Now He Tells Us: John Paul Stevens Wants to Abolish the Death Penalty

In his latest book, Six Amendments: How and Why We Should Change the Constitution, retired United States Supreme Court Justice John Stevens reminds us why some of the most frustrating judges are the ones who have left their courts behind. What would American law look like today, how different might it be, if this moderate justice had been willing to vote on the Court all those decades for what he now believes to be just?


For example, a man who consistently upheld capital convictions and the death penalty itself for over 35 years, who helped send hundreds of men and women to their deaths by failing to hold state officials accountable for constitutional violations during capital trials, who more recently endorsed dubious lethal injection standards because he did not want to buck up against court precedent, now wants the Eighth Amendment to read this way, with five new words added:


Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments such as the death penalty inflicted.



It’s never too late for redemption, I suppose (unless you are one of those innocent men executed in America since capital punishment returned in its modern form in 1976). And Justice Stevens deserves credit, at least, for sharing his change of heart with the rest of the world in a manner likely to garner much attention. In his new book, a wish-list of what he’d like to change about the Constitution, an apology of sorts for all that he got wrong, he writes:


For me, the question that cannot be avoided is whether the execution of only an “insignificant minimum” of innocent citizens is tolerable in a civilized society. Given the availability of life imprisonment without the ability of parole as an alternative method of preventing the defendant from committing further crimes and deterring others from doing so, and the rules that prevent imposing an “eye for an eye” form of retributive punishment, I find the answer to that question pellucidly clear. When it comes to state-mandated killings of innocent civilians, there can be no “insignificant minimum.”



These are powerful words—and perhaps they will further stoke the roiling debate today over the death penalty. But they are essentially the same words uttered famously, for essentially the same reasons, by another moderate Republican appointee, Justice Harry Blackmun. It’s been 20 years now since he turned away from the death penalty in Callins v. Collins in one of the most famous dissents in Court history. In February 1994, Justice Blackmun wrote:


Rather than continue to coddle the Court’s delusion that the desired level of fairness has been achieved and the need for regulation eviscerated, I feel morally and intellectually obligated simply to concede that the death penalty experiment has failed. It is virtually self evident to me now that no combination of procedural rules or substantive regulations ever can save the death penalty from its inherent constitutional deficiencies. The basic question–does the system accurately and consistently determine which defendants “deserve” to die?—cannot be answered in the affirmative.



Twenty years later, with what we now know about wrongful convictions, racial disparities in capital cases, and lethal injection secrecy, those words ring ever more true. Now compare Justice Blackmun’s cri de coeur with the words of Justice Stevens, in the aforementioned lethal injection case, Baze v. Rees, decided in 2008. In a concurrence in that case, after a lengthy critique of capital punishment rules and Kentucky’s lethal injection plans, Justice Stevens wrote:


I have relied on my own experience in reaching the conclusion that the imposition of the death penalty represents “the pointless and needless extinction of life with only marginal contributions to any discernible social or public purposes. A penalty with such negligible returns to the State [is] patently excessive and cruel and unusual punishment violative of the Eighth Amendment.Furman, 408 U. S., at 312 (White, J., concurring).



It took Justice Stevens over 30 years—from his ascension to the Supreme Court in 1975 to 2008—to reach this point. And it has taken him another six years, from 2008 to 2014, to fully become the advocate for reform that he never was on the Court. If I were Senator Patrick Leahy, the Vermont Democrat who chairs the Senate Judiciary Committee, I would invite Justice Stevens today to testify on Capitol Hill about the death penalty—to bear witness, expert witness, to its arbitrary nature.


I have written before about how continuing exposure to capital cases turns Supreme Court justices from supporters to opponents of the death penalty. About how no one on the Court who sifts through the litany of unfair capital trials bubbling up from state courts ever becomes a more ardent supporter of the death penalty. Justice Stevens is just the latest example of this frustrating phenomenon. These jurists see the light—almost always too late to do any good.


