Drug court judge allegedly drunk during proceedings; goes to rehab instead of jail

Judge Gisele Pollack
(Source: ABC)

BROWARD COUNTY, FL — A Florida judge presiding over misdemeanor drug cases reportedly showed up to work intoxicated and had to be removed from court. In a palpable irony, even a person who has dedicated her career toward meddling in other people’s lives and using the force of government against them is herself incapable of keeping herself sober at work. The judge faces no legal consequences and instead of being carted off to jail like so many of the recreational drug users she has dealt with, she will voluntarily put herself in rehab.

Judge Gisele Pollack, who founded Boward County’s misdemeanor drug court in 2005, was seen verbally assaulting her judicial assistant and yelling for her car keys to be returned before another judge intervened, according to an unidentified source.

The tirade followed Pollack’s abrupt dismissal of the day’s session after only serving an hour and a half on the bench, during which time she began slurring her words while addressing defendants.

“She’s not afraid to lock somebody up if they’re repeatedly thumbing their nose at authority.”

One can only speculate how many cases Pollack, an admitted alcoholic, may have presided over while under the influence. She says she will address what she calls “health issues” during an intensive two week outpatient program before returning to the bench.

Not everyone in the legal community feels that’s quite an adequate remedy.

“Could you imagine doing a night in jail because a judge couldn’t understand or appreciate your argument?” said attorney Steven Schaet. “If she’s adversely affected someone’s life, she shouldn’t be on the bench.”

There are thus far no indications Pollack will face official disciplinary action. She has, however, checked herself into rehab.

Pollack’s court provides misdemeanor drug offenders opportunities to have their charges dismissed and their records wiped clean if they complete six months of rehabilitative treatment. Offenders who relapse face tougher consequences.

“She’s not afraid to lock somebody up if they’re repeatedly thumbing their nose at authority,” said defense attorney Bill Gelin.

In view of the vague penalties high-profile offenders are handed relative to the punishments routinely meted out to the commonfolk, it’s clear American society operates with orders of jurisprudence. U.S. Senator Donne Trotter, for instance, received one year of court supervision after he was caught trying to smuggle a handgun onto a plane at O’Hare airport late last year, and Keith Tabron, a former “Detective of the Year” for the Washington D.C. police department, was given a five year suspended sentence and probation for furtively videotaping his stepdaughter in the shower; a felony that under Maryland law demands sex offender registration. Prosecutors granted Tabron immunity from this provision, ostensibly because he had no prior criminal history.

Addiction is a tragic and destructive problem, as Judge Pollack surely must be aware. But it is not one that the government is capable of fairly or competently dealing with. In the spirit of justice, one would hope when she returns to the bench, she comes back with a new outlook on the oppressive War on Drugs… and that she comes back in a lucid state when holding people’s fates in her hands.

NBC and ABC Bash Reagan as Pro-Apartheid During Mandela Coverage

Amid the tributes looking back at the life of former South African President Nelson Mandela following his death on Thursday, Friday’s NBC Today and ABC’s Good Morning America both managed to take shots at Ronald Reagan for not being supportive of Mandela during Apartheid. [Listen to the audio]

On Today, chief foreign affairs correspondent Andrea Mitchell proclaimed: “The U.S. wasn’t always on Mandela’s side. In the 1980s, President Reagan supported the Apartheid regime, a cold war ally, even as protests broke out on college campuses across America demanding that the U.S. punish the regime….Finally, Congress, including key Republicans, overrode Reagan’s veto, imposing the economic sanctions that helped break the Apartheid regime.”

On Good Morning America, human rights attorney Gay McDougall took a similar jab at Reagan: “Americans took a stand against Apartheid and said no to our government, when Ronald Reagan wanted to solidify, you know, U.S. support for Apartheid. We said no, we said sanctions, and we played an important role.”

