Overemphasis on “Climate Change” Has Made California’s Water Crisis Worse

President Barack Obama offered the desperate farmers and farmworkers of the drought-stricken Central Valley a desultory relief package last week: $ 1 billion for a “climate resilience fund,” plus “summer meals” and various other kinds of aid. For a president who boasts of his willingness to use executive action, it was a pathetic display of sophistry, full of mumbles about how water management is not a “zero-sum game”–though in this case, it is.

As the Investor’s Business Daily and countless others have noted, water management in California is a trade-off between the needs of farmers and the demands of the environmental movement, which has embraced the delta smelt, an obscure endangered species in the Sacramento-San Joaquin River delta. The Democrats, and Obama, have supported the environmentalists over the farmers–and the subsequent flushing of California’s reservoirs.


It may be true that the delta smelt is a species on which the whole regional ecosystem depends, and that its disappearance could have a negative effect on fishing, among other impacts. But that calls for wise management involving all stakeholders–not the blunt instrument of the federal courts, which utopian environmental activists have used precisely because they do not want to have to face the real challenges of water conservation.

The Obamacare Security Nightmare: It Gets Worse


Fraudsters on the inside, hackers on the outside. Here we are, stuck in the middle with the security nightmare called Obamacare. Can it get any worse? Yes, it can.


After the spectacular website crashes during last fall’s federal health insurance exchange rollout, enrollees will soon wish the entire system had stayed down and dead. “404 Error” messages and convicted felon Obamacare navigators may be the least of our health care tech problems now. The latest? U.S. intelligence agencies notified the Department of Health and Human Services last week that the Healthcare.gov infrastructure could be infected with malicious code.


Who’s responsible? Washington Free Beacon national security reporter Bill Gertz writes that U.S. officials have “warned that programmers in Belarus, a former Soviet republic closely allied with Russia, were suspected” of possible sabotage. A government tech bureaucrat in the Belarusian regime bragged last summer on Russian radio that HHS is “one of our clients” and that “we are helping Obama complete his insurance reform.”


Gulp. When an authoritarian minion from the country known as “Europe’s last dictatorship” boasts about “helping” the Obama White House, be afraid. One of our intel people spelled it out for Gertz: “The U.S. Affordable Care Act software was written in part in Belarus by software developers under state control, and that makes the software a potential target for cyber attacks.”


No kidding. The friends of Vladimir Putin are not our friends. If you’ve been paying attention, you know that Belarus and other Eastern European hacking gangs have been at the center of several recent international cybercrimes. These aren’t merely schemes to steal credit card numbers or vandalize websites with annoying graffiti. They’re acts of espionage and sabotage — like using malware in a phishing scheme aimed at White House employees to gather military intelligence and pilfer sensitive government documents.


It’s not just the federal health care system’s problem. Former Obamacare website contractor CGI still holds dozens of contracts with other federal agencies and state governments worth billions of dollars — and wide access to health and financial data. In my state of Colorado, for example, CGI has a $ 78 million contract to “modernize, host and manage” the state’s financial system. Have they checked to see whether Belarus hackers are standing by?


For their part, Obamacare officials are making their usual “don’t worry about it, the problem’s under control” noises. But we already know the problem is far out of control. Last month, GOP oversight hearings exposed persistent failures by Obamacare overseers to fix security lapses.


Former most-wanted cybercriminal Kevin Mitnick concluded in a letter to Capitol Hill: “It’s shameful the team that built the Healthcare.gov site implemented minimal, if any, security best practices to mitigate the significant risk of a system compromise.” If the latest warnings from our intel agencies are any indication, it appears that Obamacare Keystone Kops didn’t just leave out security protections, but also may have allowed foreign programmers to write in cyber-traps.


David Kennedy, head of computer security consulting firm TrustedSec LLC and a former cybersecurity official with the National Security Agency and the U.S. Marine Corps, warned that “Healthcare.gov is not secure today” and said nothing had changed since he gave Congress that assessment three months before. Among the vulnerabilities that the Obama administration still hasn’t fixed:


–TrustedSec “identified the ability to enumerate user information (first, last, email, user id, profile, etc.) through one of the sub-sites that directly integrates into the healthcare.gov website.”