Except it is not yet too late for Justice Stevens. In Six Amendments, he directly criticizes Justice Antonin Scalia’s tendentious capital jurisprudence, and he should continue to do so as he now embarks upon his book tour. Freed from his obedience to Court precedent, and his self-imposed constraints as a judge, Justice Stevens should shout as loudly as his modest demeanor permits about the injustices he sees in the administration of the death penalty.


It would be a good thing, maybe even a great thing, for a retired justice to speak so candidly in public about some of the most controversial issues the Court ever faces—who lives, who dies, and who decides. Who knows? Perhaps the justice’s conscience, expressed so passionately now, will draw out from the shadows the views of those current justices who themselves have grave doubts about the constitutionality of capital punishment in America today. Better they say so while they still have a vote on the Court than to wait too long until they don’t.

Egyptian court sentences 529 Muslim Brotherhood members to death





An Egyptian court sentenced 529 members of the outlawed Muslim Brotherhood to death for murder and other offences on Monday, in a sharp escalation of a crackdown on the movement that is likely to fuel instability.


Family members stood outside the courthouse screaming after the verdict — the biggest mass death sentence handed out in Egypt‘s modern history, defense lawyers said.


Turmoil has deepened since the army overthrew Egypt’s first freely elected president, Mohamed Morsi of the Muslim Brotherhood, in July. Security forces have killed hundreds of Brotherhood members in the streets and arrested thousands.


Human rights groups said Monday’s verdict suggested the authorities intended to tighten their squeeze on the opposition.


State television reported the sentences without comment. A government spokesman and other government officials did not immediately respond to calls.


Most of the defendants at Monday’s hearing were detained and charged with carrying out attacks during clashes which erupted in the southern province of Minya after the forced dispersal of two Muslim Brotherhood protest camps in Cairo on August 14.


Islamist militants have also stepped up assaults on the police and army since Morsi’s ouster, killing hundreds and carrying out high profile operations against senior interior ministry officials.


“The court has decided to sentence to death 529 defendants, and 16 were acquitted,” defense lawyer Ahmed al-Sharif told Reuters. The condemned men can appeal against the ruling.


The Muslim Brotherhood, largely driven underground, responded by calling for the “downfall of military rule” on its official website.


Mohamed Mahsoub, who served as minister of legal affairs under Morsi, described the court’s decision “a ruling calling for the execution of justice” on his Facebook page.


Supporters set fire to a nearby school in protest, state television reported, though security officials said they had received no reports of unrest.


‘The quickest case’


The charges against the group, on trial in Minya since Saturday, include violence, inciting murder, storming a police station, attacking persons and damaging public and private property.


“This is the quickest case and the number sentenced to death is the largest in the history of the judiciary,” said lawyer Nabil Abdel Salam, who defends some Brotherhood leaders including Morsi.


“A second year student in the faculty of law would never issue this verdict. There are a lot of flaws in this verdict. I think maybe an appeal could be successful but nothing is predictable,” said Mohamed Zaree, program manager, Cairo Institute for Human Rights Studies.


HA Hellyer, an Egypt expert and fellow at American think-tank the Brookings Institution, said he doubted the sentences would be carried out.


“Nevertheless, the very issuing of the sentence itself is quite significant,” he added.


On Tuesday, the Muslim Brotherhood’s Supreme Guide, Mohamed Badie, and 682 others will face trial on charges of incitement to kill.


Attacks


Only 123 of the defendants were in court. The rest were either released, out on bail or on the run.


“When the trial starts on Saturday and it is just a procedural hearing, and the judge doesn’t listen to any lawyers or witnesses and doesn’t even call the defendants, you are before a group of thugs and not the judiciary,” Walid, a relative of one of the defendants, said by phone.


It was not possible to confirm his account of the proceedings independently.


The government has declared the Brotherhood a “terrorist” group. The organization says it is committed to peaceful activism.


Analysts say some of its members could turn violent if the state keeps up pressure on the movement, which won the vast majority of elections since a popular uprising toppled autocrat Hosni Mubarak in 2011.

Death toll climbs from Harlem explosion


Four more bodies were found overnight in the smoldering rubble of two upper Manhattan buildings leveled by a gas explosion that injured more than 70 people and spewed debris for blocks, bringing the death toll to seven.