Mitchell and McDougall both failed to describe the full context of Reagan not backing Mandela. In a Thursday article examining the complexity of Mandela’s legacy, Brietbart’s Joel Pollak, originally from South Africa, explained:

The ANC [African National Congress] remained banned in the country [South Africa], but its military wing continued to operate within Southern Africa, with assistance from the Soviet Union. The decision to align with the Soviet Union would later haunt the ANC, as it alienated the United States and Great Britain, which were otherwise inclined to support the anti-apartheid movement (and did so, albeit in limited fashion). While Mandela was in prison, the Soviet-trained leaders of the ANC’s army committed human rights abuses in military camps outside the country, and used terror attacks on civilians inside South Africa.

Pollak elaborated during an appearance on Mark Levin’s radio show that evening.

Prior to reciting the anti-Reagan talking points, Mitchell’s Today report began with her gushing over how Mandela influenced President Obama:

MITCHELL: Nelson Mandela transformed his nation and the world. A freedom fighter with the grace and courage to forgive his oppressors, inspiring generations of civil rights leaders and a young Barack Obama, who recalled a rally on his own college campus.

BARACK OBAMA: My very first political action. The first thing I ever did that involved an issue or a policy or politics was a protest against Apartheid.

MITCHELL: As a senator, Obama had visited Mandela. And the President and Mrs. Obama brought their daughters to Robin Island Prison so they could better understand what Mandela had suffered. After he died, Michelle Obama tweeted, “We will forever draw strength and inspiration from Nelson Mandela’s extraordinary example of moral courage, kindness, and humility.”

Here is a full transcript of Mitchell’s December 6 report:

8:03AM ET

SAVANNAH GUTHRIE: Let’s go to NBC’s Andrea Mitchell. She’s been following the outpouring of tributes pouring in all around the world. Andrea, good morning to you.

[ON-SCREEN HEADLINE: Remembering Nelson Mandela; World Leaders Pay Tribute to Fmr. Leader]

ANDREA MITCHELL: Good morning, Savannah. Nelson Mandela is indeed being mourned around the world and here at home by the Americans whose lives he influenced, starting with the President of the United States.

Nelson Mandela transformed his nation and the world.

Bill Clinton tweeted a picture and wrote, “I will never forget my friend Madiba,” using the affectionate name by which Mandela was known to his followers.

But the U.S. wasn’t always on Mandela’s side. In the 1980s, President Reagan supported the Apartheid regime, a cold war ally, even as protests broke out on college campuses across America demanding that the U.S. punish the regime.

[SONG PLAYING: "Free Nelson Mandela"]

“Free Nelson Mandela” became a popular anthem for black and white Americans. Finally, Congress, including key Republicans, overrode Reagan’s veto, imposing the economic sanctions that helped break the Apartheid regime. That set the stage for Mandela’s triumphant visit to Washington as his country’s president.

NELSON MANDELA: We are to one another brother and sister. A united rainbow nation that derives its strength from the bonding of its many races and colors.

MITCHELL: Bono, Mandela’s great friend, wrote, “In the end, Nelson Mandela showed us how to love rather than hate. Not because he had never surrendered to rage or violence, but because he learned that love would do a better job.” Savannah.

GUTHRIE: Well chosen words. Andrea, thank you so much.

US may have illegally monitored foreign dignitaries as well as wider population

The latest revelation to come from the Edward Snowden leaks highlights how the NSA conducted a mass spying exercise with the co-operation of Canadian authorities during international meetings in order to further certain policy goals.

In a report by The Canadian Broadcasting Company, it is revealed that Prime Minister Stephen Harper’s government colluded with the NSA during the 2010 G8 and G20 summits in Toronto.

Documents marked “Top Secret,” highlight how the US embassy in Ottawa was transformed into a spy centre compound for a week as president Obama met with 25 foreign dignitaries and leaders.

The NSA was aided by its Canadian counterpart, the Communications Security Establishment Canada (CSEC).

While the documents do not specifically state who the target of the huge operation was, it is thought that the exercise is most likely a repeat of what occurred in Britain just a few months earlier during the 2009 G20 summit in London. There, as other NSA leaks have revealed, the U.S. and Canadian intelligence agencies, along with Britain’s GCHQ are said to have hacked the phone calls and emails of multiple foreign politicians and diplomats.

