Smith & Wesson pull out of California over microstamping

California is providing a valuable lesson for defenders of Second Amendment rights around the country this year. Having failed to convince the courts that guns should be outright banned, they’ve done an end around move and passed a law which makes it so prohibitively expensive to produce their product that at least one major manufacturer is just going to stop selling some of their weapons there.


Gun manufacturer Smith & Wesson refused Thursday to comply with California’s controversial “microstamping” law, causing more of its products to fall off the state’s permissible firearms list and be ineligible for sale.


In a two-page statement on its website, Smith & Wesson criticized Assembly Bill 1471, which requires new or redesigned semiautomatic weapons to carry microstamping technology, imprinting its make, model and serial number onto shell casings when a bullet is fired.


Though the law was passed in 2007, language in the legislation stipulated it would go into effect when the necessary technology was widely available. It was not enacted until May 2013.


Critics argue that the technology is flawed. In its statement, Smith & Wesson said “a number of studies have indicated that microstamping is unreliable, serves no safety purpose, is cost prohibitive and, most importantly, is not proven to aid in preventing or solving crimes.”


“Smith & Wesson does not and will not include microstamping in its firearms,” the statement said. “The microstamping mandate and the company’s unwillingness to adopt this so-called technology will result in a diminishing number of Smith & Wesson semiautomatic pistols available for purchase by California residents.”



Microstamping is notoriously unreliable as a means of tracing weapons used in crimes, adds a huge cost burden to the manufacturer and the consumer, and can be easily thwarted by most criminals with even a rudimentary knowledge of mechanics and the ability to use a common file.

Obviously the law’s author is proclaiming that of course this has nothing to do with the Second Amendment! They’re not trying to deny your right to keep and bear arms… they’re just trying to keep you safe. But as Smith & Wesson’s statement shows, the result is the same. By passing this law, California has effectively found a way to ban the sale of hand guns while still giving the appearance of allowing them. Sure… you can sell your hand guns here. You’re just going to have to re-tool your manufacturing process and drive the cost of the weapons to a prohibitive level.


Score one for the gun grabbers. Be on the lookout for similar legislation to to be brought up in state legislatures in blue states across the country.

Oil, Gold Pull Back on Syria Strike Delay

LONDON—Crude oil and gold pared overnight losses in London Monday but both remained lower for a third successive session as U.S. plans to delay a possible military strike in Syria eased concerns about the oil supply while upbeat manufacturing data from China and the euro zone briefly pushed traders out of gold.


A positive tone prevailed in foreign exchange, with currencies in emerging markets and others perceived as risky bets such as the commodity-linked currencies of Australia and New Zealand gaining ground against the dollar.


Brent crude for October delivery fell 0.3% to $ 113.70 a barrel on ICE Futures Europe. U.S. crude-oil futures were down 0.9% at $ 106.71 a barrel on the New York Mercantile Exchange.


Spot gold was down 0.04% at $ 1,394.70 a troy ounce.

BRUSSELS (Reuters) – The euro zone’s two biggest economies, Germany and France, both grew more than forecast in the second quarter, reinforcing expectations that data later on Wednesday will show the currency bloc has moved out of recession.


The German economy grew by 0.7 percent in the second quarter of 2013, its largest expansion in more than a year, thanks largely to domestic private and public consumption.


France’s economy expanded 0.5 percent, pulling out of a shallow recession to post its strongest quarterly growth since early 2011. The expansion was driven by consumer spending and industrial output, although investment dropped again.


Overall euro zone figures due at 0900 GMT (4:00 a.m. EDT) are likely to show the euro zone economy grew in the three months to June, moving out of recession after seven quarters.


“The euro zone is set for a gradual economic recovery, helped by a sharp slowing in the pace of austerity, an acceleration in global demand growth and a sustained easing of uncertainty and financial stress,” said ABN AMRO’s head of macro research Nick Kounis, adding that a number of drags on growth remain.


A Reuters poll taken before the German and French releases forecast an expansion of 0.2 percent in the second quarter, the same amount the 18-nation bloc’s economy shrank by in Q1.


The overall picture is likely to be mixed, as peripheral countries such as Spain, Greece and Portugal continue to struggle with high double-digit unemployment, on-and-off political rows and painful austerity.


The Reuters poll, published on Tuesday, suggested the euro zone economy is not likely to gain real momentum before 2015, with quarterly growth not seen exceeding 0.4 percent before then despite recent signs of improvement.


Euro zone industrial production rose in April and June, construction output picked up after a weak first quarter hit by bad weather and joblessness fell for the first time in more than two years in June.


“I suspect there was likely a modest overall pick-up in consumer spending, given improved confidence, moderate inflation and slowing job losses,” said Howard Archer, chief European economist at IHS.


“Business investment also likely fell at a reduced rate given improved business confidence and the fact that it has fallen markedly for an extended period.”


The European Central Bank has said it will keep interest rates at record lows for an extended period of time to assist the fragile recovery.