Rescue crews brought in a backhoe and bulldozer and were digging through the debris Thursday for more buried victims as firefighters battled flareups in the wreckage of the two five-story buildings that collapsed Wednesday morning on 116th and Park Avenue.


The force of the blast was so strong that it registered on the Richter scale at just under .5, according to Columbia University. Smoke billowed into Central Park and could be seen miles away in midtown, and New Yorkers said they felt rumbles as far away as 150th Street. Closer to the collapse, groceries were knocked from store shelves and an ashy film covered streets, sidewalks and cars.


The only indication of anything wrong before the explosion was a call to Con Edison from a woman in a nearby building, reporting a strong odor of gas just minutes before the blast, the mayor and the utility said. But it was too late.


“This is a tragedy of the worst kind because there was no indication in time to save people,” Mayor de Blasio said.

Three of the seven victims killed in the explosion have been identified as Griselde Camacho, 44, Carmen Tanco, 67, and Rosaura Hernandez-Barrios, 22. Three others, two men and one woman, have not been identified. It’s not clear if the seventh victim, recovered Thursday morning, is a man or a woman.


Hospitals reported receiving 74 people injured, including one teen and one woman who were both critically hurt. The 15-year-old boy’s skin was badly burned, and he had broken bones and internal injuries, doctors said. The woman, who was pulled from the debris, is being treated for critical neck and back injuries.


Most of the people who were injured are expected to survive. At Harlem Hospital, where more than a dozen people were treated, one man who suffered from smoke inhalation described passing out as he ran from falling debris.


“I just kept on going, just trying to get away,” he said.


Another man was driving a cab near the Metro-North tracks when he felt the blast.


“He thought the train was falling on top of him, but that wasn’t true,” his son said. “His car got shattered but he’s OK. He’s shaken up.”


Two on-duty FBI agents who were driving through the area at the time of the explosion were among those hurt, but their injuries were not life-threatening, the FBI said.


A woman who was at her home on 115th Street between Park and Lexington avenues said she heard the explosion and thought it was a bomb. The explosion was near where Metro-North tracks run through Harlem.


“I thought a train had exploded,” said Marisa Aquino.


Another woman who said she was watching TV in her home about a block away said the explosion blew out her windows.


“All my windows shattered and I didn’t know what it was,” she said on NBC 4 New York. She said first responders soon arrived at her building and ordered everyone out.


“It sounded like a bomb. That’s what it really sounded like,” Trey Dey, a laborer who was working in a nearby basement when the buildings exploded, told NBC 4 New York.


A sinkhole developed from a water main break likely caused by the explosion, complicating efforts Wednesday night. The FDNY said crews had to repair the sinkhole before heavy equipment could be brought to the scene for cleanup and search efforts.


Officials cautioned the firefighting and cleanup process would take time.


The Buildings Department said one of the collapsed buildings had six units and the other had nine. One of the buildings had work done in June for 120 feet of gas piping, records show. It has no violations on record.


The other building just to the north had one violation from 2008 related to vertical cracks in the rear of the building. The city said a fine was paid but it was not clear that the condition had been corrected.


Con Edison described the building’s gas main as an 8-inch iron and plastic main. In 2011, 70 feet of it was replaced during an excavation project.


The explosion blew debris onto the elevated tracks of the Metro-North tracks above Park Avenue, causing a shutdown of service in both directions. Service was restored late Wednesday afternoon after tracks were cleared of debris and inspected for structural integrity, the MTA said.


The Department of Environmental Protection is monitoring air quality in the area. The city’s health department says smoke from the fire has largely dissipated and that respiratory irritation from any smoke is usually short-term in healthy people.


The NTSB said it was joining the investigation. The agency probes pipeline explosions as well as transportation disasters.


The NTSB says it will examine Con Edison’s handling of customer complaints, the oversight of Con Edison by federal and state officials, and any evidence of possible third-party damage from digging, among other things.

California’s severe drought could become new Dust Bowl; ‘Agonizing death’ for farmers

(NaturalNews) The worst drought in at least a century threatens to reduce California’s agricultural industry to ruin, possibly creating a new Dust Bowl.


