Florida police used a cell phone tracking device at least 200 times without a warrant because they conspired with the device manufacturer to keep its use a secret, according to the ACLU.

Through a recent motion for public access, the ACLU determined that at least one Florida police department never told judges about its use of the cell phone tracking device, known as a “stingray,” because the department signed a non-disclosure agreement with the stingray’s manufacturer to keep its use from being publicly known.

The manufacturer, which the ACLU said was likely a Florida-based company, also retained ownership of its stingrays and only let the department borrow them, further aiding in its secrecy.

The stingray, also called a “cell tower simulator,” determines the location of a targeted cell phone by impersonating a cell tower, which tricks the targeted phone – and non-targeted cell phones in the same range – into transmitting its precise location and phone records to the stingray.

“When in use, stingrays sweep up information about innocent people and criminal suspects alike,” Nathan Freed Wessler, an ACLU attorney, reported.

The ACLU learned about the department’s use of the stingray through an ongoing court case entitled Florida v. Thomas, in which police used the device to track a stolen cell phone to the suspect’s apartment.

After forcing their way inside the apartment, the police conducted a search of the residence, found the stolen phone and arrested the suspect.

Yet the police never obtained a warrant for the search or for its use of the stingray.

“This was apparently because they had signed a non-disclosure agreement with the company that gave them the device,” Wessler wrote. “The police seem to have interpreted the agreement to bar them even from revealing their use of stingrays to judges, who we usually rely on to provide oversight of police investigations.”

“Potentially unconstitutional government surveillance on this scale should not remain hidden from the public just because a private corporation desires secrecy,” he added. “And it certainly should not be concealed from judges.”

And, according to the ACLU, other police departments are also using stingrays secretly in the same fashion, joining an ever growing list of government entities infringing upon the Fourth Amendment.

Last week it was revealed that officials in Ypsilanti Township, Michigan began working with local police to place surveillance cameras in every neighborhood.

“We are recording images that a police officer would see if he or she were standing in the same place,” the township’s director of the Office of Community Standards, Mike Radzik, said.

And several months prior, a city in New Jersey decided to counter personnel reductions in its police force by placing the public under constant surveillance.

In fact, he filmed public spaces in New York, Philadelphia, and Boston where a sociologist had filmed in the 1960s and ’70s, and compared the two. And lo and behold, we’re actually less alone than before. Among the findings and reactions:

• Cell phone use was fairly low, 3% at one location and 10% at another, the study found. And users tended to be alone, rather than ruining group dynamics by using cell phones with friends.


• Public interaction is higher today than in the old films. Today, 24% of people hanging around outside the Metropolitan Museum of Art are alone, but it was 32% back in 1979.


• Sherry Turkle, author of Alone Together, concedes that Hampton may be right about public spaces, but says his study ignores the destructive effects of technology in the home.


• Hampton’s most surprising finding: More women are out in public than before. “I mean, who would’ve thought that, in America, 30 years ago, women were not in public the same way they are now?” he says. “We don’t think about that.”

Back to the bad news: A Kent State University study finds that cell phone use gives students greater anxiety and lower GPAs, 23ABC News reports. “I will say, it does distract me and I guess that could affect my GPA,” says one student.

Man mysteriously found dead in U.S. border control cell after being arrested for marijuana possession

The cause of death of a man who collapsed in a San Diego Border Patrol holding cell on Christmas Eve after he was taken into custody for allegedly carrying three pounds of marijuana, is being investigated by the County Medical Examiner’s office.

U.S. citizen Steven Keith, 58, was stopped at a checkpoint on Interstate 8, near the Mexican border.  

He was arrested and taken to a holding cell at the Campo Border Patrol station after authorities said they found marijuana, drug paraphernalia and traces of methamphetamine in his car.

Several hours after sitting in a holding cell, officials said Keith became ‘incoherent and unresponsive.’

