Pill mixup led to Kennedy "drugged driving" trial: defense

WHITE PLAINS, New York (Reuters) – A Kennedy family member’s groggy behavior during her 2012 arrest for sideswiping a tractor trailer in New York was not the result of a criminal act but mistakenly taking a sleeping pill instead of her usual thyroid medication, her lawyers argued at her trial Monday.

Kerry Kennedy, 54, daughter of assassinated Senator Robert F. Kennedy and the ex-wife of New York Governor Andrew Cuomo, has pleaded not guilty to a charge of driving while impaired.

“This case is about a mistake, plain and simple,” defense attorney Gerald Lefcourt said in his opening statement in Westchester County Court in White Plains, about 35 miles north of New York City.

Lefcourt said it was a regrettable medication mixup that led to Kennedy’s arrest for erratically driving her silver Lexus on Interstate 684 near North Castle in Westchester County the morning of July 13, 2012.

Kennedy, who wore a grey dress and jacket and black-rimmed glasses in court, is expected to be on trial for about a week.

Her mother, Ethel Kennedy, widow of Senator Kennedy, was also in the courtroom as Lefcourt described Kennedy as a devout Catholic and a devoted humanitarian and mother who would never willfully drive while impaired.

“If she would have realized her mistake and known she was not in the right condition to drive her car that day, she would never have continued on the road,” he told the jury.

Kennedy, who is also the niece of assassinated President John F. Kennedy, “is not seeking any advantage here because of her famous family,” Lefcourt said. “On the other hand, she should not be punished because of it.”

A jury trial is unusual for a relatively minor unclassified misdemeanor. If convicted, Kennedy could face up to a year in prison, but with no prior criminal record, it is unlikely she would serve any time behind bars, court officials said.

A toxicology report taken after Kennedy’s arrest showed she had the drug zolpidem, which is sold under the brand name Ambien, in her system. The drug is a slow acting medication to induce sleep and overcome insomnia.

Prosecutors said Kennedy continued to drive her car after realizing she was impaired, endangering herself and other drivers, before running off the road and passing out behind the wheel.

Nobody was injured during the incident.

“It was an ominous and regrettable day for this defendant Kerry Kennedy,” said Assistant District Attorney Stefanie DeNise during opening statements. “Still she continued to operate her car in an unsafe manner.”

Kennedy drove about five miles while swerving into other lanes of traffic, the grassy median and eventually a tractor trailer, prosecutors told the jury.

The man who appeared before Congress last week to explain the security pitfalls of HealthCare.gov took to Fox News on Sunday to explain just how easy it was to penetrate the website.

Hacking expert David Kennedy told Fox’s Chris Wallace that gaining access to 70,000 personal records of Obamacare enrollees via HealthCare.gov took about 4 minutes and required nothing more than a standard browser, the Daily Caller reported.

“And 70,000 was just one of the numbers that I was able to go up to and I stopped after that,” he said. “You know, I’m sure it’s hundreds of thousands, if not more, and it was done within about a 4 minute timeframe. So, it’s just wide open.”

“You can literally just open up your browser, go to this, and extract all this information without actually having to hack the website itself,” he said.

Washington (CNN) — Texas Republican Congressman Roger Williams was especially stunned as he sat in school on November 22, 1963, and heard President John F. Kennedy was assassinated in Dallas. Earlier that morning, he stood outside the Fort Worth Hotel with his mother and shook the President’s hand right before he got on a plane and flew to Dallas.

“I literally was the last person to shake his hand as he left the hotel,” Williams told CNN. He was 14 years old at the time.

Now a 64-year-old freshman member of the House of Representatives, Williams sat in his Capitol Hill office on Wednesday and recounted in vivid detail the day he said he would never forget, and a moment that would later spark his own interest in public service.

“It was pouring rain, it was cold on November 22nd,” Williams said, describing the morning he headed to a breakfast for the President and the first lady at the Fort Worth Hotel. Williams and his mother sat inside the ballroom with 1,000 others. He told CNN he recalls seeing Mrs. Kennedy’s “bright pink suit” and listening to the President talk about the economy, the need for a strong military, and his idea for a man to reach the moon.

His father, Jack Williams, an owner of car dealerships, was asked by his friend Jim Wright, the Democratic congressman from the area, to supply several cars for the President’s motorcade for his visit to Fort Worth. In return for his help, Williams’ father asked Wright if his wife and son could meet the President.

After the speech, he and his mother were approached by someone and ushered to the front of the hotel where Jacqueline Kennedy emerged .