According to the White House’s top science and technology adviser, the western United States is suffering from the worst dry spell in 500 years. The drought’s effect on California in particular has national implications: California is the top farming state in the United States, producing one-third of the country’s fruits and vegetables.


California is suffering from its worst drought in at least 100 years, which Governor Jerry Brown has called an “unprecedented” emergency. Statewide, agriculture is a $ 44.7 billion business. In the Central Valley, California’s agricultural heartland, almost 40 percent of all jobs are agriculture-related.


“It’s really a crisis situation,” said Kenneth McDonald, city manager of Firebaugh, a Central Valley city. “And it’s going to get worse in time if this drought doesn’t alleviate.”


If the state’s agricultural industry fails, cities like Firebaugh may end up as ghost towns, McDonald warned.


“It’s going to be a slow, painful process — but it could happen,” McDonald said. “It’s not going to be one big tsunami where you’re gonna having something get wiped out in one big wave. It’s gonna be a slow, painful, agonizing death.”


Federal agricultural officials have designated disaster areas in 11 separate states, Arkansas, California, Colorado, Hawaii, Idaho, Kansas, New Mexico, Nevada, Oklahoma, Texas and Utah, particularly noting the economic strain that the drought has placed on agricultural workers. In an attempt to mitigate this strain, President Obama has announced a $ 15 million assistance plan for farmers and ranchers in California and the Southwest to implement water conservation.

Haarp being used to finalize death of the San Joaquin

After draining the dams on purpose was done by the “elite” to destroy the San Joaquin valley on purpose, Haarp is being used to finish the job with a real drought. San Joaquin destroyed on purpose? Read on, I have proof that this has been in the works for six years, long before Fukushima.

There has been an effort by the elite to destroy the San Joaquin valley agricultural zone ongoing for about six years now. An article posted by Rense and others about the Haarp caused high pressure region which is blocking rain from falling in California strongly implies that this action is benign and only protecting us from Fukushima.


BULLSHIT


FACT:


There has been no drought in California for the last six years YET many of the orchards and prime agricultural zones have been intentionally killed via denial of water by the choice of the elite. This was caused by draining all the dams and flushing all the water out to the ocean ON PURPOSE.


Here is what is really going on -


The elite obviously want the San Joaquin gone from America’s list of assets. The San Joaquin is a natural desert, which was only brought to life via irrigation projects and reservoirs. No “drought” can change this fact. Several people who are among the “elite”, most notably Warren Buffet bought all the reservoirs, in violation of law (at least the original law the reservoirs were agreed to be built under) and drained them into the ocean rather than give the water to the farmers (which also violated the water contracts the farmers signed onto) in the name of an imported and not native fish called the Delta Smelt. These fish were brought into California around 100 years ago and are not natural to the area at all.


There has ALWAYS been plenty of water in California. The irrigation projects were vastly overbuilt and were more than enough to handle an extended drought, (which there in fact has not been despite claims) up until now. But once the elite got control of the dams, they simply opened the floodgates and sent all the collected water straight to the ocean down the San Joaquin river, causing a large amount of flooding and draining the water supply that California orchards and agriculture needs to survive. And they did it in the name of a fish that did not belong there anyway, an obvious act of war. Since the farmers subsequently did not get their water, a lie of drought was hatched in the ziopress, a lie laid waste by the rainfall chart that even Rense posted.


This was an act of war against the American people, launched by kike elitists to destroy America’s most prime agricultural zone. Make no mistake, the Jews absolutely HATE America, and will be America’s “friend” only to whatever extent it takes to deceive an ignorant populace long enough to have that populace stand idly by as America’s greatest assets are WIPED OUT.


They hate America in reality, because Christian America stood up against tyranny and even wiped out the Jewish slave trade in America. The blacks were not enslaved by white Christians, they were in fact enslaved by Jewish slave lords. And to this day, the heart of the global slave trade is run by Jews, in Israel. Obviously shutting down the slave trade snubbed their noses, but it was America’s freedom, prosperity and technological achievenments they despised the most. Russia was their first victim in modern times (probably because Tesla came from there), and they failed Russia the same way they are now failing America.