–”Tens of thousands of user-based data appears to be vulnerable on the specified website and has not been addressed. There are a number of other exposures that have been reported privately that continue to expose users of the healthcare.gov website.”


–Another exposure identified is “the ability to perform an open redirect.” In fact, “there are multiple open redirects still vulnerable on the healthcare.gov website and supporting sub-sites.” What this means is that “an attacker can send a targeted email to an individual that has signed up for healthcare.gov or is looking to and have it appear valid and legitimate and originate from the healthcare.gov website.” These can open avenues so that victims click on links “redirecting to a malicious website that hacks the computer and takes complete control over it.”

Worse Than I Realized


As I wrote below, before Wildstein’s accusations, before this afternoon’s email, I thought Christie was toast. I think’s clear for the reasons I wrote, even if Christie is totally innocent and even if no smoking gun emerges. But I hadn’t sat long enough with the Christie letter to fully digest its implications. This email is purportedly if not from Christie himself then issued in his name and from his closest advisors. On that basis it reads like it’s coming from a person or a team who is way, way further gone than I had realized.




One person said we should see the release of this email as a message to funders. If so, the message seems to be “I’m desperate and losing my mind.”


This email/memo/press release doesn’t read like a methodological takedown. It reads more like something dashed off in a climate of frenzied but impotent rage.



Look at this passage.


It’s genuinely shocking that a sitting governor and presidential aspirant finds himself or his key defenders writing a sentence like this: “He was publicly accused by his high school social studies teacher of deceptive behavior.”


I mean, is that a joke? Or, he’s someone who “made moves that were not productive”?


Seriously, who wrote this?


What’s funny is that many people who know the guy have no trouble saying Wildstein in a brilliantly sleazy guy, someone with a taste for dirty politics and would, as the letter finally says, do and say anything to save David Wildstein. So even as a scorched earth attack it’s a pretty hapless effort. It shouldn’t be hard to find damning things to say about this guy.


In the cited articles, you see some of the inherent difficulties of the situation. Sleazy liar is Gov’s “eyes, ears inside The Port Authority”!


That helps.


It speaks for itself that Wildstein is out to save himself. He is not sitting on a reputation for integrity and truth-telling. So the wisdom of doing anything more than saying Wildstein is trying to save himself and lacks credibility is highly questionable. The end product here reads like it’s coming from a team or a person who is flailing and grasping at straws.


If I’m a Republican power player reading this to a get a read on what’s actually happening, what’s likely to happen next week or next month, I think I come away thinking things are considerably worse than I realized.

It’s been a disastrous couple of weeks for President Barack Obama. His signature legislation, the Patient Protection and Affordable Care Act, is a slow-motion train wreck. His poll numbers have tanked.

Now, things have gotten so bad for Obama that even former president Jimmy Carter has called President Obama incompetent in the family-friendly pages of Parade magazine.


“He’s done the best he could under the circumstances,” Carter said of Obama in an interviewed published on Thursday. “His major accomplishment was Obamacare, and the implementation of it now is questionable at best.”


Carter presided over what was, until the current recession, the longest period of economic stagnation since the Great Depression. There was runaway inflation, high unemployment and an ongoing energy crisis. There was a hostage crisis in Iran involving the capture and imprisonment of 52 Americans for 444 days.


In the summer of 1979, Carter gave one of the least effective speeches any president in the history of the American presidency. The deeply unpopular “Crisis of Confidence” speech became widely known as Carter’s “malaise” speech.


Carter lost his 1980 reelection bid to Ronald Reagan by an electoral vote total of 489 to 49. He won only six states, along with the District of Columbia.


The 39th president’s Parade interview touched on several subjects in addition to Obamacare including his grandson’s role in a hidden camera video of Mitt Romney, the Middle East, the Trayvon Martin case and the recent tribulations of fellow Georgian Paula Deen.


Carter’s wife Rosalynn was also present at the interview and contributed to it.


When asked “how he hopes history will remember him,” Carter joined the rest of America in preferring to skip over his presidency. “I’d like to be judged primarily by our work at the Carter Center for the last 32 years,” he told the magazine. “I don’t mean to exclude the White House. But in my more self-satisfied moments, I think about our unwavering promotion of peace and human rights.”

UK middle-class kids to be worse off


A watchdog is to warn that Britain™s middle-class kids will be worse off in adulthood than their parents.