The document pertaining to the Toronto summit states that the NSA’s goal was, at least in part, “providing support to policymakers” at the meetings, namely providing what would have been private information to the Canadian and US leaders in order to give them an advantage during negotiations and debates.

The documents once again highlight how the NSA surveillance dragnet extends beyond simply protecting against security threats, and has become a commonplace tool for the US government and its allies, The United Kingdom, Canada, Australia, and New Zealand. The so called “Five Eyes” have had a surveillance agreement dating back to the 1950s, it was only revealed to have existed in 2005.

If true, the latest revelations would once again show how the NSA and its partner spy agencies are routinely breaking the law. Under Canadian law, a warrant must be issued in order for the government to conduct covert surveillance on anyone, including foreign visitors. Foreign spy agencies also do not have jurisdiction on Canadian soil.

“If CSEC tasked NSA to conduct spying activities on Canadians within Canada that CSEC itself was not authorized to take, then I am comfortable saying that would be an unlawful undertaking by CSEC,” says Craig Forcese, an expert in national security at University of Ottawa’s faculty of law.

“[The CSEC is] undermining democracy here at home, while deeply damaging Canada’s international reputation as a fair and honest partner,” said Steve Anderson, executive director of OpenMedia.ca, a Canadian civil liberties group.

The US government has refused to comment. Canadian Prime Minister Stephen Harper’s office has also refused to comment, citing national security.

Hungry during the holidays

  • CNN’s Rosa Flores was moved by a woman she met covering a story

  • Katherine M. is raising her three grandchildren on food stamps and very little money

  • To earn extra cash, Katherine collects aluminum cans on the streets of Harlem

  • How can you help? Go to CNN.com/impact

Editor’s note: CNN correspondent Rosa Flores reported on food stamp changes in early November, but she had a hard time forgetting the woman she profiled in the story. This woman is just one of many people who may go hungry this holiday season.

New York (CNN) — I’m no stranger to poverty. I’ve lived it. I don’t forget it. And when I saw Katherine M. pick up aluminum cans while walking her granddaughter home from school, I couldn’t stop the rush of emotions. I wasn’t reporting from a developing country. This was a New York street in the heart of Harlem.

“If I don’t have my gloves, I don’t dig into the garbage,” Katherine said as she walked past dozens of black plastic trash bags that lined the street.

I met her at a soup kitchen while covering a story about the end of the food stamp benefit boost from the 2009 American Recovery and Reinvestment Act.

“You’ve gotta do your homework, and I’ve gotta do your hair,” Katherine said with a smile to her 9-year-old granddaughter, Katherine.

In 2004, her daughter died in childbirth, making the now-66-year-old a caretaker of three overnight. That’s when she went back to changing diapers and taking care of two young boys with small attention spans and big appetites.

Raising children on a fixed income was not easy for Katherine. Receiving $ 358 a month in food stamps helped but didn’t cover all her grocery needs.

On November 1, her food stamp benefits shrunk. That’s when the boost in benefits from the 2009 American Recovery and Reinvestment Act ended. About 47 million Americans saw their benefits reduced, too. For Katherine, less food stamp benefits meant collecting more cans on the street and from friends.

“I tell everybody here, ‘give me your cans,’ ” she said.

She redeems the cans for 5 cents each.

Talking to strangers like me about her economic situation was not easy.

“I don’t like that word, ‘poor,’ ” she said. “I’m bent.”

“What does bent mean?” I asked.

“Poor, but I don’t like the word poor,” she said.

Katherine M. is just one of millions of people affected by changes to food stamp benefits.

After Katherine’s story aired, a generous viewer from Florida helped her shop for groceries so that this Thanksgiving, she doesn’t have to sell cans to put food on the table.

Life has been rough on Katherine, but you’d never know from the constant smile on her face. She laughs about the small joys in life and about its tough lessons, as well.