“She came around the corner in that pink dress and she shook my mother’s hand and shook my hand and stood right next to me.” Williams said.

But then the “moment:” Williams says the President appeared, took a puff of his cigar, discarded it, and then grasped his mother’s hand and turned to him.

“He came to me and shook my hand and did not let it go, and looked back at my mother and said ‘It was a pleasure to meet your son.’ ” Kennedy then left for Dallas.

Williams remembers wanting to know what kind of shoes the President of the United States would wear, and inspected them that morning, describing them as “black cat toe shoes.”

After he met Kennedy, his mother took him to school. Later as he sat in Latin class, the principal handed his teacher a note, and Williams watched as his teacher’s head fell to his desk and he wept.

“I couldn’t fathom it frankly because I had just seen him an hour and half ago,” Williams said.

The Texas Republican said after Kennedy was killed “the world changed.” His generation was never the same and the country shifted from a “happy society” to one that experienced a series of events like the shootings at Kent State and the assassination of Robert Kennedy.

An emotional Williams told CNN, “John Kennedy — he touched my heart and soul.”

Though he’s now an ideological opposite of the Democratic president he praised and admired, Williams said meeting Kennedy was part of his journey to run for office.

“It eventually empowered me to do something for my country, like he did,” recalling Kennedy’s famous line from his inauguration speech, “Ask not what your country can do for you, but what you can do for your country.”

Williams played baseball for the Atlanta Braves after college. But after an injury, he followed his father into the car business, running a string of dealerships in Texas. He became involved in politics when George W. Bush served as governor of Texas. He later served as Texas secretary of state under Gov. Rick Perry.

He admits his conservative leanings differ from JFK’s, but Williams believes he has a lot in common politically with things Kennedy pushed in office, citing tax cuts, a strong military, and a message that the U.S. is the dominant world power.

Kennedy’s great nephew, Massachusetts Democratic Rep. Joe Kennedy III, was elected in the same class as Williams. The Congressman told CNN he’s talked to Kennedy about other experiences but never what it was like to meet his great uncle that day 50 years ago.

After telling his story of November 22, 1963, he said, “I think I’m going to reach out to him and just kind of let him know my story.”

Kennedy Cousin Granted Bail

(Newser) – The Kennedy cousin convicted of murdering his neighbor in 1975 will soon be free on bail. Michael Skakel was granted bail of $ 1.2 million today, and he was expected to be freed shortly, the AP reports. He’ll have to stay in Connecticut and wear a GPS tracker, the judge ruled. Skakel, nephew to Ethel Kennedy, was granted a new trial last month after a judge ruled his lawyer in the original trial did not represent him adequately. “Everybody in my family knows that Michael is innocent,” said Robert Kennedy Jr. this week. “The only crime that he committed was having a bad lawyer.”

Specifically, the judge said Skakel’s attorney did not locate a witness who confirmed Skakel’s alibi for the night of the murder, and also failed to locate a man who challenged the claim of a star witness that Skakel had confessed to the crime. The judge also said the defense team should have focused more on Skakel’s older brother, Thomas, an early suspect and the last person to have been seen with victim Martha Moxley. Moxley’s family was in attendance for the bail hearing; her mother said this week she is convinced Skakel killed her daughter and “he ought to serve his punishment.”

Obama, Clintons join forces for Kennedy event 50 years after JFK death

WASHINGTON (Reuters) – President Barack Obama joined forces with Bill and Hillary Clinton on Wednesday to recognize the legacy of John F. Kennedy, the president who inspired a generation until he was felled by an assassin’s bullets 50 years ago this week.

Obama awarded the highest U.S. civilian honor, the Presidential Medal of Freedom, to former President Clinton and 15 other Americans who have made significant contributions to U.S. culture, politics, sports and science.

The event was intended as a testament to the memory of Kennedy, who signed an executive order shortly before his death creating the Presidential Medal of Freedom. Kennedy also established the Peace Corps and set the country on a path to landing humans on the moon.

After the event in a packed White House East Room, Obama, Clinton and his wife, former Secretary of State Hillary Clinton, were to pay homage to Kennedy in a visit to his Arlington National Cemetery grave.

The day was steeped in powerful political imagery as Obama and the Clintons appeared together against a backdrop of speculation that Hillary Clinton may be laying the groundwork for a run for the Democratic presidential nomination in 2016.

Kennedy was shot to death by assassin Lee Harvey Oswald on November 22, 1963, as he and his wife, Jacqueline, rode in a motorcade in Dallas. America has been awash in televised remembrances of the death of the handsome, vigorous 46-year-old president and subsequent killing of Oswald by nightclub owner Jack Ruby.

