught. And this is — one of the things is — one of the reasons it’s fraught is because of what you raised.


I want to make one point on what Zeke [Emanuel] said about the insurance industry. I suggest that all of the black helicopter crowd, the people who are doubting the numbers and all of that stuff should talk to the insurance industry because they seem to be bearing out the numbers that the government is reporting. Maybe they’ll believe private industry.

How can politicians make Obamacare the winning message? It’s in the polls.


Everyday Americans get up in the morning and go to work. They provide their services to companies and corporations. In return they expect a living wage. They expect that their work entitles them to financial security and healthcare security. For thirty plus years both have been eroding.

When President Obama ran for president in 2008 he understood that the root of every American’s economic security laid with ensuring every American would have access to affordable health care. He knew a single-payer health care system was the most effective system. However he was pragmatic enough to settle for RomneyCare on Viagra to begin the codification of health care as a right.


The reason health care reform has always eluded presidents of the past is because of ideological rigidity. President Obama minimized his ideological rigidity to the consternation of his left flank to get an imperfect law that will ultimately get improved. A few months ago I wrote a piece that placed this into context:


The genius in achieving the passage of Obamacare is immediately evident after reading the transcribed talk titled “A Brief History: Universal Health Care Efforts in the US” given by Karen S. Palmer MPH, MS in San Francisco at the Spring, 1999 Physicians For A National Health Program (PNHP) meeting. The talk revealed the headwinds that have blown over every President attempting to pass some form of universal healthcare. Doctor associations, insurance industry, unions, and other groups have always created opposition in some combination that guaranteed failure. She described the reason for failure as follows.

Political naiveté on the part of the reformers in failing to deal with the interest group opposition, ideology, historical experience, and the overall political context all played a key role in shaping how these groups identified and expressed their interests.


In effect, the very compromises President Obama has been knocked for are the compromises that allowed the passage of the Affordable Care Act. It was a running start that will need modification. The president is cognizant of this fact and he stated that much in the State Of The Union Speech on January 25th, 2011.

Organizing for Action Uses Gadsden Flag to Push Obamacare

A pro-Obama group pushing Obamacare is using a rendition of the Gadsden flag, often used by tea party members, on a bumper sticker it is giving away.

The bumper sticker, put out by Organizing for Action, has a stethoscope in the shape of a rattlesnake, like the original flag, but instead of the phrase “Don’t Tread on Me” it says, “Don’t Tread on My Obamacare.”


“This is for everyone who’s tired of hearing the other side talk smack about healthcare reform that is helping millions of Americans get affordable, quality care,” Jon Carson, OFA executive director, said on Facebook.


“They’ve spent hundreds of millions to tear it down. We’ve worked hard to make sure they didn’t succeed,” he added. “If you’re like me, you’re pretty proud of that. Want to brag about it?”


The group is a spin-off from President Barack Obama’s 2012 presidential campaign, and it often works in support of the president’s agenda.


The group began a door-to-door Obamacare campaign in February to help increase enrollment in the new healthcare law.


The Gadsden flag was originally created during the American Revolution, and was inspired by a cartoon created by Benjamin Franklin in 1754 depicting a rattlesnake broken into 13 parts, with each part representing one of the colonies, with the phrase “Join, or Die.”


The Gadsden flag is commonly seen carried by tea party members at rallies across the country.

With all of the discussion of ObamaCare’s failures, incompetencies, and flat-out lies, there has been a lot of head-scratching over accountability. No one has lost their job at HHS, for instance, for the faceplant of Healthcare.gov, not even the contractor responsible, which still has ongoing work on the project. In part, this is because no one in the administration wants to admit that anything’s seriously amiss, even though HHS will miss their enrollment target of 7 million by a wide margin — and that goal was exceedingly modest in the first place, after years of Democratic insistence that 40 million or more uninsured needed to get coverage.


There are structural reasons for the lack of accountability, too. Since ObamaCare is a multi-jurisdictional effort, no one agency in the government has oversight on the entire, sprawling mess. The Inspectors General of HHS and Treasury can only look within their own structures, which allows for stovepiping and structural disconnects for accountability. Rep. Peter Roskam wants to take a page from TARP and create a new oversight agency, and explained it today to Larry Kudlow on CNBC:


The concept is a very simple one – follow the money and give an independent oversight agent, that is a Special Inspector General, the capacity to go across all of these jurisdictional lines. Because here’s the limitations right now: the Health and Human Services Inspector General can only ask HHS questions; Treasury can only ask Treasury questions. And there’s dozens of agencies that are involved in Obamacare and no one single entity has the capacity to ask all of the questions. This will be a money saver. …


It all begs the question, which is, who watching this whole scene? And the answer is nobody is watching the whole scene in totality…the reality, Larry, is that the Administration has so wedded itself to Obamacare, a signature piece of legislation for the president, that they don’t have that dispassionate interest in trying to get to the bottom of things. They are really interested in covering up and patching through, and coming up with a whole hodgepodge approach. And the net result is – it’s individual citizens and individual businesses that are really suffering. …


I think Obamacare is a house of cards that is collapsing as it is being built. The trouble is that, as it is being built and as it is collapsing at the same time, it’s injuring people and it’s having an adverse impact on the economy. You cannot get straight answers from this Administration, which is why you need an independent oversight organization, or a Special Inspector General, that has the breadth and capacity to get and cut through all the nonsense and go from one department to the other department to put all of the pieces together to find out what’s what.



Roskam offered legislation nearly two weeks ago, titled Special Inspector General for Monitoring the Affordable Care Act (SIGMA), to duplicate the kind of accountability that TARP eventually had. That’s not to say that the TARP’s IG managed to eliminate the waste and incompetence that went into that program, but Neil Barofsky did offer plenty of sunlight on just how badly the TARP-related pieces of Obamanomics performed.


Roskam reminded National Review readers of the kind of accountability IGs can provide when truly independent:


Recent special inspectors general have been remarkably successful. Beginning in 2004, the Special Inspectors General for Iraq (SIGIR) and Afghanistan Reconstruction (SIGAR) have produced $ 645 million and $ 480 million in direct taxpayer savings, respectively. And since 2008, the Special Inspector General for the Troubled Asset Relief Program (SIGTARP) has used the broad investigative powers provided by Congress to rack up 122 convictions, 75 suspensions and debarments of federal contractors and employees, and $ 533 million in direct taxpayer savings. At $ 700 billion, the jurisdiction of SIGTARP was the largest to date, but that program pales in comparison to the $ 1.8 trillion in costs under Obamacare.



Don’t expect the White House to welcome SIGMA with open arms. Then-Senator Obama was certainly enthusiastic about SIGTARP, but that was before accountability applied to him and his team. House Republicans should demand this from Senate Democrats — and then demand a public explanation when they oppose it.