Border Patrol emergency medical technicians performed CPR on Keith while waiting on paramedics to arrive. Paramedics took over life-saving efforts but were unable to revive Keith, officials said.

Keith’s sister Janet, who lives in Texas, said Steven had moved to Thailand years ago but was visiting family in San Diego for the holidays.

Janet said the medical examiner told her an autopsy was done, but they couldn’t release the cause of death for 90 days while toxicology tests are being completed, reports ABC10.

Janet, a former police officer, said her brother was in good health. He had no partner or children.

‘I am a former police officer myself and I definitely want some answers and I’m going to get them,’ she told UT San Diego.

‘Customs and Border Protection’s San Diego Sector Border Patrol is cooperating fully with these investigators to ensure a neutral third party reviews all evidence and information surrounding this unfortunate death,’ said a statement released by the Border Patrol.

The Department of Homeland Security Office of Investigator General is also investigating the incident.

Alliance San Diego, a human rights organization, is monitoring the incident as well.

‘Border Patrol is under a whole lot of pressure to make sure their agents are properly trained and to make sure when cases like this happen information is properly given to the family,’ said Christian Ramirez with Alliance San Diego.

Cops and Feds Routinely ‘Dump’ Cell Towers to Track Everyone Nearby

The nation’s mobile phone carriers received more than 9,000 requests last year for cell-tower dumps, which identify every mobile phone at a particular location and time, often by the thousands.

The revelation, revealed in a congressional inquiry, underscore that domestic authorities, from the FBI to the local police, are performing a massive amount of surveillance on Americans on domestic soil sometimes without probable-cause warrants.

Figures provided by the nation’s largest carriers T-Mobile, Sprint, Verizon and AT&T, and smaller companies like C-Spire and Cricket, show that the carriers overall got as many as 1.1 million requests for customer cellular data last year. They’ve earned tens of millions of dollars processing the data, the records show.

The governments requests, most of which were honored, include data for, among other things, the geo-location of a device, call detail records, texts message contents, voicemail, cell tower dumps, wiretapping, subscriber information, and websites visited.

But the most startling figures show that the authorities are obtaining information on the whereabouts of perhaps thousands of people at once, often by a judge’s signature based on assurances from the authorities that the data is relevant to an investigation.

A myriad of factors determine how many people are caught in the web of one of these so-called “cell-tower dumps” or “searches,” including the time, location and a mobile-phone tower’s capacity. The data from a dump can provide a wealth of information regarding whoever is carrying a mobile phone in a tower’s area — from the phone number to various device information pointed to a phone’s account.

Although we do not specifically track the details of each tower request, our experience is that we typically receive requests for less than 30 minutes (e.g., where law enforcement is already able to pinpoint the time of a crime). But we also receive requests covering more than an hour (e.g., where there has been a crime spree). When we receive a demand for a longer period, cognizant that the cell tower dump will contain many mobile device numbers, we will often ask law enforcement to narrow the scope of the time period or accept reports run for shorter, incremental periods, even if the longer time period was approved by a judge. The number of mobile device numbers per cell tower dump depends on many factors including the location of the tower and the time day. A major event (like the Boston Marathon) may lead to a substantial increase in the number of mobile device numbers communicating with a tower at a given time.

Sprint said it “provided approximately 6,000 cell tower searches (.pdf) to law enforcement agencies.” T-Mobile did not answer the question.

The responses were released today as part of an inquiry by Sen. Edward Markey (D-Massachusetts).

“As law enforcement uses new technology to protect the public from harm, we also must protect the information of innocent Americans from misuse, said Markey, who is a member of the Commerce, Science and Transportation Committee. “We need a 4th amendment for the 21st century. Disclosure of personal information from wireless devices raises significant legal and privacy concerns, particularly for innocent consumers. That is why I plan to introduce legislation so that Americans can have confidence that their information is protected and standards are in place for the retention and disposal of this sensitive data.”