White House officials decided to mark the occasion with the Medal of Freedom ceremony to remember Kennedy’s life rather than the macabre circumstances of his death.

Those who stood to have the Medal of Freedom medal draped around their necks by Obama included a wide range of American success stories, from TV talk show host Oprah Winfrey, to former Chicago Cubs baseball star Ernie Banks, to the late astronaut Sally K. Ride to former Washington Post editor Ben Bradlee.

The event allowed Obama and Clinton to warm a relationship that has seen its share of strains.

Just last week Bill Clinton jumped into the political fight over Obama’s healthcare law by telling a TV interviewer that Obama should “honor the commitment” he made that if people like their insurance plan, they can keep it.

Millions are seeing their insurance plans canceled despite Obama’s pledge, and the resulting loss of trust in his leadership has contributed to a downward spiral in his job approval ratings, down to 37 percent in a new CBS News poll.

A new book, “Double Down,” by journalists Mark Halperin and John Heilemann, said Obama in the past has found Clinton to be exhausting, and quoted him as telling an aide, “I like him … in doses.”

Perhaps mindful of that anecdote, Obama went out of his way to honor Clinton, who was president from 1993-2001 and heads the Clinton Global Initiative, a global charity organization. Clinton’s lifelong interest in public service dates back in part to a 1963 visit to the White House where he shook Kennedy’s hand four months before the assassination.

Obama said he was grateful for the patience Clinton had shown during the endless travels of Hillary Clinton as the top U.S. diplomat.

“I’m grateful, Bill, as well for the advice and counsel you have offered me on and off the golf course, and most importantly for your life-saving work around the world, which represents what’s very best in America,” Obama said.

This photograph appears on page 22. The caption reads,”From the same building where Oswald lay in ambush, a telescopic lens reconstructs an approximation of what the killer saw at the moment of tragedy”. The photograph does appear to support the idea that a single shot could have hit both Kennedy and Texas Governor John Connally. However, the photograph, despite the caption, was not taken from the schoolbook depository. The distinctive brickwork of the schoolbook depository (see photo from pages 24-25) is clearly seen on the right hand side of the photograph, proving that the photograph was actually staged from the Daltex building. The traffic signs clearly in view indicate a much lower angle than would be seen from 6 floors up.

Compare the above view of the street with that seen in the next photo taken from just INSIDE the 6th floor window of the Texas Schoolbook Depository from which Oswald was supposed to have fired.

Quite an obvious difference!

This photograph appears on pages 24 and 25. Taken by AP Photographer James Altgens, it clearly captures the moment when John Kennedy clutches his throat. Note the following.

John Connally is clearly turned to his right. Had he indeed been hit by the same bullet which has just exited Kennedy’s throat, his wounds would have traversed his body from right to left. Connally’s wounds were from back to front. NOTE: The claim has been made that Connally was facing forward when JFK was shot in the neck, before the photo was taken, but in order to then see the view in this photo, Connally would have had to twist to his right after being shot!

Note the turned heads of some of the policemen and Secret Service agents. Clearly, they have heard and are responding to the sound of gunshots.

Note the fourth car back, which contains Vice President Johnson’s Secret Service detail. The car doors are open as the agents rush to protect Johnson from the threat. Compare this with Kennedy’s Secret Service detail, who have not moved at all. Also note the man within Kennedy’s Secret Service car who is grinning ear to ear (tentatively identified as Dave Powers). It is interesting to note that in the book “Mortal Error” this photograph is deliberately cropped to hide the open doors of the car carrying V.P. Johnson’s Secret Service detail.

Most importantly, note the man standing in the ground level doorway of the Texas Schoolbook Depository (which is where he reportedly told the Dallas PD he was at the time).

Compare these two images. The man in the doorway of the school book depository (top) , and Oswald’s photo immediately after his arrest (bottom).

This is a photograph of Lee Harvey Oswald taken shortly after his arrest. Note the clear similarity in both appearance and dress to the man in the schoolbook depository doorway in the Altgen’s photo.

The Warren Commission “identified” the individual as Billy Lovelady, a fellow Book Depository employee. But while Lovelady identified the person in the Altgens’ photo as himself, he also stated that he’d worn a red and white vertically striped shirt on the day of the assassination The man in the doorway’s shirt in not striped and is open in front, exposing the tee shirt underneath.