“Here, you pick that up for me,” Katherine instructed her young granddaughter, pointing to a bottle resting against a fence.

Young Katherine used her small hands to pick up the bottle and give it to Grandma, who put it in a small black plastic bag. We all continued walking.

As I observed and listened, I could feel a knot growing in my throat.

“I don’t want her to feel ashamed because she have to pick up cans to eat or get the things that she needs,” Katherine said as she looked in every direction for plastic or aluminum. “No matter how people look at you, you keep your head up.”

“Do you think it’s an important lesson?” I asked.

“Yeah, it shows young kids how to be independent,” she responded.

By this time, I was holding back my tears. It was a lesson I learned too, at a very early age. And I was seeing another young girl receive the same advice.

According to Feeding America, 15.9 million American children lived in food-insecure homes in 2012. While many American children are thinking about the latest version of their favorite smartphone or tablet this season, millions of children across the country, like little Katherine, don’t know where their next meal will come from.

Missouri Legislator & Wife Ask Court for Protection During Obamacare Lawsuit Appeal

Thomas More Society Seeks Preliminary Injunction for State Rep. Wieland and Family

ST. LOUIS, Nov. 25, 2013 /Christian Newswire/ — Today, Thomas More Society attorneys filed for preliminary injunctive relief on behalf of Missouri State Representative Paul Wieland and his wife Teresa in the couple’s lawsuit contesting Obamacare’s infringement on their First Amendment rights. The couple is asking the United States Court of Appeals for the Eighth Circuit to exempt their family from the Health and Human Services mandate that would require them to participate in group insurance coverage that includes abortion-inducing drugs, sterilization, and birth control for their teenage and adult daughters.

The Wielands are suing the federal government for violating their religious liberty, free speech, and parental rights by reason of Obamacare’s mandating a religiously objectionable health insurance plan provided by the State of Missouri. Beginning January 1, 2014, the Patient Protection and Affordable Care Act mandates that the Wielands obtain for themselves, and provide for their dependent daughters, health care coverage that includes coverage for “contraceptive methods, sterilization procedures, and patient education and counseling for all women with reproductive capacity.”

This coverage, which is abhorrent to the Wielands, given their Catholic faith, is mandated to continue until their dependent daughters are 24 years old. The Eighth Circuit court and other federal appellate courts have held that for-profit employers are likely to prevail on similar claims under the Religious Freedom Restoration Act, because their free exercise of religious faith is substantially burdened when the government forces them to provide such coverage for their employees. The Wielands claim that their religious freedom – Paul’s as an employee and both Wielands, as parents, is also protected under the act.

The Wielands had previously obtained a health insurance plan that did not include abortion-inducing drugs and contraceptives. But because of the Health and Human Services mandate, that plan was eliminated and, without their permission, the Wielands were transferred to another plan that is contrary to their Catholic faith.

“We liked our health care plan. We should be able to keep it,” Mrs. Wieland said. “It protected our religious beliefs and our rights as parents.”

To date, forty for-profit employers have filed lawsuits over the controversial Obamacare mandate. Thirty-two of the plaintiffs have secured injunctive relief against the mandate. “There is every reason to expect that the Wielands will also prevail in their quest to secure their religious liberty,” said Timothy Belz, special counsel for the Thomas More Society, who is representing the Wielands.

According to veteran court watchers, the U.S. Supreme Court on Tuesday will consider whether to take up one or more of four cases on the mandate decided in the lower courts – including an appeal by the Obama Administration of the Hobby Lobby decision by the Tenth Circuit in June that upheld the right of the Christian craft store chain to exclude abortion-inducing drugs and devices in their employee’s health plans.

The lawsuit by the Wielands names the U.S. Department of Health & Human Services, U.S. Department of the Treasury, and U.S. Department of Labor as defendants.

I was upset to see that Milo and Otis was on the list of problem movies.
It was adorable. The story was fun. And there were cute animals.
It’s a childhood favorite for many people.
But the rumors that wont die are that dozens of kittens died during filming.
I’m in shock …. really …