Britain™s middle-class children are on track to be materially less well off in adulthood than their parents, a government commission warns.


The social mobility and child poverty commission, which was set up by British Prime Minister David Cameron, is to announce that children growing up in families with above-average income will struggle to achieve the same living standards as their parents.


“This will be controversial, but for the first time in over a century there is a real risk that the next generation of adults ends up worse off than today’s generation,” a Whitehall source said.


The commission is also expected to warn of the œperfect storm” of graduate debt and job insecurity that threaten middle-class students.


Moreover, the watchdog™s findings, which are planned to be presented to the British Parliament on Thursday, will criticize that Tory-led government™s initiatives for focusing too strongly on the poorest 10 percent of the society.


Earlier in August, a study showed that around 3.6 million children are currently growing up in relative poverty in Britain, compared to 2 million recorded in 1969.


According to the report released by the National Children’s Bureau, child poverty is now a bigger problem than during the 1960s and Britain is at risk of becoming a place where rich and poor children live in separate, parallel worlds.

WASHINGTON – On the fifth anniversary of the current fiscal crisis, the nation’s economy is getting worse under Barack Obama, according to an objective mathematical measurement of the nation’s economic indicators released Monday by Congressman Steve Stockman (R-Texas 36.)


The economy continues to fail to recover under Obama as Obama’s Failometer Score grew to a punishing 1,222 last month. This is the third straight month Obama’s Failometer score has grown, and his 1,222 for August is the second-highest score this year.


Obama can set the Failometer to zero simply by outperforming George W. Bush on the economy and fulfilling his 2008 and 2012 campaign promises to help blacks and Hispanics gain economically.


“For the third consecutive month Obama’s economic failures are getting worse,” said Stockman “The percentage of working-age American with jobs has plunged to Jimmy Carter-era depths, we aren’t creating enough jobs to restore the economy and black unemployment is growing again.”


“Hispanic unemployment is higher now than it was in April.  Black unemployment is growing again. He has yet to grow enough monthly jobs to even get back to a pre-recession economy. An objective mathematical measure of Obama’s economic policies shows he’s blazing a new path of failure.”


The Obama Failometer uses a fixed mathematical score to calculate four economic indicators from the Bureau of Labor Statistics.  The figures from the monthly reports are weighted to provide a balanced total score, which ranges from zero to 1,000. A score of 0 represent economic stability and racial equality. The higher the score, the deeper the economic failure.


So far, Obama is worse than Bush.


Since its creation, Obama has failed to generate a Failometer score that can be contained within the chart’s range of zero to 1000.


The Obama Failometer Score was originally displayed on a ten-foot-long billboard displayed in the hallways of the Capitol’s Cannon House Office building.  House officials ordered it torn down in January after Democrats complained.


Here is how the Obama Failometer Score is calculated:


FACTORS MEASURED AGAINST BUSH


Monthly jobs created: The Hamilton Project, a liberal economic policy group, stated last year the economy must create 321,000 jobs a month in order to return the economy to pre-recession employment levels by December 2016, the end of Obama’s term.


As the economy continues to flounder under Obama, that number has grown; but the Obama Failometer will continue to use it, which gives him some statistical relief.


Obama promised to not only restore the economy to where it was under Bush, but grow it.  So far, Obama has failed to even perform as well as Bush.

The Bureau of Labor Statistics reports the black unemployment rate last month ballooned to 13.0 percent, while the national overall rate was 7.3 percent.  That is a gap of 5.7 percent. This portion of the Obama Failometer Score is 570.


Compare Obama’s performance to Bush’s.  The highest monthly unemployment rate ever for blacks under Bush was 12.1 percent.  Obama’s lowest rate is now 12.6 percent in July.  He has never performed as well as Bush’s worst black unemployment rate.


Bush’s average black unemployment rate was 9.7 percent and an overall national average of 5.2 percent, a 4.5 percent gap that gives Bush a score of 450.


Hispanic unemployment:  Despite winning the Hispanic vote, Obama’s liberal policies have caused widespread damage to the Hispanic community.  Thanks to Obama, they continue to lag behind the national average in many economic factors.


This Obama Failometer score portion is calculated by taking the monthly unemployment rate for Hispanics and subtracting the monthly unemployment rate for all Americans, and multiplying it by 100 to balance it against other factors.

