Alabama House passes resolution requesting constitutional convention to ban marriage equality

Closeup of the U.S. Constitution

That the Alabama House passed a resolution calling for a constitutional convention in order to ban same-sex marriage nationwide forever ‘n ever is not all that surprising. More surprising is that apparently most of the representatives involved didn’t know what the hell they were voting for:

According to the resolution, the convention would specifically propose an amendment defining marriage as a union between one man and one woman, and bar legal recognition of any other form of marriage.

Democrats on the Rules Committee wouldn’t have signed off if they’d known what it was, Todd said. The description of the resolution on a summary sheet provided to committee members, she said, only mentioned that the state would call for a convention to make an amendment to the U.S. Constitution. It did not specify what the amendment would address. [...]

The resolution passed on a voice vote of the chamber.

Laboratories of democracy, indeed.

Alabama DA Drops Effort to Send Man Who Raped 14-Year-Old to Prison

Facing an uphill battle in the state supreme court, an Alabama district attorney has dropped his effort to put a man convicted of raping a 14-year-old behind bars. The News Courier reports that Limestone County District Attorney Brian Jones has decided not to challenge the state appeals court ruling that allowed Austin Smith Clem to avoid prison time for his three rape convictions. “After consultation with the victim and her family, we have decided not to pursue a petition for writ of mandamus to the Alabama Supreme Court,” Jones told the News Courier. “Courtney Andrews has shown immense courage and tenacity during this ordeal. My hope is that, through her example, other victims of sexual offenses will find the courage to speak out and to come forward with these crimes.”

Alabama RFID Cards: How Biometrics Helps DHS Fight Terrorism

The Alabama Department of Public Safety (ADPS) are issuing new chipped driver’s licenses and IDs under the STAR ID initiative that promises to “improve the integrity and security of state-issued driver licenses and identification cards, which, in turn, will help fight terrorism and reduce fraud.”

STAR ID is the Alabama legislature’s response to the REAL-ID Act of 2005 (RIDA) which keeps the state in compliance with federal mandates while maintaining ‘security [and] authentication” of Alabama residents.

By December of 2017, Alabama states that all residents must have their STAR ID; having replaced their current ID and driver’s license.

RIDA is tasked with protecting Americans from terrorism by empowering the Department of Homeland Security (DHS) and other federal agencies to monitor and profile residents to ensure their authenticity.

Over four distinct phases, the DHS is enforcing state mandatory deadlines for compliance and a courtesy 3 month “warning” period.

The phases of compliance are:
1. Restricted areas for DHS headquarters
2. All federal facilities and nuclear power plants
3. Semi-restricted areas at federal facilities
4. Entry into commercial aircraft

States that have complied with RFID chipped ID cards for residents include:
• Alabama
• California
• District of Columbia
• Florida
• Hawaii
• Illinois
• Kansas
• Maryland
• Nevada
• New Mexico
• North Carolina
• Oregon
• Rhode Island
• Texas
• Virginia
• Wisconsin
In 2003 the Department of Defense was receiving software for the Joint Protective Enterprise Network (JPEN) under directives from Oracle’s Homeland Security Program Office.

Oracle was paid $ 15 million to supply this system to military bases across the nation. JPEN would facilitate the Federal Bureau of Investigations (FBI), the Central Intelligence Agency (CIA), the Transportation Security Agency (TSA) and the DHS; as well as connecting hospitals, air traffic control centers, nuclear power plant operators and police and fire departments.

Six years later, the DHS renegotiated contracts with Oracle. Under consolidation, DHS took 487,000 licenses, software and maintenance agreements from Microsoft; as well “unlimited” licenses between Oracle and the Immigration and Customs Enforcement (ICE).

The DoDare using biometrics to fight terrorism, catalogue active duty troops and maintain national security interests. The Biometrics Identity Management Agency (BIMA) utilizes biometrics to “identify the enemy” and verify individuals to ensure secure business and governmental functions.

The US Department of State Consular Consolidated Database (CCD) has more than 90 million people’s photographs data based with the continuous use of the Department of Facial Recognition Software.
The DHS Automated Biometric Identification System tracks an estimated 250,000 biometric communications a day. Over 126 million fingerprints, photographs and biographical information are filed for the US government to use at their discretion.