In color films taken from another angle, the color of the shirt worn by the man in the doorway was revealed to be orange-brown. When Oswald was arrested, he was wearing the identical shirt- an orange-brown tweed with missing buttons and tee-shirt underneath.

Other films taken on November 22, 1963 revealed that Lovelady was in fact wearing a red and blue plaid shirt.

Hence, the figure in the doorway is NOT Lovelady.

(Billy Lovelady died of a heart attack Jan 1979)

Obama Skips the Kennedy Tax Cuts

After delivering a number of “economic growth” speeches this summer, President Obama has failed to inspire any confidence, falling all the way back to square one in a recent Gallup poll. Actually, make that less than square one. Gallup reported that Obama’s approval rating on the economy has sunk to 35 percent in August, from 42 percent in early June.

Why should we be surprised?

The actual economy shows real gross domestic product falling well below 2 percent. This so-called recovery remains the worst in modern history dating back to 1947.

And as far as solutions go, Obama keeps giving us the same old, same old: End the spending-cut sequester, lower tax deductions and raise taxes on the rich, all to free up money for infrastructure, green energy, “manufacturing innovation initiatives” and the teachers unions.

Of course, this would all come on top of Obamacare, which if it doesn’t fall of its own weight, will add so many new taxes and regulations that it will sink the economy even more.

The Gallup poll also reflected voter fatigue over Obama’s stale class-warfare act. It’s a leftover from his first term. He talks about a “winner-take-all economy where a few do better and better while everyone else just treads water.” It’s a bore. It’s unproven. It’s like his new phrase of “an economy that grows from the middle out.” No one knows what this means because it doesn’t mean anything.

Speaking in Galesburg, Ill., this summer, however, Obama served up a convenient historical fairy tale: “In the period after World War II,” he said, “a growing middle class was the engine of our prosperity.” Presumably he was thinking of a time when high taxes on the rich and industrial-union rule had the middle class soaring. The trouble is, Obama’s history is wrong.

From 1944 to 1960, with a top tax rate of 91 percent, the U.S. economy expanded at an anemic 2.1 percent annual pace, according to economic historian Brian Domitrovic. And during the Eisenhower years, the economy grew at a subpar 2.4 percent yearly rate, including three recessions, which Domitrovic says made for “the worst growth of any postwar president until George W. Bush and Barack Obama came along.”

So much for postwar prosperity.

But then came the 1960s, the decade liberals love to hate. Why? Because the path-breaking supply-side tax cuts of John F. Kennedy generated one of the greatest booms in economic history.

Actually, according to Domitrovic, it was two big tax cuts. The first was a business tax cut put in place in 1962, and the second was an across-the-board personal tax cut that began in early 1964.

The result? Domitrovic reminds us that the eight-year expansion from 1961 to 1969 saw growth of 48 percent — a third more in an eight-year period than in the 16 years ending in 1960. So the postwar prosperity of 1944 to 1969 did exist at roughly 3 percent per year. But only because the 1960s lifted everything up. Kennedy cut the top tax rate from 91 percent to 70 percent, but all other tax rates were also reduced for top-to-bottom income earners.

Conveniently, John Kennedy’s powerful tax-cut slashing on business, individuals and investors doesn’t exist in the left’s postwar, economic narrative. It’s been rubbed out of history, replaced by a liberal vision of powerful unions and high tax rates on the rich, which is supposed to create growth. And expectedly, Obama and the Left never make the connection between the Kennedy tax cuts and the Reagan tax cuts 20 years later, which essentially copied the JFK model.

Not only did Reagan copy JFK’s across-the-board rate reduction, he even dusted off his rhetoric. Reagan frequently talked about a rising tide lifting all boats, after-tax incentives to keep more of what you earn and how lower tax rates produce higher tax revenues. In fact, Reagan credited Kennedy when the 1980s tax cuts got the economy moving again.

Domitrovic calls the postwar, pre-tax-cut era the “fairy tale about the 1950s prosperity which has been current for several decades.” When President Obama talks about a grand bargain for corporate tax reform to raise more revenues to be used for more stimulus spending, or a budget that would end the sequester and its budget caps and stick it to the well-to-do with a near $ 1 trillion tax hike, he completely skips the Kennedy-Reagan growth story.

None of Obama’s tax-and-spend proposals will pass the current Congress. He knows that, and so does everybody else. But to suggest that his policies would benefit the middle class or the rest of the economy is cynical and misleading.

President Obama is a former law professor. Even accounting for his huge policy differences with JFK and Reagan, he should do us all the courtesy of getting his history straight.