WASHINGTON – On the fifth anniversary of the current fiscal crisis, the nation’s economy is getting worse under Barack Obama, according to an objective mathematical measurement of the nation’s economic indicators released Monday by Congressman Steve Stockman (R-Texas 36.)


The economy continues to fail to recover under Obama as Obama’s Failometer Score grew to a punishing 1,222 last month. This is the third straight month Obama’s Failometer score has grown, and his 1,222 for August is the second-highest score this year.


Obama can set the Failometer to zero simply by outperforming George W. Bush on the economy and fulfilling his 2008 and 2012 campaign promises to help blacks and Hispanics gain economically.


“For the third consecutive month Obama’s economic failures are getting worse,” said Stockman “The percentage of working-age American with jobs has plunged to Jimmy Carter-era depths, we aren’t creating enough jobs to restore the economy and black unemployment is growing again.”


“Hispanic unemployment is higher now than it was in April.  Black unemployment is growing again. He has yet to grow enough monthly jobs to even get back to a pre-recession economy. An objective mathematical measure of Obama’s economic policies shows he’s blazing a new path of failure.”


The Obama Failometer uses a fixed mathematical score to calculate four economic indicators from the Bureau of Labor Statistics.  The figures from the monthly reports are weighted to provide a balanced total score, which ranges from zero to 1,000. A score of 0 represent economic stability and racial equality. The higher the score, the deeper the economic failure.


So far, Obama is worse than Bush.


Since its creation, Obama has failed to generate a Failometer score that can be contained within the chart’s range of zero to 1000.


The Obama Failometer Score was originally displayed on a ten-foot-long billboard displayed in the hallways of the Capitol’s Cannon House Office building.  House officials ordered it torn down in January after Democrats complained.

Is the NYPD Worse Than the NSA?

The surveillance debate triggered by Edward Snowden’s leaks frequently features government spokespeople assuring Americans that the authorities aren’t targeting us with their spying activities. Implicit is the notion that if Americans were being targeted, that would be an abuse of power. 


In New York City, the debate is different, because there’s no doubt about the NYPD’s surveillance tactics: they’re definitely targeting innocent Americans citizens and legal residents. And that’s an ongoing abuse of power, even if comparatively fewer people have heard about it.


We’ve known for some time that innocent Muslim Americans were ethnically profiled by undercover NYPD officers, causing significant, under-acknowledged hardship in affected communities. Earlier this summer, Charlie Savage reported on four C.I.A. officers embedded within the NYPD, despite the strict rules governing the spy agency’s behavior within the United States. And today, New York has published “The NYPD Division of UnAmerican Activities,” in which Matt Apuzzo and Adam Goldman unearth even more alarming details about the NYPD Demographics Unit.


  • Official secrecy defined the program from the beginning. “Documents related to this new unit were stamped NYPD SECRET. Even the City Council, Congress, and the White House–the people paying the bills–weren’t told about it.”

  • This is straight-up profiling. “They mapped, looking for 28 ‘ancestries of interest.’ Nearly all were Muslim. There were Middle Eastern and South Asian countries such as Pakistan, Iran, Syria, and Egypt. Former Soviet states like Uzbekistan and Chechnya were included because of their large Muslim populations. The last ‘ancestry’ on the list was ‘American Black Muslim.’”

  • Files on New Yorkers were started on the flimsiest of pretexts. “One Muslim man made it into files even though he praised President Bush’s State of the Union address and said people who criticized the U.S. government didn’t realize how good they had it. Two men of Pakistani ancestry were included for saying the nation’s policies had become increasingly anti-Muslim since 9/11. Muslims who criticized the CIA’s use of drones to launch missiles in Pakistan were documented.”

  • Inevitably, spying was used for purposes other than counterterrorism. “Surveillance turned out to be habit-forming… Undercover officers traveled the country, keeping tabs on liberal protest groups like Time’s Up and the Friends of Brad Will. Police infiltrated demonstrations and collected information about antiwar groups and those that marched against police brutality. Detectives monitored activist websites and copied the contents into police files, including one memo in 2008 for Kelly that reported the contents of a website about a group of women organizing a boycott to protest the police shooting of Sean Bell, an unarmed black man killed the morning before his wedding.