The National ID card by Oracle would establish “a standard and secure national identifier, we could ensure that any system that chose to use it could effectively share information with other systems that use it.”

Larry Ellison, founder of the Oracle Corporation, showed off a prototype of a National ID card at the National Press club in 2001 that included a picture, fingerprint and other digital controls to ensure security. He believed that the US government “could phase in digital ID cards to replace existing Social Security cards and driver’s licenses. These new IDs should be based on a uniform standard such as credit card technology, which is harder to counterfeit than existing government IDs.”

Former KKK Leader And His Mother Indicted After Alabama Cross Burning

A 28-year-old alleged “former Exalted Cyclops” of the Ku Klux Klan and his mother have both been arrested and are facing federal charges relating to a 2009 cross burning in a predominantly African-American neighborhood in Ozark, Ala.

Steven Joshua Dinkle was arrested in Mississippi on Wednesday for allegedly orchestrating the cross burning and obstructing the ensuing investigation, according to a press release sent out Friday by the Department of Justice. Dinkle was described by the DOJ as having previously held the “Exalted Cyclops” title in an Ozark, Ala. chapter of the Ku Klux Klan. Dinkle “conspired with another person to burn a cross in an African-American neighborhood to threaten and intimidate residents of that neighborhood and thereby interfere with their federally protected housing rights” on May 8, 2009, the Justice Department alleges.

“Dinkle allegedly constructed a six-foot cross, wrapping jeans and a towel around it.  He and his co-conspirator drove the cross to an African-American community near Johntown Road in Ozark where Dinkle poured fuel on the cross, erected it in the ground and set it on fire,” the DOJ press release said. “The indictment further contends that Dinkle obstructed justice by lying to local investigators in 2009, and federal investigators in 2012. Dinkle claimed he had withdrawn from the KKK months before the cross burning, provided a false alibi and denied knowing a person who was, in fact, his superior in the KKK.”

Dinkle’s mother, Pamela Morris, who the DOJ described as “the former secretary of the KKK chapter” was arrested on Nov. 21 and charged with committing perjury before the grand jury investigating the cross burning. In an indictment filed in U.S. District Court for the Middle District of Alabama on November 14, federal prosecutors said Morris “knowingly made false material declarations when she denied being involved in the Ku Klux Klan” and when she denied being aware of her son’s KKK involvement. Morris has entered a not guilty plea in the case.

According to the DOJ, Dinkle was charged on five counts in the U.S. District Court for the Middle District of Alabama including; “one count of conspiracy to violate housing rights, one count of criminal interference with the right to fair housing, one count of using fire to commit a federal felony and two counts of obstruction of justice.” As of this writing, documents from Dinkle’s case were not posted on the court’s website and the federal prosecutor’s office was unable to provide them.

On Facebook, a page matching Dinkle’s name and listing his hometown as Skipperville, Ala., includes links to footage of Klan rallies, an informational page about the Church of the National Knights of the Ku Klux Klan from the website of the anti-KKK Southern Poverty Law Center, and multiple links to a speed dating site. A photo posted among the profile pictures on the page in October 2011 shows a tattoo of the KKK blood drop cross logo. In comments posted on the page, its owner used the phrase “white power,” typed racial slurs, and alluded to unspecified legal problems.

“fucking warrents,” he wrote in 2011 (sic).

Alabama Punishes Students for Exiting Football Blowouts Early

After Alabama head coach Nick Saban complained about students leaving home games early, Alabama suspended the block-seating privileges of 20 popular student organizations.

This means for the annual rivalry game between Tennessee played in the Third Saturday in October, any student “can sit anywhere in the student section.”

Alabama lists “early departures and excessive tardiness as ‘unacceptable behavior’ under its block-seating guidelines,” and  ”another violation could result in a suspension for the rest of the season.”

“I’ve talked about players playing for 60 minutes in the game and competing for 60 minutes in the game,” Saban told Al.com last week. “And, in some kind of way, everybody that choses to go to the game should stay there and support the team for the game.”

He added, “Maybe if you’re not interested in doing that, you should let someone else go who would really like to go because I have a lot of people who want to go.”

In Alabama’s four home games this year, Alabama has defeated Colorado State 31-6, Ole Miss 25-0, Georgia State 45-3, and Arkansas 52-0.