The disclosures come amid revelations from NSA whistleblower Edward Snowden that National Security Agency snoops are harvesting as many as 5 billion records daily, without warrants, to track mobile phones as they ping nearby cell towers across the globe.

The law on cell-site locational tracking — while generally favorable to the government — is far from clear. Courts are offering mixed rulings on whether warrants are needed, and the Supreme Court has yet to take a case to resolve the issue.

Markey’s proposed legislation, which he is expected to drop within the coming weeks, would require probable-cause warrants for mobile-phone location tracking “to believe it will uncover evidence of a crime. This is the traditional standard for police to search individual homes.”

Chris Calabrese, the legislative counsel for the American Civil Liberties Union, said: “The idea that police can obtain such a rich treasure trove of data about any one of us without appropriate judicial oversight should send shivers down our spines. There is an easy fix to part of this problem – President Obama and members of Congress should pass legislation that updates our outdated privacy laws by requiring law enforcement to get a probable cause warrant before service providers disclose the contents of our electronic communications to the government. Anything less is unnecessarily invasive and un-American.”

The figures, meanwhile, while showing that the carriers are all over the map in terms of whether warrants are required for dumps, also reveal that the carriers keep the data for differing time periods, too. For example, U.S. Cellular and Verizon keeps cell-tower data for a year. T-Mobile (.pdf)  and Sprint retain it for 180 days and AT&T five years. Markey would like to see a nationwide, uniform approach to that.

AT&T said the average cell-tower dump was 80 minutes. (.pdf) The company said it charged $ 10.3 million last year furnishing thousands of request for data to the authorities last year. Verizon, which reported 2,400 tower dumps, said it charged “less than” $ 5 million last year to comply with all government demands for customer and cell-site monitoring.

The National Security Agency conducted a secret pilot project in 2010 and 2011 to test the collection of bulk data about the location of Americans’ cellphones, but the agency never moved ahead with such a program, according to intelligence officials.

The existence of the pilot project was reported on Wednesday morning by The New York Times and later confirmed by James R. Clapper, the director of national intelligence, at a Senate Judiciary Committee hearing. The project used data from cellphone towers to locate people’s cellphones.

In his testimony, Mr. Clapper revealed few details about the project. He said that the N.S.A. does not currently collect locational information under Section 215 of the Patriot Act, the provision the government says is the legal basis for the N.S.A.’s once-secret program under which it collects logs of all domestic calls from telephone companies.

“In 2010 and 2011, N.S.A. received samples in order to test the ability of its systems to handle the data format, but that data was not used for any other purpose and was never available for intelligence analysis purposes,” Mr. Clapper said.

He added that the N.S.A. had promised to notify Congress and seek the approval of a secret surveillance court in the future before any locational data was collected using Section 215.

An official familiar with the test project said its purpose was to see how the locational data would flow into the N.S.A.’s systems. While real data was used, it was never drawn upon in any investigation, the official said. It was unclear how many Americans’ locational data was collected as part of the project, whether the agency has held on to that information or why the program did not go forward.

After combing reams of data on individual purchases from a national mobile operator (unnamed in their report), they discovered that, in a country where prepaid phones dominate, there are basically two kinds of airtime buyers: those who make big infrequent purchases, filling up on minutes, and those who buy fewer minutes more regularly. Their theory is the re-fillers are richer than those who buy airtime often, and thus the average size of an airtime purchase can serve as a proxy for wealth. And indeed, the biggest average purchases, as the map below shows, happen in Abidjan, the capital; in a few cities in the interior; and around key border areas and trade routes.

There’s good reason to believe in a connection between airtime purchases and wealth. Mobile service providers throughout Africa allow their customers to transfer minutes between one another. In Côte d’Ivoire, such transfers are especially easy. The result is that airtime is used as currency in Côte d’Ivoire, Ghana, Egypt, and other countries. Airtime goes beyond being a proxy for wealth. In a sense, it is wealth.