The full story contains a lot more objectionable behavior, and after reading how the undercover officers operate it’s easy to understand why the unit would cause Muslim American mosque attendees, small business owners and patrons, and students throughout the city to grow paranoid in their daily lives. And defenders of the program are unable to point to even a single case where it prevented a terrorist attack — in fact, they can’t even point to a terrorism-related arrest or prosecution. 


Usually, when I write phrases like, “This is how a secret police force with files on innocent Americans starts,” I’m issuing a warning about the future. But the NYPD literally started a secret police unit that began indiscriminately keeping files on innocent Americans. This isn’t a warning about a slippery slope. It is an observation about ongoing abuse of civil liberties in America’s biggest city.

How Keeping Abortions Underground Makes Health Care Worse for Everyone

Like many African nations, Kenya’s health care system faces many challenges, including severe rates of malaria and HIV/AIDS. But according to a new report published by the Kenyan Ministry of Health, one change could go a long way toward reducing stress on a hugely overburdened system: allowing more women to have an abortion. 


Though Kenyans reconsidered an existing abortion ban when writing their 2010 constitution, the nation’s top legal document still virtually forbids the procedure. Exceptions are only allowed during health emergencies, as determined by a trained health professional (although at least one US congressman was outraged that even these exceptions made it into the final constitution). Yet outlawing abortion has done little, if anything, to reduce the number of procedures. In 2012, the period of the study’s analysis, researchers estimated that Kenyan women underwent nearly 465,000 induced abortionsabout 48 for every 1,000 women of reproductive age, well above the estimated rates for both Africa (29 per 1,000) and the world (28 per 1,000).


But keeping abortions underground has led to an incredible rate of complications, putting a strain on an already overburdened health care system. In 2012, almost 120,000 Kenyan women, or more than a third of all women who underwent the procedure, experienced complications. The vast majority of these complications, the researchers found, followed “unsafe abortions” carried out by untrained people or “in an environment that does not conform to minimal medical standards.”


Most of these unintended side effects were quite serious: 77 percent of these 120,000 women suffered complications that were “moderately severe” or “severe,” according to the study. Out of 100,000 unsafe abortions in Kenya today, the researchers estimated, 266 women die. That rate is lower than the World Health Organization’s estimate for all of sub-Saharan Africa (520 deaths per 100,000 unsafe abortions), but far higher than in developed regions, where the rate is estimated to be 30 per 100,000.


Loosening the virtual abortion ban may not end Kenya’s flood of post-abortion complications overnight, but it could save innumerable lives. Kenya’s northern neighbor shows why: In 2004, following an outcry over abortion-related deaths, the Ethiopian legislature decriminalized abortion under certain conditions, such as rape, incest, or when the mother is a minor or has a physical or mental disability. About 27 percent of abortions in Ethiopia are now performed in clinical conditions, and despite lower life expectancy and a lower doctor-patient ratio than Kenya (both measures of overall health care quality), as of 2008, the rate of abortion-related complications in Ethiopia was only 20 percentstill high, but far lower than in Kenya. 


But the real takeaway from this study, and why US states pondering their own supercharged abortion restrictions should pay attention, is how unsafe abortions harm more than just the women on whom they are performed. The researchers estimated that in 2012, more than 119,000 women in Kenya were treated for abortion-related complications. “The treatment of abortion complications uses a large amount of scarce health systems resources,” they write.In other words, unsafe abortions reduce everyone’s access to health care. 


“Improved access to high-quality comprehensive abortion care,” the researchers state, “will not only save lives, but also reduce costs to the health system.”

THE FBI says a man has been arrested at a Michigan movie theatre wearing body armour and carrying a gun.



Cassidy Delavergne wasn’t charged with crimes related to the armour, the gun or 34 rounds of ammunition. But he was charged yesterday with possessing a phony Central Intelligence Agency identification card.


FBI spokesman Simon Shaykhet says police were called to the Trillium Theater in Grand Blanc Township near Flint on Tuesday night after someone noticed the vest and gun.

Delavergne was watching a movie when police arrived.


Shaykhet declined to say whether agents believe Delavergne planned to use his handgun.


A court filing says Delavergne told an agent he displayed the phony ID to minimise concerns about his gun. Delavergne claimed to have a concealed weapon permit.

