Report: 80 percent of U.S. deportations involve minor offenses

The United States is mostly deporting undocumented immigrants who have committed only minor offenses or have no criminal record, despite President Barack Obama’s promises to the contrary, the New York Times reported Monday.




The newspaper said it found that only 20 percent of the two million people deported since Obama took office in January 2009 were involved in major crimes like drug trafficking.




Obama, whose quest for comprehensive immigration reform has run aground in the Congress, has assured Hispanics that his government was going after “criminals, gang bangers, people who are hurting the community, not after students, not after folks who are here just because they’re trying to figure out how to feed their families.”




But the Times said its analysis of records of more than 3.2 million deportation cases over the past decade showed that deportations actually increased under Obama.




Moreover, two thirds “involve people who had committed minor infractions, including traffic violations, or had no criminal records at all,” it said.




It found that deportations of people who only had traffic violations quadrupled in Obama’s first five years in office, over George W. Bush’s last five years as president — 193,000 over 43,000.




The Times also discovered that in 2013 immigration charges were filed in 90 percent of deportation cases involving people with no prior criminal records.




For those deportees, it means they face up to a year in prison if they return to the United States within five years.




Faced with growing criticism, Obama last month announced a review of his administration’s deportation policies to see if there was a “more human” approach.




He blamed Congress for the high number of deportations, claiming he had no option but to apply the law as long as the legislature failed to approve comprehensive immigration reform.




The US Senate last year approved an ambitious reform bill that offers a path to citizenship for 11 million undocumented immigrants.




The bill also provides for strengthened border controls and a complete overhaul of the US system for issuing visas, among other initiatives.




But the bill is stalled in the House of Representatives, and analysts agree that it is unlikely to come to a vote before mid-term elections in November.

The Senate Intelligence Committee voted on Thursday afternoon to declassify a 480-page summary of a report on the Central Intelligence Agency’s detention and interrogation programs.

Senate Intelligence Chairwoman Dianne Feinstein (D-Calif.) said the documents show the CIA “made serious mistakes that haunt us to this day” in the agency’s efforts to track down those responsible for the terrorist attacks on Sept. 11, 2001.

“The purpose of this review was to uncover the facts behind this secret program, and the results were shocking,” Feinstein said. “The report exposes brutality that stands in stark contrast to our values as a nation. It chronicles a stain on our history that must never again be allowed to happen.”

The committee agreed to declassify the report in a narrowly divided 11-3 vote, with Sen. Tom Coburn (R-Okla.) voting present. The decision marked the culmination of a five-year investigation by the Senate panel that studied how the CIA treated more than 100 detainees. It comes at a time of heightened tension between some lawmakers and the CIA after Feinstein recently accused the agency blocking the committee’s investigation.

Feinstein said that the documents contain details about CIA mismanagement of its Bush-era interrogation programs and exposes “major problems” regarding the intelligence community’s interactions with Congress and the White House.

“The release of this summary and conclusions in the near future shows that this nation admits its errors, as painful as they may be, and seeks to learn from them,” Feinstein said. “We are acknowledging those mistakes, and we have a continuing responsibility to make sure nothing like this ever occurs again.

The report now goes to the White House, where President Barack Obama must review it before its public release. The panel’s Republicans also plan to eventually release minority views on the report, which is expected to critique how the report was gathered.

Sens. Angus King, the Maine independent who caucuses with the Democrats, and Susan Collins, a Republican who is as close to a maverick as the party includes these days, announced Wednesday that they will vote to declassify the “Finding & Conclusions” and the Executive Summary of the 6,300-page torture report of the Senate Select Committee on Intelligence. Both senators are members of the 15-member committee, which is scheduled to vote on declassification Thursday.

Good to hear. But even if the vote is favorable, as now seems probable, it might be months or longer before the public actually sees the report, which was completed 16 months ago. It has been the subject of review by the CIA and unproductive discussions between committee members and the agency, which ran the torture program whose methods became euphemized as “enhanced interrogation techniques.” The CIA would almost certainly seek a final review of the parts of the report the committee seeks to declassify.

Having the CIA handle such a review is especially troubling given the details of the report that have been leaked to the press. In addition to what was already known, what those details show is that the agency intentionally released false information to persuade people that torture works and that it employed methods of torture not previously confirmed. Nobody should be surprised by either of those revelations.

(Newser) – The tax code is rife with home ownership incentives that are both popular with voters and staunchly defended by lawmakers. But it turns out the breaks mostly just help rich people buy pricier houses, according to a new report from the right-leaning R Street Institute. They “don’t encourage homeownership in any meaningful way,” the study’s author tells the Wall Street Journal. “People just end up buying larger homes.” He estimates that in Washington, DC, the subsides have increased the average home size by 1,400 square feet.

What’s more, the tax breaks are mainly going to the wealthy; homeowners with incomes above $ 100,000 are four times as likely to claim the benefit as those earning less, because low earners rarely itemize their deductions. It’s the kind of report that can anger the right and the left alike. Matt Welch at Reason calls the tax breaks an “upper class entitlement,” while Hamilton Nolan at Gawker calls it a “grotesque policy outcome.” Barack Obama has repeatedly called for making the benefit available only to those making less than $ 200,000 a year.

NSA records all calls in targeted foreign nation: report

WASHINGTON (Reuters) – The U.S. National Security Agency has created a surveillance system that can record all phone calls in a targeted foreign nation, allowing it to play back and listen to conversations up to 30 days later, the Washington Post reported on Tuesday.