UNEVEN, BUMPY RECOVERY AHEAD


Recent economic data and sentiment surveys had suggested the German economy was picking up after contracting in late 2012 and a weak start to 2013.


But look south and there is a different picture.


The International Monetary Fund said earlier this month that Madrid’s reform progress, fiscal consolidation and crackdown on external imbalances were bearing fruit, but that urgent action was needed to create jobs and stimulate growth.


The scope and form of the austerity drive in the European Union is now changing. Policymakers still say adjustments in excessive deficits and high debt are essential. But they now emphasize that any action taken must not choke growth and must help create jobs.


ECB President Mario Draghi said this month that labor market conditions remained weak, though he expected the bloc’s growth to benefit from a gradual recovery in global demand.


“Overall, euro area economic activity should stabilize and recover at a slow pace. The risks surrounding the economic outlook for the euro area continue to be on the downside,” Draghi said after the ECB rate meeting on August 1.

CAIRO (Reuters) – The United States urged Arab ally Egypt to pull “back from the brink” after security forces killed dozens of supporters of deposed Islamist President Mohamed Mursi and opened a dangerous new phase in the army’s confrontation with his Muslim Brotherhood.


Thousands of Brotherhood supporters were hunkered down in a vigil at a Cairo mosque on Sunday, vowing to stand their ground despite a threat by the authorities to disperse them “soon”.


Saturday’s bloodshed, following huge rival rallies, plunged the Arab world’s most populous country deeper into turmoil following two turbulent years of transition to democracy with the fall of veteran autocrat Hosni Mubarak in 2011.


Egypt’s Health Ministry said 65 people had died. The Brotherhood said another 61 were on life support after what it described as a ferocious dawn assault by men in helmets and black police fatigues. The ambulance service put the death toll at 72.


Bodies wrapped in white sheets were laid on the floor of a Brotherhood morgue, their names scrawled on the shrouds.


Washington, treading a fine line with an important Middle East ally and recipient of over $ 1 billion in military aid, urged the Egyptian security forces to respect the right to peaceful protest.


U.S. Defence Secretary Chuck Hagel spoke by telephone with Egyptian army chief General Abdel Fattah al-Sisi, who led the July 3 military overthrow of Mursi and whose face has appeared on posters across the teeming capital, Cairo.


U.S. Secretary of State John Kerry spoke to two senior members of Egypt’s army-installed interim cabinet, expressing his “deep concern.”


“This is a pivotal moment for Egypt,” he said in a statement. “The United States … calls on all of Egypt’s leaders across the political spectrum to act immediately to help their country take a step back from the brink.”


Saturday’s violence, and the threat of more, has deepened alarm in the West over events in the country of 84 million people, a vital bridge between the Middle East and North Africa.


Over 200 people have died in violence since Sisi deposed Mursi on the back of huge popular protests against his rule, ending a one-year experiment in government by the Muslim Brotherhood after decades spent in the shadows under successive Egyptian strongmen.


PLEDGE TO STAY


In the early hours of Sunday, the state-run Al-Ahram news website reported fresh confrontation in the western Helwan district of Cairo between what it described as marching Brotherhood supporters and angry residents.


The report said several cars were destroyed and gunshots heard, but there was no information on casualties.


Saturday’s killings followed a day of rival mass rallies, triggered by a call from Sisi for a popular mandate to confront “violence and terrorism.”


Denying police culpability, Interior Minister Mohamed Ibrahim said the vigil outside the Rabaa al-Adawia mosque in northern Cairo would “God willing, soon … be dealt with.”


A public prosecutor is reviewing complaints from local residents unhappy with the huge encampment on their doorstep.


Ibrahim said angry residents had clashed with Brotherhood protesters in the early hours of Saturday, and police intervened with teargas.


Brotherhood activists said they would not be cowed and warned of worse bloodshed if the security forces did not back down. Thousands were packed into the area as night fell.


“We will stay here until we die, one by one,” said Ahmed Ali, 24, as he helped treat casualties at a makeshift field hospital on Saturday.


Brotherhood spokesman Gehad El-Haddad said they would remain until their demands are met and Egypt’s first freely elected president is reinstated. He accused Sisi of issuing a “clear, pre-determined order to kill.”


Mursi has been held in army detention at an undisclosed location since he was deposed. Ibrahim said he would likely be transferred shortly to the same Cairo prison where Mubarak is now held, after authorities launched an investigation of him on charges including murder stemming from his 2011 escape from jail during Egypt’s Arab Spring uprising.


The European Union and major European powers condemned Saturday’s bloodshed, the second mass killing since Mursi’s ouster. On July 8, more than 50 Brotherhood supporters died when security forces opened fire on them outside a Cairo barracks.


The events have led U.S. President Barack Obama last week to delay delivery of four F-16 fighter jets, part of some $ 1.5 billion a year in mainly military aid from Washington to Cairo, though U.S. officials have indicated there will be no cut-off in support to the pivotal ally.