But let’s get back to the real issue – the San Joaquin water shortage which is completely intentional.


This agricultural zone was far too much of an asset for America’s conquerors to tolerate having around, so they just took control via government corruption afforded by rigged elections and shut off the water. Now there are hundreds of miles of dead orchards there, stretching as far as the eye can see. And the State mandates that the growers cut these dead orchards down, so six years into this war there are equally vast expanses of dead earth that were only a short time ago fertile orchards.


So when you hear MANY in the so called “truth movement” haarp all about how the San Joaquin died because of Fukushima, KNOW THE LIE. MANY IN THE “TRUTH MOVEMENT” HAVE EVOLVED INTO BEING THE ENEMY OF TRUTH. Let’s PROVE IT RIGHT NOW, with a few pictures of the San Joaquin from MORE THAN A YEAR AGO, LONG before this so-called “drought” which happens to be Haarp caused and actually is real. REAL BUT IRRELEVEANT, THE SAN JOAQUIN IS ALREADY DEAD.





Here is the California precipitation chart everyone is now quoting. Look at the history here, there have been plenty of other periods that were a little bit dry. And of course there were only five inches so far this year – WE ARE ONLY A MONTH AND A HALF INTO IT. So the chart for this year is a FREAKING LIE ANYWAY. LOOK AT THE CHART BELOW, AND THEN TRY TO EXPLAIN THE FOLLOWING PHOTOS OF EMPTY DAMS. WHY ARE THEY EMPTY ALREADY, WHEN UP TO DEC OF 2013 THE RAIN WAS WITHIN A NORMAL RANGE?



From the chart above, it is OBVIOUS there has been no drought. Even in 2010 and 2011 the ziopress talked all about how little rain California got, and the chart proves that those were both very wet years. The subsequent years were NOT BAD ENOUGH TO MAKE THE DAMS LOOK LIKE THIS:




The chart from Forbes PROVES: These orchards are NOT dead because of drought and the dams are NOT empty because of drought, they are empty because a few priviledged zionists chose to drain them so they can get America by the throat in a future catastrophe THEY ENGINEERED. The enemy would surely love to blame it on Fuku, DO NOT let a lack of knowledge draw you into that trap.


The photo to the left, which Rense posted clearly shows that Haarp is indeed being used to stop the rain from reaching California. But this is being done to create a real drought only AFTER the San Joaquin has been severely damaged from lack of water. 2011 gave the orchards another year, up until 2010 the farmers were able to pump wells to water the valley. But the wells went mostly dry by the end of 2010, and 2011 was a godsend because they had no other water, and were denied it from the reservoirs, water which they got from a very wet year that should have filled the reservoirs. I know, I WAS THERE DURING IT. It rained all the time and this saved the orchards. But after 2011, the orchards took a severe beating from being denied water during a normal precipitation year following a very wet year that should have filled the reservoirs, and this haarp blockage will no doubt be the final death sentence for the San Joaquin, because even if there is an agreement to save the orchards, the kikes already emptied the dams. There is no where to go now.

Death, Illness And The Theological Reasoning Behind “Creation Science”

Here is what it is in a nutshell: Fear of death. Which is actually a biggie. I mean you can scoff at it when you are in your 20′s and in perfect health, but if you or a loved one has terminal cancer, for example, it tends to occupy your thoughts.


When faced with death, people really want to know if there is anything on the other side, and if there is then it’s hopefully something pleasant; even heavenly.


The way Christians traditionally worked this out is that death is un-natural. God is love, yet for some reason, perfectly nice relatives and friends are periodically taken from us sometimes, after experiencing protracted periods of horrible pain. The reason for this, theologically, is that death is a judgement; a punishment for sin. God, in his righteousness, had to punish sin but he felt bad about it. He felt so bad about it that he decided to punish himself instead on our behalf, so that we wouldn’t have to suffer and die. So if you accept this sacrifice,you will still die, but at some later point,you will be brought back to life and there will be no more tears.


I’m not really trying to be crass, because suffering and death is no joke to me. I think any means people have to get through it and be at peace is a huge blessing.