The newspaper cited unnamed sources with direct knowledge of the system as well as documents supplied by former NSA contractor Edward Snowden, who since last year has leaked extensive data revealing sweeping American spying activities.

The voice interception program is known as MYSTIC and started in 2009, with its “retrospective retrieval” capability, called RETRO, reaching full strength in 2011 against the first target nation, the Post reported.

The newspaper said that at the request of U.S. officials, it was withholding details that could be used to identify the nation where the system is being used or others where it might be used in the future. The Post cited documents that envisioned similar U.S. spying operations in other nations.

A classified summary of the system said the collection effort was recording “every single” conversation nationwide in the first target country, storing billions of conversations in a 30-day rolling buffer that clears out the oldest calls as new ones are made, the Post reported.

A senior manager for the program likened it to a time machine that can replay voices from any phone call without the need to identify a person for spying in advance, the newspaper reported.

The Post said that no other disclosed NSA program captures a nation’s telephone network in its entirety.

Current and former U.S. officials quoted anonymously by the Post said large numbers of conversations involving Americans would be gathered using the system.

White House spokesman Jay Carney, at his regular news briefing on Tuesday, sidestepped a question about the Post article, saying that “we don’t, as a general rule, comment on every specific allegation or report.”

“We make clear what activity the NSA and … our intelligence community engages in, and the fact that they are bound by our laws and the oversight of three branches of government,” Carney told reporters.

Carney also noted that President Barack Obama announced a series of steps in January to “significantly reform our activity.

Obama on January 17 began reining in the vast collection of Americans’ phone data and banned U.S. eavesdropping on the leaders of close allies in a series of limited reforms triggered by the revelations from numerous documents leaked by Snowden.

In a statement published by the Post, White House National Security Council spokeswoman Caitlin Hayden refused to comment on “specific alleged intelligence activities.”

But Hayden said “new or emerging threats” are “often hidden within the large and complex system of modern global communications, and the United States must consequently collect signals intelligence in bulk in certain circumstances in order to identify these threats,” the Post reported.

NSA spokeswoman Vanee Vines told the Post that “continuous and selective reporting of specific techniques and tools used for legitimate U.S. foreign intelligence activities is highly detrimental to the national security of the United States and of our allies, and places at risk those we are sworn to protect.”

Snowden last year fled to Hong Kong and then to Russia, where he has asylum. The United States wants him returned to face criminal prosecution.

China rejects UN report accusing North Korea of crimes against humanity

China dismissed a UN report alleging North Korea has committed crimes against humanity, effectively confirming the fears of human rights advocates that Beijing will shield its ally Pyongyang from international prosecution.

The report, published in February, accused the reclusive country of mass killings and torture comparable to Nazi-era atrocities and said officials, possibly even Supreme Leader Kim Jong Un himself, should face the International Criminal Court (ICC).

Chen Chuandong, a counselor at China’s mission in Geneva, told the UN Human Rights Council on Monday that the independent commission of inquiry had made unfounded accusations and made recommendations that were “divorced from reality.”

“The inability of the commission to get support and cooperation from the country concerned makes it impossible for the commission to carry out its mandate in an impartial, objective and effective manner,” Chen said.

China, as a member of the UN Security Council, would have the power to veto any move to refer North Korea to the Hague-based ICC. Diplomats had already warned China was likely to object to the report, which also criticized Beijing for its treatment of North Korean defectors.

The chief author of the report, retired Australian judge Michael Kirby, had opened the debate urging the United Nations to take action.

“Contending with the scourges of Nazism, apartheid, the Khmer Rouge and other affronts required courage by great nations and ordinary human beings alike,” Kirby said.

“It is now your solemn duty to address the scourge of human rights violations and crimes against humanity in the Democratic People’s Republic of Korea.”

Kirby said the team’s findings, based on testimony from hundreds of victims, defectors and witnesses, were unequivocal, and demanded closure of political prison camps believed to hold up to 120,000 people.

But Chen said the report was based on information and interviews collected outside the country, without first hand information. “The question then arises: can such an inquiry be truly credible?”

The commission has been seeking a meeting with Chinese officials in Geneva, UN officials said. “We are not very optimistic that it will happen,” a UN official told Reuters.

Defector

Shin Dong Hyuk, a North Korean born in a political prison camp who escaped after his mother and brother were publicly executed, told Reuters he had expected China to reject the report.

But the “big purpose” of establishing the inquiry was to get the report discussed at the UN Security Council, he added.

In a speech at the Geneva debate, he noted that millions of people had been slaughtered in Nazi concentration camps during World War II.

“And 60 years later, at this moment in North Korea, hundreds of thousands of political prisoners are waiting for their death,” he said, adding that the report could not be “thrown away like a used tissue and forgotten”.

US Ambassador Robert King, the US envoy on North Korean human rights issues, said pressure on Pyongyang would go on even if China blocked a UN Security Council resolution.

“The fact that right now we may not be able to go forward as far as we’d like to go does not mean that we’re going to stop and say we can’t do anything more, and we’re not going to do it,” he told reporters. “Human rights are not a quick and easy fix and we’re not going to stop.”

North Korean Ambassador So Se Pyong reiterated Pyongyang’s rejection of the report, rubbishing it as a ridiculous provocation and a fabrication instigated by the United States and other “hostile forces,” who he said should be investigated for their own human rights records.
