US Appeals Court Upholds California Ban on Gay-conversion Therapy

California’s ban on a controversial therapy aimed at reversing homosexuality in children was upheld by a federal appeals court on Thursday that dismissed arguments by opponents of the measure who contended it violated free speech and parental rights.

The 9th U.S. Circuit Court of Appeals ruling concluded that the so-called gay-conversion therapy ban does not violate the constitutional rights of counselors, minor patients or their parents.

“California has authority to prohibit licensed mental health providers from administering therapies that the legislature has deemed harmful,” the ruling said.

The ruling by a three-judge panel resolved two lawsuits seeking to stop implementation of the measure, which prohibits therapists from performing sexual-orientation change counseling with children and teens under age 18.

Democratic Governor Jerry Brown signed the ban into law in September, making the nation’s most populous state the first to prohibit the treatment, also known as reparative therapy, among youths. New Jersey Republican Governor Chris Christie signed a similar measure into law earlier this month.

The California ban marked a major victory for gay rights advocates, who say the treatment lacks a medical basis and can psychologically harm gay and lesbian youth.

Implementation of the law had been on hold pending the suits filed by Christian groups seeking to block it. The California Psychological Association and the California Board of Behavioral Sciences supported the ban.

A spokesman for state Attorney General Kamala Harris, who has defended the law, said she was not immediately available to comment. State Senator Ted Lieu of Torrance, the bill’s author, applauded the decision.

“Today’s federal court opinion puts another nail in the coffin for the discredited and harmful practice of gay-conversion therapy,” he said in a statement. “Now the law has caught up to the truth: Sexual orientation is not a mental illness or defect.”

Mat Staver, founder of Liberty Counsel, which had earlier obtained an injunction to block the law, issued a renewed criticism of the ban as politically motivated and “an astounding overreach by the state.”

“Legislators and judges in the state of California have essentially barged into the private therapy rooms of victimized young people,” Staver said in a statement.

Manning ready to pay for hormone therapy - attorney

Chelsea Manning, the whistleblower formerly known as Bradley Manning who announced she wanted to live as a woman after being sentenced to 35 years in jail, is ready to pay for her hormone therapy, her lawyer said.

David Coombs, Manning’s lawyer, announced his defendant would want to have hormone treatment as soon as possible. In an interview with AP, Coombs said he perceived from online comments about the situation that people were mostly objecting to Manning being given this kind of therapy on the taxpayers’ dime.

The attorney said he and Manning had some hope that the Army or the military prison would finance hormone treatment, since it had been an Army psychiatrist who diagnosed Manning with gender-identity disorder.

“It’s just to be comfortable in her own skin,” Coombs said, referring to Manning as female, according to the whistleblower’s wish.

The day after Bradley Manning was sentenced for leaking hundreds of thousands of classified documents, he announced he wanted to live as a woman, and to live under the name of Chelsea Elizabeth.

The attorney explained Manning did not want sex-reassignment surgery, but thought the hormone therapy – high doses of estrogen to promote female characteristics, such as breast development – could help to cope with gender disphoria.

The chances the Army will pay for the treatment are meager, according to officials’ earlier comments. “The Army does not provide hormone therapy or sex-reassignment surgery for gender identity disorder,” Kimberly Lewis, the spokeswoman for Fort Leavenworth prison where Manning is to serve his sentence, told Courthouse News Service on August 20.

Coombs does not rule out the possibility of Manning having to sue in military or civilian court for his right to get hormone treatment. The attorney said he hoped the military prison “will simply do the right thing.”

The Fort Leavenworth prison is all-male and its officials are at this point unlikely to refer to Manning by the name and pronoun she wishes to be addressed by.

Coombs, however, said he and his client would still look into the legal options for the name change and would try to make the military recognize it.

The lawyer said Manning realizes that the process of accepting her new gender and name will take some time.

“There’s a realization that most people know her as Bradley,” Coombs said. “Chelsea is a realist and understands.”

The whistleblower’s supporters are, however, already taking action to make it happen sooner.

“In response to PVT Manning’s announcement, the Bradley Manning Support Network is changing its name to the Private Manning Support Network, and will work on changing other frequently used parts of its website and materials to incorporate the name Chelsea and the female pronoun,” David Coombs’s blog reads.

Talk therapy helps Congolese victims of sexual violence recover

Group sessions work better than individual counseling

By Nathan Seppa

Web edition: June 6, 2013

African women living in a war zone who have post-traumatic stress disorder from enduring or witnessing sexual violence are more apt to overcome it with group therapy than with private counseling, researchers report in the June 6 New England Journal of Medicine.

The approach, called cognitive processing therapy, encourages people with PTSD to reassess how they think about an event. Victims of sexual violence often place blame on themselves. “They might think, ‘It was my fault,’ or ‘I should have prevented this,’” says Boston University psychologist Patricia Resick.

Cognitive processing therapy provides step-by-step mental techniques to identify such maladaptive thoughts or beliefs, says study coauthor Judith Bass, a psychiatric epidemiologist at Johns Hopkins University in Baltimore. Then, she says, the women “can move forward.”

To test the strategy in groups against individual support therapy by lay counselors, researchers enlisted 405 women in 15 villages in eastern Democratic Republic of Congo, a rural area that has been beset by warfare for nearly two decades. Armed militias and government soldiers continue to roam the region, often attacking civilians. Nearly all the women in the study had been raped.

Psychological assessments of the women showed that most of them had PTSD along with depression or anxiety. Many were also functionally impaired — unable to perform routine tasks. The researchers assigned 248 women in eight villages to get individual support counseling as needed, a standard crisis response; 157 women in the other seven villages were put in groups of six to eight and got up to 12 sessions of cognitive processing therapy.

After four months, the proportion of women with probable PTSD dropped from 60 percent to 8 percent in the cognitive processing therapy group; the proportion of those with depression or anxiety plummeted from 71 to 10 percent. Their functional impairment scores dropped by half. In the women who received individual support counseling, rates of probable PTSD, depression or anxiety declined less, from 83 percent to about 54 percent.

Resick, who devised the 12-session cognitive processing strategy, has used it to treat PTSD in rape victims, battered women and combat veterans. She says testing the therapy in war-torn Congo is a real accomplishment, in part since many of the women were illiterate. The therapeutic strategy normally involves giving clients notebooks to record and recognize problem thoughts and to write down coping techniques. “I was very impressed, actually amazed,” she says, “that they were able to pull off a randomized, controlled trial under those kinds of circumstances.”

The approach should translate to other war-weary areas, Bass says. “We’ve shown we can do it in low-literacy, conflict areas. These are the hardest parts of the world.”