Alabama Abortion Ban 2013: Parts Of Alabama’s Abortion Ban Are Blocked in Court

On Friday, U.S. District Judge Myron Thompson temporarily blocked a portion of Alabama’s TRAP (Targeted Regulation of Abortion Providers) bill from taking effect until July 12. Regularly scheduled to take effect on July 1, the provision covered by the judge’s ruling would require that physicians performing abortions in the state have admitting privileges to local hospitals. While it is likely that this provision will be overturned, other provisions of HB 57 have the potential to close clinics and increase the cost of abortion procedures for patients.

The lawsuit, filed on June 11 by Planned Parenthood Southeast and Reproductive Health Services (a privately-owned clinic in Montgomery), claims that the provision of HB 57 that requires physicians who perform abortions to have hospital admitting privileges would create an undue burden on people seeking legal abortion services. Because many abortion providers do not live in the communities (or even the states) in which they work, it can be difficult for them to receive admitting privileges from hospitals in those communities. Furthermore, the stigma of providing abortions would also prevent many local physicians from being granted admitting privileges.

Though many state lawmakers have said that HB 57 is intended to increase the safety of abortion services, there is no evidence to suggest that legal abortions performed in Alabama require additional regulation. Nationwide, only 0.3% of all abortions result in complications that require hospitalization. Alabama’s rates are lower.

“We’re an extremely low-risk facility,” Dalton Johnson, the owner and operator of Huntsville’s Alabama Women’s Center for Reproductive Alternatives, said of his own clinic. “Our safety record shows that. Fifteen thousand procedures in 12 years and only six complications and no fatalities. There are procedures with higher risks they need to look into.”

While Judge Thompson believes that the admitting privileges requirement of the law will likely be overturned, HB 57′s requirement that clinics make the necessary upgrades to meet the state’s regulatory standards for ambulatory surgical centers could still close clinics and, at the very least, decrease or eliminate abortion access for those with little or no income.

“It requires clinics to be like a miniature hospital. It’s going to pretty much probably close us down,” Johnson said. “I’m letting my staff know that it’s a possibility.”

The financial burden to transition into an ambulatory surgical center will disproportionately affect privately owned clinics. Gloria Gray, the operator and part-owner of Tuscaloosa’s West Alabama Women’s Center, said, “It is much more difficult for an independent clinic to meet the requirements of the law or to challenge the law due to limited financial resources.” While nonprofit organizations like Planned Parenthood have “their own attorneys on staff who are able to challenge the law and numerous resources available in donations and federal funds,” privately owned clinics have a much more difficult time fundraising to pay legal fees to challenge the law or become compliant with newly imposed regulations.

Because of the stigma attached to providing abortion services, some privately owned clinics are also having difficulty finding architects and contractors that will agree to work with them on making the mandated upgrades, and, even when people can be hired, privately owned clinics must be able to pay for these services using their own financial resources.

Coming up with the money to meet Alabama’s regulatory standards for ambulatory surgical centers will ultimately come out of the pockets of patients, but it’s not clear as to whether patients will be able to afford the high cost of procedures in these “safer” clinics.

Currently, the average cost of a medical abortion (RU 486, Mifepristone, Mifeprex) is $ 450 in Alabama and is effective for terminating pregnancies up to eight weeks. The cheapest surgical abortions can be performed from about 5-11 weeks into the pregnancy and cost, on average, $ 400. However, surgical abortion patients can expect to add at least $ 100 to the cost of the procedure for every additional week after 11 weeks.

While service fees at the West Alabama Women’s Center will not increase as a result of the mandated upgrades, patients at the Alabama Women’s Center for Reproductive Alternatives will most definitely face fee increases if the clinic can remain open. Rightly, Johnson worries that the patients affected most by HB 57 will be those low-income and no-income patients who come from outside Alabama to obtain abortion services.

“We have people who ride the bus to get here,” Johnson said. “They come from places like Mississippi, where there’s only one clinic, and they take the bus to Huntsville and get a cab from the bus station to the clinic. Then they have to get a hotel room, because they have to wait at least 24 hours to have the procedure done.”

In addition to overturning the requirement that abortion providers have local hospital admitting privileges, the federal court should recognize that the increased cost of abortion services that results from TRAP legislation places an undue financial burden on those who seek to exercise their right to terminate a pregnancy.