2000 years of tradition goes a long way in helping people through this process. Hospitals, military bases, any place where there is a lot of dying going on are filled With chaplains and various clergy working to bring peace to people in their suffering. I have experienced this first-hand, and the comfort this tradition brings to people is a real and tangible thing. I don’t pooh pooh it at all, because in the dying process, being at peace is much preferred to writhing in physical (as well as existential) pain.


Now, you maybe wondering, what if anything, does the need for a belief in dinosaurs frolicking alongside humans possibly have to do with this?


I really feel like the vast majority of Christians aren’t Theologically concerned about dinosaurs, or wouldn’t be if not for certain literal minded people like Ken Ham, founder of “Answers In Genesis” and the Creation Museum


Taken extremely literally, the whole “substitutionary atonement” salvation scheme does have a monkey wrench thrown into it by evolutionary biology, as it is currently understood. The reason is because in the course of evolution, and the huge stretches of time involved, there have been millions and millions of generations of living things. In other words, millions and millions of deaths. Things have been living and dying from the beginning, and there was death long before there were human beings by millions of years. In light of this it makes no logical sense that physical death could be a judgement for human sin, and that opens up once again the whole question of why do people die, why does it suck so bad, and what if anything is on the other side?


In light of evolutionary biology, many of these tried and true theological answers fail – at least in an extremely literal sense. I will hasten to add, however, that there are different schools of thought in soteriology (the study of salvation) besides the substitutionary atonement such as “Christus Victor” but delving into that is beyond the scope of this essay.


Let’s just say that for the most part evolutionary biology, and modern geology put fundamentalists on very shaky ground, theologically speaking. The Creation Science museum is essentially ahuge exercise in rationalization and wishful thinking. Its all borne from insecurity on a monumental scale. Ham and his associates have chosen to prove (to themselves) that the Garden of Eden was an historical place where literally, all the living species that ever existed, once lived, but with no predation or physical death, or suffering of any kind.


What is at stake for them is that if they can’t prove this story as being literally true, they have no answers for why people die and no assurance that anything pleasant awaits them on the other side. They are instead faced with their own annihilation and the annihilation of their loved ones.


Yet for many people Christianity (and Science) still seems to work for them.


I recently lost my dad. He was an intelligent person who admired science and scientists, yet as he lay in hospice he was very much comforted by visits from Catholic priests and nuns,  and by praying and receiving communion. In fact, he would invite any chaplain or clergy into his room who offered to pray, whether they were Catholic, Protestant, Fundamentalist Christian or completely non-denominational.


I think that in the end he chose to go with the Catholics cuts to the heart of the difference between Roman Catholics and Protestants, especially fundamentalists. Fundamentalists are, in fact, Protestants, among Protestants. The Reformation itself was is in some ways a working out of a type of extreme literal-mindedness, or over-rationality. It’s the idea that as human beings, nothing is beyond our grasp of (rational) understanding. I believe that this is what led to the type of materialism Fundamentalists now pit themselves against.


You don’t see Roman Catholics debating evolutionists because – at least officially – the Roman Catholic Church has no beef with evolution. Creation Science is not taught in Catholic schools. To Roman Catholics these big questions are shrouded in mystery. Its more mystical. Some things are beyond us, yet there is reassurance that God loves and takes care of us.


Moving beyond contemporary and historical scandals and political squabbles, many of them rightly seen as horrible, the Roman Catholic Church is a very big Church. It is very broad based and diverse in its traditions. Within this diversity there are tie-ins to other mystical, even non-dual traditions, such as Buddhism.


The non-dual answer for death is that part of us is consciousness itself, and it is this best part of us, the only real part of us, lives on.


As my Dad lay in his hospital bed, barely able to speak, but still very aware, he was visited again by a particular Franciscan nun, with whom he had developed a strong connection. She told him that he did not need words to pray, and that he only needed to breath in and out: That each breath was a giving of thanks to God.


“Its so simple,” my father said.


In his last few days as he breathed in and out, there was a tangible peace in the room and all that he had left was his Love. I really feel that in that sense he lives on.