Analysis: Bank of America"s interest-rate exposure may be worse than rivals"

NEW YORK (Reuters) – Bank of America Corp’s (BAC.N) balance sheet suffered from rising bond yields in the second quarter, suggesting that the second-largest U.S. bank may be more exposed to interest-rate risk than some of its major rivals.


The bank posted a profit for shareholders of $ 3.57 billion in the second quarter, but on its balance sheet the picture was not as good – its net worth fell by $ 6.26 billion as a result of investment losses. Rivals JPMorgan Chase & Co (JPM.N) and Citigroup Inc (C.N) both managed to increase their net worth as measured by their book value.


The unrealized losses bode ill for investors hoping Bank of America will increase share buybacks and dividends.


As bond yields – and eventually interest rates – rise, further losses in its portfolio could prevent it from building its net worth, making it hard to convince regulators the bank can return more capital to shareholders.


Bank of America appears to have used mortgage bonds in an investment portfolio to bet yields would stay stable and relatively low, say analysts who studied the size and composition of its holdings.


It lost that bet. U.S. bond yields surged after Federal Reserve Chairman Ben Bernanke said the bank would taper its latest bond buying programs. Bank of America booked some $ 5.73 billion of paper losses from these securities in the quarter, and still held about $ 170 billion as of June 30.


Those losses and others were in a portfolio, known as the “available-for-sale” book, which affects a bank’s balance sheet but does not affect earnings.


The Charlotte, North Carolina-based bank also may have made similar, large bets about rates in the derivatives markets that will lead to more losses if yields rise, analysts said, based on the bank’s prior disclosures.


“Every bank has their risk where they’re willing to go out on a limb, and rate risk is what Bank of America is willing to go out on a limb for,” said Charles Peabody, a partner at Portales Partners, an equity research and trading firm.


According to Peabody’s estimates, Bank of America has a higher percentage of residential mortgage-backed securities in its available-for-sale portfolio than JPMorgan and Citigroup. Higher exposure to RMBS implies it has greater exposure to rising rates.


“They shine at taking rate risk over time, but it can come back to haunt them, too,” Peabody said. He rates Bank of America an “underperform,” and last month correctly predicted that the bank would generate billions of dollars of losses in its available-for-sale portfolio.


Bank of America spokesman Jerry Dubrowski declined to comment.


For this year, the bank already has approval from regulators to buy back up to $ 5 billion in common shares and redeem approximately $ 5.5 billion in preferred stock.


By some measures, the bank is building capital, and is ahead of rivals. For example, Bank of America boosted its capital levels under new international rules, known as Basel III, above those of JPMorgan. Regulators consider multiple measures of capital and leverage in assessing a bank.


GOOD AND BAD SCENARIOS


As of Wednesday, investors seem to be more pleased with the bank’s lower operating expenses and higher revenues than worried about any decrease in tangible book value. Bank of America shares closed at $ 14.31, their highest level since March 2011.


Many investors also hope that bond yields have stabilized at higher levels. So far this month, the 10-year U.S. Treasury yield has remained relatively flat at 2.49 percent. It rose 0.87 percentage points to 2.49 percent between May 3 and the end of the second quarter.


In this scenario, Bank of America may be able avoid hits to its balance sheet from losses in its investment portfolio and deflect criticism from investors.


Continued growth in earnings would also offset those unrealized losses. Chief Financial Officer Bruce Thompson said it would likely take three years for net interest income to offset the decline in its securities portfolios due to the rise in yields.


“You’re going to have earnings improving, which is what the markets are going to be looking at. It just takes a little time to get there,” said Marty Mosby, an analyst at Guggenheim Securities.


But in a worst-case scenario, one of minimal economic growth coupled with rising bond yields, the bank’s income could be squeezed and it could suffer further investment losses. Both of those factors would decrease bank capital.


Declines in the value of the bank’s available-for-sale portfolio have another impact on its books: they prevent the bank from using tax benefits it has accumulated, known as “deferred tax assets.”


Bank of America’s rate risk has spooked some investors.


“Rising rates will not be a benefit for Bank of America or any big bank in the short-term. That’s why we’re staying away,” said Malcolm Polley, chief investment officer at Stewart Capital Advisors, which has about $ 1.1 billion under management.