There is a certain irony in studies such as this one. The main reason to do them is that, in countries like Côte d’Ivoire, government statistics can be spotty and unreliable. But the absence of solid statistics means the researchers have no real way of validating their results.

Still, as the map suggests, they’re probably on the right track.

US President Barack Obama has toured Robben Island – the jail in which Nelson Mandela was kept for 18 years.

He said he and his family were “deeply humbled” to visit the prison once inhabited by Mr Mandela – who remains critically ill in hospital.

Mr Obama went on to give a speech at the University of Cape Town and launch a multi-billion-dollar electricity initiative.

The US leader did not visit Mr Mandela, but met the Mandela family in private.

Security is likely to have been strengthened during this final Cape Town leg of his time in South Africa, says the BBC’s Karen Allen who is there, following clashes on Saturday between riot police and anti-Obama protesters in Soweto.

On Sunday morning, two church groups were singing hymns, while veterans from Umkhonto we Sizwe (MK), the ANC’s armed wing set up by Mr Mandela, arrived with a portrait of their founder wearing a military uniform.

The tributes come from around the world – Pakistan, Mexico and France – as well as several African countries. And in a testimony to Mr Mandela’s dream of creating a rainbow nation, all of South Africa’s racial groups were represented.

As she left a bunch of white chrysanthemums, Raksha Daya said that like many South Africans, she connects with the former president on a deeply personal level, like a grandfather. “It’s a sense of love.”

‘Heroes’

Mr Obama and the first family visited Mr Mandela’s bleak cell as well as the lime quarry – overlooked by a concrete watchtower – where anti-apartheid fighters including Mr Mandela were forced to undertake hours of back-breaking labour.

Mr Mandela was at the prison for 18 years and his long history of lung problems can be traced to the tuberculosis he contracted there – which he attributed to the dampness of his cell.

Later, Mr Obama wrote in the guest book in the prison courtyard: “On behalf of our family, we’re deeply humbled to stand where men of such courage faced down injustice and refused to yield.

“The world is grateful for the heroes of Robben Island, who remind us that no shackles or cells can match the strength of the human spirit.”

Mr Obama also visited a community project before delivering a keynote address at the University of Cape Town.

It was the same venue where 47 years ago, US Senator Robert Kennedy gave his famed “ripple of hope” speech, which gave inspiration to those fighting the racially divisive policies of apartheid rule and linked their struggle with that of the US civil rights movement.

Mr Obama paid tribute to South Africa’s achievements over the past two decades but urged young Africans to fulfil Mr Mandela’s legacy.

“Nelson Mandela showed us that one man’s courage can move the world,” he said.

More needed to be done to tackle poverty and disease, he said, adding that fear too often prevailed in Africa. For as long as war raged, democracy and economic opportunity could not take hold, he said.

Mr Obama also announced a $ 7bn (£4.6bn) five-year initiative to double access to electricity in sub-Saharan Africa, in partnership with African countries and the private sector.

Mr Obama arrived in South Africa from Senegal on Friday evening. On Monday, he will continue his African tour in Tanzania.

Family row

Mr Mandela’s family heir, Mandla, has said he will oppose a court action brought by the rest of the family, seeking to exhume the bodies of his father, Makgatho, two of Nelson Mandela’s daughters and two other relatives.

The rest of the family want the remains to be reburied in Qunu, where the former South African president wants to be laid to rest, while Mandla, an ANC MP, wants them to stay in the nearby village of Mvezo, Nelson Mandela’s birthplace, where he is building a museum dedicated to his grandfather.

South Africa’s Sunday Times newspaper quotes local chiefs in the area as saying that Madiba, as Nelson Mandela is known in the country, will not be at peace until this issue is resolved.

On Friday, a court granted an interim action saying the bodies could be exhumed and reburied but Mandla Mandela says he was not aware of the case until it was reported in the media and he is now opposing it.
